background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">av\u00e2nd \u00een vedere avizul Parlamentului European [2],<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">av\u00e2nd \u00een vedere avizul Comitetului Economic \u0219i Social European [3],<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">av\u00e2nd \u00een vedere avizul Comitetului Regiunilor [4],<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">\u00eentruc\u00e2t:<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(1) O politic\u0103 comun\u0103 \u00een domeniul azilului, care prevede un sistem european comun de azil, este un element constitutiv al obiectivului Uniunii Europene care urm\u0103re\u0219te instituirea progresiv\u0103 a unui spa\u021biu de libertate, securitate \u0219i justi\u021bie deschis celor care, for\u021ba\u021bi de circumstan\u021be, caut\u0103 \u00een mod legitim protec\u021bie \u00een Comunitate.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(2) \u00cen cadrul reuniunii extraordinare de la Tampere din 15 \u0219i 16 octombrie 1999, Consiliul European a convenit s\u0103 ac\u021bioneze \u00een sensul instituirii unui sistem european comun de azil, fondat pe punerea integral\u0103 \u0219i global\u0103 \u00een aplicare a Conven\u021biei de la Geneva din 28 iulie 1951 (&#8220;Conven\u021bia de la Geneva&#8221;) privind statutul refugia\u021bilor, completat\u0103 de Protocolul de la New York din 31 ianuarie 1967 (&#8220;protocolul&#8221;), \u0219i s\u0103 garanteze c\u0103 nici o persoan\u0103 nu risc\u0103 s\u0103 fie din nou persecutat\u0103 conform precizarilor principiului \u201enonrefulment\u201d (interzicerea repatrierii daca se risca persecutia).<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\"><span class=\"Apple-style-span\">&nbsp;<\/span><span class=\"Apple-style-span\">(3) Conven\u021bia de la Geneva \u0219i protocolul aferent constituie elementul cheie al sistemului juridic interna\u021bional referitor la protec\u021bia refugia\u021bilor.<\/span><\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(4) Concluziile Consiliului European de la Tampere prev\u0103d c\u0103 sistemul european comun de azil ar trebui s\u0103 cuprind\u0103, \u00een viitorul apropiat, o apropiere a normelor privind recunoa\u0219terea \u0219i con\u021binutul statutului de refugiat.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(5) Concluziile Consiliului European de la Tampere precizeaz\u0103 totodat\u0103 c\u0103 normele privind statutul de refugiat ar trebui completate, de asemenea, prin m\u0103suri privind forme subsidiare de protec\u021bie, care ofer\u0103 un statut corespunz\u0103tor oric\u0103rei persoane care are nevoie de o astfel de protec\u021bie.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(6) Obiectivul principal al prezentei directive este, pe de o parte, s\u0103 se asigure c\u0103 toate statele membre pun \u00een aplicare criterii comune de identificare a persoanelor care au o nevoie efectiva de protec\u021bie interna\u021bional\u0103 \u0219i, pe de alt\u0103 parte, s\u0103 asigure un nivel minim de prestatii respectivelor persoane pe teritoriul tuturor statelor membre.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(7) Apropierea normelor privind recunoa\u0219terea \u0219i privind elementele definitorii ale statutului de refugiat \u0219i al protec\u021biei subsidiare ar trebui s\u0103 contribuie la limitarea circula\u021biei secundare a solicitan\u021bilor de azil \u00eentre statele membre, \u00een cazul \u00een care aceast\u0103 circula\u021bie se datoreaz\u0103 exclusiv diferen\u021belor care exist\u0103 \u00eentre cadrele juridice ale statelor membre.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\"><span class=\"Apple-style-span\">(8) Prin \u00eens\u0103\u0219i natura standardelor minime, statele membre ar trebui s\u0103 aib\u0103 capacitatea de<\/span><span class=\"Apple-style-span\">&nbsp;&nbsp;<\/span><span class=\"Apple-style-span\">prevedere sau de men\u021binere in vigoare a unor dispozi\u021bii mai favorabile pentru resortisan\u021bii \u021b\u0103rilor ter\u021be sau apatrizii care solicit\u0103 unui stat membru protec\u021bie interna\u021bional\u0103, atunci c\u00e2nd se consider\u0103 c\u0103 o astfel de solicitare se realizeaz\u0103 ca urmare a faptului c\u0103 persoana \u00een cauz\u0103 este un refugiat \u00een sensul articolului 1A din Conven\u021bia de la Geneva, sau este o persoan\u0103 care, din alte motive, are nevoie de protec\u021bie interna\u021bional\u0103.<\/span><\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(9) Nu intr\u0103 \u00een domeniul de aplicare a prezentei directive resortisan\u021bii \u021b\u0103rilor ter\u021be sau apatrizii c\u0103rora li s-a acordat permisiunea de \u0219edere pe teritoriul statelor membre din alte motive dec\u00e2t nevoia de protec\u021bie interna\u021bional\u0103, ci cu titlu discre\u021bionar, din motive umanitare.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(10) Prezenta directiv\u0103 respect\u0103 drepturile fundamentale, precum \u0219i principiile recunoscute \u00een special de Carta drepturilor fundamentale a Uniunii Europene. Prezenta directiv\u0103 urm\u0103re\u0219te \u00een special garantarea deplinei respect\u0103ri a demnit\u0103\u021bii umane \u0219i a dreptului de azil ale solicitan\u021bilor de azil \u0219i ale membrilor familiei care i se vor alatura apoi.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(11) \u00cen ceea ce prive\u0219te tratamentul persoanelor care intr\u0103 \u00een domeniul de aplicare a prezentei directive, statele membre au obliga\u021biile care decurg din instrumentele de drept interna\u021bional la care sunt p\u0103r\u021bi \u0219i care interzic discriminarea sub orice forma.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(12) In aplicarea prezentei directive, statele membre trebuie s\u0103 acorde o important\u0103 deosebit\u0103 &#8220;interesului superior al copilului&#8221;.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(13) Prezenta directiv\u0103 nu aduce atingere Protocolului privind dreptul de azil pentru ceta\u021benii statelor membre ale Uniunii Europene, anexat la Tratatul de constituire a Comunit\u0103\u021bii Europene.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(14) Recunoa\u0219terea statutului de refugiat este un act declarativ.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(15) Consult\u0103rile cu \u00cenaltul Comisariat al Organiza\u021biei Na\u021biunilor Unite pentru Refugia\u021bi pot oferi indica\u021bii utile pentru statele membre atunci c\u00e2nd trebuie s\u0103 se pronun\u021be cu privire la acordarea statutului de refugiat \u00een temeiul articolului 1 din Conven\u021bia de la Geneva.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(16) E necesar a fi stabilite standarde minime privind definirea \u0219i con\u021binutul no\u021biunii statutului de refugiat pentru a ajuta instan\u021bele judec\u0103tore\u0219ti na\u021bionale competente ale statelor membre \u00een aplicarea Conven\u021biei de la Geneva.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\"><span class=\"Apple-style-span\">(17) Este necesar\u0103 introducerea unor criterii comune care sa se aplice solicitan\u021bilor de azil \u00een&nbsp;<\/span><span class=\"Apple-style-span\">&nbsp;<\/span><span class=\"Apple-style-span\">vederea recunoa\u0219terii statului de refugiat, \u00een sensul articolului 1 din Conven\u021bia de la Geneva.<\/span><\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(18) \u00cen special, trebuiesc introduse defini\u021bii comune a urm\u0103toarelor no\u021biuni: nevoie de protec\u021bie international\u0103 aparut\u0103 atunci cand se afl\u0103 \u00een afara \u021b\u0103rii de origine (sur place); motivele projudiciului \u0219i a protec\u021biei; protec\u021bie intern\u0103; persecu\u021bie \u0219i motivele persecu\u021biei.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(19) Protec\u021bia poate fi acordat\u0103 nu numai de stat, ci \u0219i de partide sau organiza\u021bii, inclusiv organiza\u021bii interna\u021bionale, care \u00eendeplinesc condi\u021biile prev\u0103zute de prezenta directiv\u0103, care controleaz\u0103 o regiune sau o suprafa\u021b\u0103 important\u0103 din teritoriul statului.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(20) In examinarea cererilor de protec\u021bie interna\u021bional\u0103 prezentate de minori, statele membre trebuie s\u0103 \u021bin\u0103 seama de formele de persecu\u021bie specifice copiilor.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(21) De asemenea, este necesar\u0103 introducerea unei defini\u021bii comune a motivului de persecu\u021bie pe care \u00eel constituie &#8220;apartenen\u021ba la un anumit grup social&#8221;.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\"><span class=\"Apple-style-span\">(22) Ac\u021biunile contrare obiectivelor \u0219i principiilor Organiza\u021biei Na\u021biunilor Unite sunt enun\u021bate \u00een<\/span><span class=\"Apple-style-span\">&nbsp;&nbsp;<\/span><span class=\"Apple-style-span\">&nbsp;<\/span><span class=\"Apple-style-span\">preambul \u0219i la articolele 1 \u0219i 2 din Carta Organiza\u021biei Na\u021biunilor Unite \u0219i men\u021bionate, printre altele, \u00een rezolu\u021biile Organiza\u021biei Na\u021biunilor Unite privind m\u0103surile de combatere a terorismului, care prev\u0103d c\u0103 &#8220;ac\u021biunile, metodele \u0219i practicile teroriste sunt contrare obiectivelor \u0219i principiilor Organiza\u021biei Na\u021biunilor Unite&#8221; \u0219i c\u0103 &#8220;finan\u021barea \u0219i planificarea cu bun\u0103 \u0219tiin\u021b\u0103 a ac\u021biunilor teroriste, precum \u0219i incitarea la astfel de ac\u021biuni sunt \u00een egal\u0103 m\u0103sur\u0103 contrare obiectivelor \u0219i principiilor Organiza\u021biei Na\u021biunilor Unite&#8221;.<\/span><\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(23) Dup\u0103 cum prevede articolul 14, termenul de &#8220;statut&#8221; poate include, de asemenea, statutul de refugiat.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(24) Ar trebui adoptate, de asemenea, standarde minime privind defini\u021bia \u0219i elementele definitorii ale protec\u021biei subsidiare. Protec\u021bia subsidiar\u0103 ar trebui s\u0103 aib\u0103 caracter complementar \u0219i suplimentar fat\u0103 de protec\u021bia refugia\u021bilor consacrat\u0103 de Conven\u021bia de la Geneva.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(25) Este necesar\u0103 introducerea criteriilor pe care ar trebui s\u0103 le \u00eendeplineasc\u0103 solicitan\u021bii unei protec\u021bii interna\u021bionale pentru a putea beneficia de protec\u021bia subsidiar\u0103. Aceste criterii ar trebui elaborate pe baza obliga\u021biilor interna\u021bionale care deriva din documentele internationale in materia drepturilor omului \u0219i din practica deja existente \u00een statele membre.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(26) Riscurile la care popula\u021bia unei \u021b\u0103ri sau o parte din popula\u021bie este \u00een general expus\u0103 nu constituie \u00een sine o amenin\u021bare individual\u0103 care s\u0103 poat\u0103 fi calificate drept v\u0103t\u0103mare grav\u0103.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(27) Membrii familiei, doar pe baza leg\u0103turii cu refugiatul, risc\u0103, \u00een general, s\u0103 fie expu\u0219i la acte de persecu\u021bie care pot justifica acordarea statutului de refugiat.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(28) No\u021biunea de siguran\u021b\u0103 na\u021bional\u0103 \u0219i ordine public\u0103 reglementeaz\u0103, de asemenea, cazurile \u00een care un resortisant al unei \u021b\u0103ri ter\u021be apar\u021bine unei asocia\u021bii care sus\u021bine terorismul interna\u021bional sau care sus\u021bine o asocia\u021bie de acest tip.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\"><span class=\"Apple-style-span\">(29) \u021ain\u00e2nd seama c\u0103 beneficiile acordate membrilor familiei persoanelor care au primit&nbsp;<\/span><span class=\"Apple-style-span\">&nbsp;<\/span><span class=\"Apple-style-span\">protec\u021bie subsidiar\u0103 nu trebuie s\u0103 fie \u00een mod necesar echivalente cu cele acordate beneficiarului care \u00eendepline\u0219te condi\u021biile necesare, acestea ar trebui s\u0103 fie echitabile \u00een raport cu cele pe care le au beneficiarii protec\u021biei subsidiare.<\/span><\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\"><span class=\"Apple-style-span\">(30) \u00cen limitele derivate din obliga\u021biile interna\u021bionale, statele membre pot dispune ca acordarea de beneficii \u00een ceea ce prive\u0219te accesul la locurile de munc\u0103, la asisten\u021b\u0103 social\u0103, asisten\u021b\u0103 medical\u0103&nbsp;<\/span><span class=\"Apple-style-span\">&nbsp;<\/span><span class=\"Apple-style-span\">\u0219i la programe de integrare s\u0103 fie condi\u021bionat\u0103 de eliberarea prealabil\u0103 a unui permis de \u0219edere.<\/span><\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(31) Prezenta directiv\u0103 nu se aplic\u0103 facilit\u0103\u021bilor financiare acordare de statele membre \u00een scopul promov\u0103rii educa\u021biei \u0219i form\u0103rii profesionale.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(32) Ar trebui s\u0103 se \u021bin\u0103 seama de dificult\u0103\u021bile practice \u00eent\u00e2lnite de beneficiarii statutului de refugiat sau ai statutului conferit prin protec\u021bie subsidiar\u0103 \u00een ceea ce prive\u0219te recunoa\u0219terea diplomelor, certificatelor sau a altor titluri oficiale de calificare str\u0103ine.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(33) \u00cen scopul evit\u0103rii unei stari economico-sociale nesatisfacatoare, este oportun ca beneficiarilor statutului de refugiat sau celor ce beneficiaz\u0103 de protec\u021bie subsidiar\u0103 s\u0103 li se acorde f\u0103r\u0103 discriminare \u00een cadrul asisten\u021bei sociale, o protec\u021bie social\u0103 \u0219i mijloace de \u00eentre\u021binere adecvate.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(34) \u00cen ceea ce prive\u0219te asisten\u021ba social\u0103 \u0219i asisten\u021ba medical\u0103, modalita\u021bile \u0219i detaliile privind atribuirea presta\u021biilor de baz\u0103 ar trebui s\u0103 fie stabilite conform legisla\u021biei nationale. Posibilitatea de limitare a presta\u021biilor pentru beneficiarii protec\u021biei subsidiare la cele de baz\u0103 trebuie s\u0103 se \u00een\u021beleag\u0103 \u00een sensul c\u0103 acestea din urm\u0103 includ cel pu\u021bin un venit minim garantat, de asisten\u021b\u0103 \u00een caz de boal\u0103, de sarcin\u0103 si asisten\u021b\u0103 pentru cre\u0219terea copilului, \u00een m\u0103sura \u00een care statul membru \u00een cauz\u0103 acord\u0103 aceleasi tip de presta\u021bii propriilor cet\u0103\u021beni, \u00een conformitate cu legisla\u021bia intern\u0103.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\"><span class=\"Apple-style-span\">&nbsp;<\/span><span class=\"Apple-style-span\">(35) Beneficiarilor statutului de refugiat sau celor care beneficiaza de protectie subsidiara trebuie s\u0103 li se garanteze accesul la asistenta medicala atat in ceea ce priveste sanatatea fizica cat si sanatatea mentala.<\/span><\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(36) Punerea \u00een aplicare a prezentei directive ar trebui evaluat\u0103 cu regularitate, \u021bin\u00e2nd seama \u00een special de evolu\u021bia obliga\u021biilor interna\u021bionale ale statelor membre in materie de \u201enon-refoulment\u201d, de evolu\u021bia pie\u021belor for\u021bei de munc\u0103 \u00een statele membre, precum \u0219i de elaborarea unor principii fundamentale comune privind integrarea.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(37) \u021ain\u00e2nd seama de faptul de obiectivele prezentei directive, \u0219i anume elaborarea unor standarde minime cu privire la acordarea de c\u0103tre statele membre a protec\u021biei interna\u021bionale resortisan\u021bilor \u021b\u0103rilor ter\u021be \u0219i apatrizilor, precum \u0219i con\u021binutul protec\u021biei acordate nu pot fi \u00eendeplinite \u00een mod suficient de statele membre \u0219i, prin urmare pot, datorit\u0103 dimensiunilor \u0219i efectelor prezentei directive, s\u0103 fie mai bine \u00eendeplinite la nivel comunitar, Comunitatea poate interveni \u00een conformitate cu principiul subsidiarit\u0103\u021bii, consacrat la articolul 5 din tratat. \u00cen conformitate cu principiul propor\u021bionalit\u0103\u021bii enun\u021bat in cuprinsul aceluiasi articol, prezenta directiv\u0103 se limiteaz\u0103 la ceea ce este necesar \u00een scopul \u00eendeplinirii acestor obiective.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(38) \u00cen conformitate cu articolul 3 din protocolul privind pozi\u021bia Regatului Unit \u0219i a Irlandei anexat la Tratatul privind Uniunea European\u0103 \u0219i la Tratatul de instituire a Comunit\u0103\u021bii Europene, Regatul Unit, prin scrisoarea din 28 ianuarie 2002, \u0219i-a notificat dorin\u021ba de a participa la adoptarea \u0219i punerea \u00een aplicare a prezentei directive.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(39) \u00cen conformitate cu articolul 3 din protocolul men\u021bionat anterior, Irlanda, prin scrisoarea din 13 februarie 2002, \u0219i-a notificat dorin\u021ba de a participa la adoptarea \u0219i punerea \u00een aplicare a prezentei directive.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(40) \u00cen conformitate cu articolele 1 \u0219i 2 din protocolul privind pozi\u021bia Danemarcei anexat la Tratatul privind Uniunea European\u0103 \u0219i la Tratatul de instituire a Comunit\u0103\u021bii Europene, Danemarca nu particip\u0103 la adoptarea prezentei directive si in consecinta nu are nici o obliga\u021bie \u00een temeiul acesteia \u0219i nu face obiectul aplic\u0103rii sale,<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">ADOPT\u0102 PREZENTA DIRECTIV\u0102:<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">CAPITOLUL I<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Articolul 2<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Defini\u021bii<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">\u00cen sensul prezentei directive:<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(a) &#8220;protec\u021bie interna\u021bional\u0103&#8221; \u00eenseamn\u0103 statutul de refugiat \u0219i statutul conferit prin protec\u021bie subsidiar\u0103, definite la literele (d) \u0219i (f);<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(b) &#8220;Conven\u021bia de la Geneva&#8221; \u00eenseamn\u0103 Conven\u021bia privind statutul refugia\u021bilor semnat\u0103 la Geneva la 28 iulie 1951, modificat\u0103 de Protocolul de la New York din 31 ianuarie 1967;<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(c) &#8220;refugiat&#8221; \u00eenseamn\u0103 orice resortisant al unei \u021b\u0103ri ter\u021be care, ca urmare a unei temeri bine intemeiata de persecutie pe motive de rasa, religie, na\u021bionalitate, opinii politice sau apartenen\u021ba la un anumit grup social, se afl\u0103 \u00een afara \u021b\u0103rii al c\u0103rei cet\u0103\u021bean este \u0219i care nu poate sau, din cauza acestei temeri, nu dore\u0219te s\u0103 solicite protec\u021bia respectivei \u021b\u0103ri sau orice apatrid care, afl\u00e2ndu-se din motivele men\u021bionate anterior \u00een afara \u021b\u0103rii \u00een care avea re\u0219edin\u021ba in mod obi\u0219nuit, nu poate sau, din cauza acestei temeri, nu dore\u0219te s\u0103 se \u00eentoarc\u0103 \u00een respectiva \u021bar\u0103 \u0219i caruia nu i se aplica prevederile art.12;<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(d) &#8220;statut de refugiat&#8221; \u00eenseamn\u0103 recunoa\u0219terea, de c\u0103tre un stat membru, a calit\u0103\u021bii de refugiat a oric\u0103rui cetatean al unei \u021b\u0103ri ter\u021be sau a oric\u0103rui apatrid;<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(e) &#8220;persoan\u0103 care poate beneficia de protec\u021bie subsidiar\u0103&#8221; \u00eenseamn\u0103 orice cetatean al unei \u021b\u0103ri ter\u021be sau apatrid care nu poate fi considerat refugiat, dar \u00een privin\u021ba c\u0103ruia exist\u0103 motive serioase \u0219i \u00eentemeiate de a crede c\u0103, \u00een cazul \u00een care ar fi trimis \u00een \u021bara sa de origine sau, \u00een cazul unui apatrid, \u00een \u021bara \u00een care avea re\u0219edin\u021ba obi\u0219nuit\u0103, ar fi supus unui risc real de a suferi v\u0103t\u0103m\u0103rile grave definite la articolul 15 \u0219i c\u0103ruia nu i se aplic\u0103 prevederile art. 17 al. (1) \u0219i (2) \u0219i nu poate sau, ca urmare a acestui risc, nu dore\u0219te protec\u021bia respectivei \u021b\u0103ri;<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(f) &#8220;statut conferit prin protec\u021bie subsidiar\u0103&#8221; \u00eenseamn\u0103 recunoa\u0219terea, de c\u0103tre un stat membru, a unui cetatean al unei \u021b\u0103ri ter\u021be sau a unui apatrid drept persoan\u0103 care poate beneficia de protec\u021bie subsidiar\u0103;<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(g) &#8220;cerere de protec\u021bie interna\u021bional\u0103&#8221; \u00eenseamn\u0103 cererea de protec\u021bie prezentat\u0103 unui stat membru de c\u0103tre un cetatean al unei \u021b\u0103ri ter\u021be sau de c\u0103tre un apatrid, care poate fi \u00een\u021beleas\u0103 ca urm\u0103rind s\u0103 ob\u021bin\u0103 statutul de refugiat sau statutul conferit prin protec\u021bie subsidiar\u0103, care nu solicit\u0103 \u00een mod explicit un alt tip de protec\u021bie \u00een afara domeniului de aplicare a prezentei directive \u0219i care poate face obiectul unei cereri separate;<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(h) &#8220;membri de familie&#8221; \u00eenseamn\u0103 membri care apartin nucleului familial al celui care beneficiaza deja de statutul de refugiat sau al statutului conferit prin protectie subsidiara, familie deja constituita in tara de origine si care sunt prezenti in acelasi stat membru ca urmare a cererii de protec\u021bie interna\u021bional\u0103:<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&#8211; so\u021bul beneficiarului statutului de refugiat sau al statutului conferit prin protec\u021bie subsidiar\u0103 sau partenerul s\u0103u nec\u0103s\u0103torit cu care se afl\u0103 \u00eentr-o rela\u021bie stabil\u0103, \u00een cazul \u00een care legisla\u021bia sau practica \u00een vigoare \u00een statul membru \u00een cauz\u0103 trateaz\u0103 cuplurile nec\u0103s\u0103torite \u00een mod similar celor c\u0103s\u0103torite \u00een temeiul dreptului s\u0103u privind str\u0103inii;<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&#8211; copiii minori ai cuplului men\u021bionat la prima liniu\u021b\u0103 sau ai beneficiarului statutului de refugiat sau al statutului conferit prin protec\u021bie subsidiar\u0103, cu condi\u021bia s\u0103 nu fie c\u0103s\u0103tori\u021bi \u0219i s\u0103 fie \u00een \u00eentre\u021binerea sa, f\u0103r\u0103 a se \u021bine seama de faptul c\u0103 sunt legitimi, n\u0103scu\u021bi \u00een afara c\u0103s\u0103toriei sau adopta\u021bi \u00een conformitate cu prevederile legisla\u021biei interne;<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(i) &#8220;minor ne\u00eenso\u021bit&#8221; este un cetatean al unei \u021b\u0103ri ter\u021be sau apatrizii sub optsprezece ani, care intr\u0103 pe teritoriul statelor membre f\u0103r\u0103 a fi \u00eenso\u021bi\u021bi de o persoan\u0103 adult\u0103 care s\u0103 fie responsabil\u0103 pentru el prin lege sau cutum\u0103 \u0219i at\u00e2ta timp c\u00e2t nu sunt efectiv lua\u021bi \u00een \u00eengrijire de o astfel de persoan\u0103; aceast\u0103 expresie desemneaz\u0103, de asemenea, minorii care sunt l\u0103sa\u021bi ne\u00eenso\u021bi\u021bi dup\u0103 intrarea pe teritoriul statelor membre;<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\"><span class=\"Apple-style-span\">(j) &#8220;permis de \u0219edere&#8221; \u00eenseamn\u0103 orice permis sau autoriza\u021bie eliberat\u0103 de autorit\u0103\u021bile unui stat membru sub forma prev\u0103zut\u0103 de legisla\u021bia intern\u0103, care permite unui cetatean&nbsp;<\/span><span class=\"Apple-style-span\">&nbsp;<\/span><span class=\"Apple-style-span\">al unei \u021b\u0103ri ter\u021be sau unui apatrid s\u0103 aib\u0103 re\u0219edin\u021ba pe teritoriul respectivului stat membru;<\/span><\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(k) &#8220;\u021bar\u0103 de origine&#8221; este tara sau tarile c\u0103rui cet\u0103\u021bean este solicitantul sau, \u00een cazul \u00een care este apatrid, \u021bara \u00een care avea re\u0219edin\u021ba in mod obi\u0219nuit.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Articolul 3<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Dispozitii mai favorabile<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Statele membre pot adopta sau men\u021bine dispozitii mai favorabile pentru a determina care sunt persoanele care \u00eendeplinesc condi\u021biile de acordare a statutului de refugiat sau care sunt persoanele eligibile pentru protec\u021bie subsidiar\u0103, precum \u0219i pentru a stabili con\u021binutul protec\u021biei interna\u021bionale, \u00een m\u0103sura \u00een care respectivele standarde sunt compatibile cu prezenta directiv\u0103.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">CAPITOLUL II<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">EVALUAREA CERERILOR DE PROTEC\u021aIE INTERNA\u021aIONAL\u0102<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Articolul 4<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Evaluarea faptelor \u0219i circumstan\u021belor<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(1) Statele membre pot considera c\u0103 este obliga\u021bia solicitantului s\u0103 prezinte, de \u00eendat\u0103 ce este posibil, toate elementele necesare \u00een sprijinul cererii sale de protec\u021bie interna\u021bional\u0103. Statele membre au obliga\u021bia de a evalua, \u00een cooperare cu solicitantul, elementele relevante ale cererii.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(2) Elementele men\u021bionate la alineatul (1) \u00eenseamn\u0103 informa\u021biile furnizate de solicitant \u0219i toate documentele de care acesta dispune privind v\u00e2rsta sa, trecutul s\u0103u, inclusiv cel al rudelor relevante, identitatea, cet\u0103\u021benia sau cet\u0103\u021beniile, \u021bara sau \u021b\u0103rile, precum \u0219i localitatea sau localit\u0103\u021bile \u00een care a avut re\u0219edin\u021ba anterioar\u0103, cererile anterioare de azil, itinerarul, documentele de identitate \u0219i de c\u0103l\u0103torie, precum \u0219i motivele care justific\u0103 cererea de protec\u021bie interna\u021bional\u0103.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(3) Evaluarea unei cereri de protec\u021bie interna\u021bional\u0103 trebuie efectuat\u0103 individual, \u021bin\u00e2nd seama de urm\u0103toarele elemente:<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(a) toate faptele relevante privind \u021bara de origine \u00een momentul lu\u0103rii unei decizii privind cererea, inclusiv de actele cu putere de lege \u0219i actele administrative ale \u021b\u0103rii de origine \u0219i de modul lor de aplicare;<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(c) situatia individuala \u0219i circumstantele personale a solicitantului, inclusiv factori precum trecutul, sexul \u0219i v\u00e2rsta acestuia, pentru a se stabili dac\u0103, \u021bin\u00e2nd seama de situa\u021bia personal\u0103 a solicitantului, actele la care solicitantul a fost sau risc\u0103 s\u0103 fie expus ar putea fi considerate o persecu\u021bie sau o v\u0103t\u0103mare grav\u0103;<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(d) faptul c\u0103, de c\u00e2nd a p\u0103r\u0103sit \u021bara de origine, solicitantul a \u00eentreprins sau nu demersuri av\u00e2nd ca scop unic sau scop principal crearea unor condi\u021bii necesare pentru a depune o cerere de protec\u021bie interna\u021bional\u0103, pentru a se stabili dac\u0103 respectivele activit\u0103\u021bi ar expune solicitantul la o persecu\u021bie sau o v\u0103t\u0103mare grav\u0103 \u00een cazul \u00een care s-ar \u00eentoarce \u00een \u021bara de origine;<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 0px; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(e) faptul c\u0103 se poate considera c\u0103 solicitantul ar putea beneficia de protec\u021bia unei alte \u021b\u0103ri al carei cetatean s-ar putea declara.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 0px; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(4) Faptul c\u0103 solicitantul a fost deja persecutat, a suferit deja v\u0103t\u0103m\u0103ri grave sau a f\u0103cut deja obiectul amenin\u021b\u0103rii directe a unei astfel de persecu\u021bii sau a unor astfel de v\u0103t\u0103m\u0103ri reprezint\u0103 un indiciu serios al temerilor fondate ale solicitantului de a fi persecutat sau al riscului real de a suferi v\u0103t\u0103m\u0103ri grave, cu excep\u021bia cazului \u00een care exist\u0103 motive \u00eentemeiate de a crede c\u0103 respectiva persecu\u021bie sau respectivele v\u0103t\u0103m\u0103ri grave nu se vor mai repeta.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 0px; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(5) Atunci c\u00e2nd statele membre aplic\u0103 principiul conform c\u0103ruia este obliga\u021bia solicitantului s\u0103 \u00ee\u0219i motiveze cererea \u0219i c\u00e2nd anumite aspecte din declara\u021biile solicitantului nu sunt sus\u021binute de dovezi documentare sau de alt\u0103 natur\u0103, aceste aspecte nu necesit\u0103 o confirmare \u00een cazul \u00een care sunt \u00eendeplinite urm\u0103toarele condi\u021bii:<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 0px; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(1) O temere intemeiata de persecutie sau un risc real de a fi supus unor v\u0103t\u0103m\u0103ri grave se poate baza pe apari\u021bia unor evenimente care au avut loc dup\u0103 plecarea solicitantului din \u021bara de origine.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 0px; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(2) O temere intemeiata de a fi persecutat sau un risc real de a fi supus unor v\u0103t\u0103m\u0103ri grave se poate baza pe activit\u0103\u021bi exercitate de solicitant dup\u0103 plecarea sa din \u021bara de origine, \u00een special \u00een cazul \u00een care este stabilit c\u0103 activit\u0103\u021bile pe care se bazeaz\u0103 respectiva cerere constituie expresia \u0219i continuarea convingerilor sau orient\u0103rilor avute \u00een \u021bara de origine.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 0px; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(a) statul;<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 0px; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(b) partidele sau organiza\u021biile care controleaz\u0103 statul sau o parte important\u0103 din teritoriul acestuia;<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 0px; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(c) agen\u021bi neguvernamentali, \u00een cazul \u00een care se poate demonstra c\u0103 agen\u021bii men\u021biona\u021bi la literele (a) \u0219i (b), inclusiv organiza\u021biile interna\u021bionale, nu pot sau nu doresc s\u0103 acorde o protec\u021bie \u00eempotriva persecu\u021biilor sau a v\u0103t\u0103m\u0103rilor grave \u00een sensul articolului 7.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 0px; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Agen\u021bii de protec\u021bie<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 0px; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(1) Protec\u021bia poate fi acordat\u0103 de:<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 0px; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(a) stat sau<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 0px; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(b) partide sau organiza\u021bii, inclusiv organiza\u021bii interna\u021bionale, care controleaz\u0103 statul sau o parte important\u0103 din teritoriul acestuia.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 0px; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(2) Protec\u021bia se acord\u0103, \u00een general, atunci c\u00e2nd agen\u021bii men\u021biona\u021bi la alineatul (1) iau m\u0103suri pentru a \u00eempiedica persecu\u021bia sau v\u0103t\u0103m\u0103rile grave, \u00eentre altele, atunci c\u00e2nd dispun de un sistem juridic eficient care s\u0103 permit\u0103 descoperirea, urm\u0103rirea penal\u0103 \u0219i sanc\u021bionarea ac\u021biunilor ce constituie o persecu\u021bie sau o v\u0103t\u0103mare grav\u0103 \u0219i atunci c\u00e2nd solicitantul are acces la o astfel de protec\u021bie.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 0px; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(3) Atunci c\u00e2nd determin\u0103 dac\u0103 o organiza\u021bie interna\u021bional\u0103 controleaz\u0103 un stat sau o parte important\u0103 din teritoriul acestuia \u0219i ofer\u0103 protec\u021bie \u00een sensul alineatului (2), statele membre \u021bin seama de orient\u0103rile eventual furnizate de actele Consiliului \u00een domeniu.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; margin-left: 0px; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Articolul 8<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Protec\u021bia \u00een interiorul \u021b\u0103rii de origine<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(1) \u00cen cadrul evalu\u0103rii cererii de protec\u021bie interna\u021bional\u0103, statele membre pot stabili c\u0103 un solicitant nu are nevoie de protec\u021bie interna\u021bional\u0103 atunci c\u00e2nd, \u00eentr-o parte din \u021bara de origine, nu exist\u0103 nici un motiv pentru a se teme c\u0103 va fi persecutat \u0219i nici un risc real de a fi supus unor v\u0103t\u0103m\u0103ri grave \u0219i c\u0103 se poate estima \u00een mod rezonabil c\u0103 solicitantul poate r\u0103m\u00e2ne \u00een respectiva parte din \u021bara de origine.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(2) Atunci c\u00e2nd examineaz\u0103 dac\u0103 o parte a unei \u021b\u0103ri de origine este conform\u0103 alineatului (1), statele membre \u021bin seama, \u00een momentul \u00een care adopt\u0103 o decizie cu privire la cerere, de condi\u021biile generale existente \u00een respectiva parte a \u021b\u0103rii \u0219i de situa\u021bia personal\u0103 a solicitantului.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(3) Alineatul (1) se poate aplica chiar dac\u0103 exist\u0103 obstacole tehnice la \u00eentoarcerea spre \u021bara de origine.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">CONDI\u021aII PENTRU A FI CONSIDERAT REFUGIAT<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\"><span class=\"Apple-style-span\">Articolul 9<\/span><span class=\"Apple-style-span\">&nbsp;&nbsp;&nbsp;<\/span><\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Acte de persecu\u021bie<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(1) Actele de persecu\u021bie \u00een sensul articolului 1A din Conven\u021bia de la Geneva trebuie:<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(a) s\u0103 fie suficient de grave prin natura sau prin caracterul lor repetat pentru a constitui o \u00eenc\u0103lcare grav\u0103 a drepturilor fundamentale ale omului, \u00een special a drepturilor de la care nu este posibil\u0103 nici o derogare \u00een temeiul articolului 15 alineatul (2) din Conven\u021bia european\u0103 pentru ap\u0103rarea drepturilor omului \u0219i a libert\u0103\u021bilor fundamentale sau<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(b) s\u0103 fie o acumulare de diverse m\u0103suri, inclusiv de \u00eenc\u0103lc\u0103ri ale drepturilor omului, care s\u0103 fie suficient de grav\u0103 pentru a afecta un individ \u00een mod comparabil cu cele men\u021bionate la litera (a).<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(2) Actele de persecu\u021bie, \u00een sensul alineatului (1), pot lua \u00een special urm\u0103toarele forme:<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(a) acte de violen\u021ba fizica sau psihica, inclusiv violen\u021ba sexuala;<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(b) m\u0103surile legale, administrative, poli\u021biene\u0219ti \u0219i\/sau judiciare care sunt discriminatorii \u00een sine sau sunt puse \u00een aplicare \u00een mod discriminatoriu;<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(c) actiuni judiciare sau sanc\u021biuni penale dispropor\u021bionate sau discriminatorii;<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(d) refuzul accesului la c\u0103i de atac judiciare care conduce la o sanc\u021biune dispropor\u021bionat\u0103 sau discriminatorie;<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(e) actiuni judiciare sau sanc\u021biuni penale \u00een urma refuzului de a efectua serviciul militar \u00een situa\u021bii de conflict, atunci c\u00e2nd serviciul militar ar presupune comiterea unor infrac\u021biuni sau \u00eendeplinirea unor acte care intr\u0103 sub inciden\u021ba clauzelor de excludere prev\u0103zute la articolul 12 alineatul (2);<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(f) actele exercitate in mod expres \u00eempotriva persoanelor din motive de sex sau actele \u00eempotriva copiilor.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(3) \u00cen conformitate cu articolul 2 litera (c), trebuie s\u0103 existe o leg\u0103tur\u0103 \u00eentre motivele men\u021bionate la articolul 10 \u0219i actele de persecu\u021bie \u00een sensul alineatului (1).<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Motivele persecu\u021biei<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(1) Atunci c\u00e2nd evalueaz\u0103 motivele persecu\u021biei, statele membre \u021bin seama de urm\u0103toarele elemente:<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(a) no\u021biunea de \u201eras\u0103\u201d include \u00een special considerente de culoare a pielii, descenden\u021b\u0103 sau apartenen\u021b\u0103 la un anumit grup etnic;<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(b) no\u021biunea de \u201ereligie\u201d include, \u00een special, faptul de a avea convingeri teiste, nonteiste sau ateiste, participarea la ceremonii de cult private sau publice, singur sau \u00een comunitate, sau neparticiparea la acestea, alte acte religioase sau exprim\u0103ri de opinii religioase \u0219i forme de comportament personal sau social fondate pe credin\u021be religioase sau impuse de astfel de credin\u021be;<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(c) no\u021biunea de \u201ena\u021bionalitate\u201d nu se limiteaz\u0103 la cet\u0103\u021benie sau la inexisten\u021ba acesteia, ci include, \u00een special, apartenen\u021ba la un grup determinat prin identitatea sa cultural\u0103, etnic\u0103 sau lingvistic\u0103, prin originile sale geografice sau politice comune sau prin rela\u021bia cu popula\u021bia unui alt stat;<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(d) un grup este considerat un anumit grup social \u00een special atunci c\u00e2nd:<\/span><\/div>\n<div style=\"background-attachment: initial; Interpretarea expresiei \u201eorientarea sexual\u0103\u201d nu poate sa includa acte considerate delicte \u00een conformitate cu legisla\u021bia intern\u0103 a statelor membre. background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(f) fiind o persoan\u0103 f\u0103r\u0103 cet\u0103\u021benie, datorit\u0103 faptului c\u0103 circumstan\u021bele \u00een urma c\u0103rora a fost recunoscut ca refugiat au \u00eencetat s\u0103 mai existe, se poate \u00eentoarce \u00een \u021bara \u00een care avea re\u0219edin\u021ba obi\u0219nuit\u0103.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(2) \u00cen scopul punerii \u00een aplicare a alineatului (1) literele (e) \u0219i (f), statele membre examineaz\u0103 dac\u0103 schimbarea circumstan\u021belor este semnificativ\u0103 \u00een mod suficient \u0219i nu este provizorie pentru ca temerea refugiatului de a fi persecutat s\u0103 nu mai poat\u0103 fi considerat\u0103 fondat\u0103.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Excluderea<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(1) Un cetatean al unei \u021b\u0103ri ter\u021be sau apatrid este exclus de la recunoa\u0219terea statutului de refugiat \u00een cazul \u00een care:<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(a) intr\u0103 \u00een domeniul de aplicare a articolului 1 sec\u021biunea D din Conven\u021bia de la Geneva, privind protec\u021bia sau asisten\u021ba acordat\u0103 de un organism sau de o agentie a Organiza\u021biei Na\u021biunilor Unite, alta dec\u00e2t \u00cenaltul Comisariat al Organiza\u021biei Na\u021biunilor Unite pentru Refugia\u021bi. \u00cen cazul \u00een care aceast\u0103 protec\u021bie sau asisten\u021b\u0103 \u00eenceteaz\u0103 din orice motive, f\u0103r\u0103 ca situa\u021bia acestor persoane s\u0103 fi fost definitiv solu\u021bionat\u0103 \u00een conformitate cu rezolu\u021biile relevante ale Adun\u0103rii Generale a Organiza\u021biei Na\u021biunilor Unite, persoanele \u00een cauz\u0103 pot beneficia ipso facto de dispozi\u021biile prezentei directive;<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(b) autorit\u0103\u021bile competente ale \u021b\u0103rii \u00een care \u0219i-a stabilit re\u0219edin\u021ba consider\u0103 c\u0103 are drepturile \u0219i obliga\u021biile aferente de\u021binerii cet\u0103\u021beniei respectivei \u021b\u0103ri sau drepturi \u0219i obliga\u021bii echivalente.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(2) Orice cetatean al unei \u021b\u0103ri ter\u021be sau orice apatrid este exclus de la recunoa\u0219terea statutului de refugiat atunci c\u00e2nd exist\u0103 motive \u00eentemeiate pentru a crede c\u0103:<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(a) a comis o infrac\u021biune \u00eempotriva p\u0103cii, o crim\u0103 de r\u0103zboi sau o crim\u0103 \u00eempotriva umanit\u0103\u021bii \u00een sensul instrumentelor interna\u021bionale care prevad astfel de infrac\u021biuni;<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(b) a comis o infrac\u021biune grav\u0103 de drept comun \u00een afara \u021b\u0103rii in care a cerut protectie \u00eenainte de a fi admis ca refugiat, \u0219i anume \u00eenainte de data ob\u021binerii permisului de \u0219edere eliberat pe baza statutului de refugiat; ac\u021biunile deosebit de crude, chiar dac\u0103 sunt comise \u00eentr-un scop declarat politic, pot primi calificativul de infrac\u021biuni grave de drept comun;<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(c) s-a f\u0103cut vinovat de acte contrare scopurilor \u0219i principiilor Organiza\u021biei Na\u021biunilor Unite prev\u0103zute de preambul \u0219i la articolele 1 \u0219i 2 din Carta Organiza\u021biei Na\u021biunilor Unite.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(3) Alineatul (2) se aplic\u0103 persoanelor care instig\u0103 sau particip\u0103 \u00een orice fel la infrac\u021biunile sau actele prev\u0103zute de respectivul alineat.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">CAPITOLUL IV<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Recunoasterea statutului de refugiat<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Revocarea, \u00eencetarea sau refuzul de re\u00eennoire a statutului de refugiat<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(1) \u00cen ceea ce prive\u0219te cererile de protec\u021bie interna\u021bional\u0103 depuse dup\u0103 intrarea \u00een vigoare a prezentei directive, statele membre revoc\u0103 statutul de refugiat acordat de o autoritate guvernamental\u0103, administrativ\u0103, judiciar\u0103 sau cvasi-judiciar\u0103 unui resortisant al unei \u021b\u0103ri ter\u021be sau unui apatrid, dispun \u00eencetarea sau refuz\u0103 re\u00eennoirea acestuia atunci c\u00e2nd refugiatul a \u00eencetat s\u0103 mai beneficieze de acest statut \u00een temeiul articolului 11.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(2) F\u0103r\u0103 s\u0103 aduc\u0103 atingere obliga\u021biei refugiatului, \u00een temeiul articolului 4 alineatul (1), de a declara toate faptele relevante \u0219i de a furniza toate documentele justificative relevante de care dispune, statul membru care a acordat statutul de refugiat demonstreaz\u0103, de la caz la caz, c\u0103 respectiva persoan\u0103 a \u00eencetat s\u0103 mai fie sau nu a fost niciodat\u0103 un refugiat \u00een sensul alineatului 1 din prezentul articol.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(3) Statele membre revoc\u0103 statutul de refugiat al oric\u0103rui resortisant al unei \u021b\u0103ri ter\u021be sau al oric\u0103rui apatrid, dispun \u00eencetarea sau refuz\u0103 re\u00eennoirea acestuia, \u00een cazul \u00een care, dup\u0103 ce i-au acordat statutul de refugiat, statul interesat stabileste c\u0103:<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(a) persoana in cauza este sau ar fi trebuit s\u0103 fie exclusa de la recunoa\u0219terea statutului de refugiat \u00een temeiul articolului 12;<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(b) alterarea sau omiterea anumitor fapte, inclusiv utilizarea unor documente false, au jucat un rol hot\u0103r\u00e2tor \u00een luarea deciziei de acordare a statutului de refugiat.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(4) Statele membre pot revoca statutul acordat unui refugiat de c\u0103tre o autoritate guvernamental\u0103, administrativ\u0103, judiciar\u0103 sau cvasi-judiciar\u0103, pot dispune \u00eencetarea sau pot refuza re\u00eennoirea acestuia \u00een cazul \u00een care:<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(a) exist\u0103 motive rezonabile pentru a-l considera un pericol pentru siguran\u021ba statului membru \u00een care se afl\u0103;<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(b) ca urmare a faptului c\u0103 a fost condamnat printr-o hot\u0103r\u00e2re judec\u0103toreasc\u0103 definitiv\u0103 pentru o infrac\u021biune deosebit de grav\u0103, constituie un pericol pentru societatea respectivului stat membru.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(5) \u00cen situa\u021biile descrise la alineatul (4), statele membre pot decide s\u0103 nu acorde statutul de refugiat atunci c\u00e2nd nu a fost \u00eenc\u0103 luat\u0103 o decizie.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(6) Persoanele c\u0103rora li se aplic\u0103 alineatele (4) \u0219i (5) beneficiaza de drepturile prev\u0103zute la articolele 3, 4, 16, 22, 31, 32 \u0219i 33 din Conven\u021bia de la Geneva sau drepturi similare, at\u00e2ta timp c\u00e2t se afl\u0103 \u00een statele membre.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(2) \u00cen sensul punerii \u00een aplicare a alineatului (1), statele membre \u021bin seama de schimbarea circumstan\u021belor, stabilind dac\u0103 aceasta este suficient de semnificativ\u0103 \u0219i nu este provizorie pentru ca persoana eligibil\u0103 pentru protec\u021bie subsidiar\u0103 s\u0103 nu mai fie supus\u0103 unui risc real de a suferi v\u0103t\u0103m\u0103ri grave.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(c) s-a f\u0103cut vinovat de acte contrare scopurilor \u0219i principiilor Organiza\u021biei Na\u021biunilor Unite prev\u0103zute in preambul \u0219i in articolele 1 \u0219i 2 din Carta Organiza\u021biei Na\u021biunilor Unite;<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(d) reprezint\u0103 un pericol pentru comunitate sau pentru siguran\u021ba statului membru \u00een care se afl\u0103.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(1) \u00cen ceea ce prive\u0219te cererile de protec\u021bie interna\u021bional\u0103 depuse dup\u0103 intrarea \u00een vigoare a prezentei directive, statele membre revoc\u0103 statutul conferit prin protec\u021bie subsidiar\u0103 acordat de o autoritate guvernamental\u0103, administrativ\u0103, judiciar\u0103 sau cvasi-judiciar\u0103 unui resortisant al unei \u021b\u0103ri ter\u021be sau unui apatrid, dispun \u00eencetarea sau refuz\u0103 re\u00eennoirea acestuia, atunci c\u00e2nd persoana \u00een cauz\u0103 a \u00eencetat s\u0103 mai fie eligibil\u0103 pentru acordarea protec\u021biei subsidiare \u00een temeiul articolului 16.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(2) Statele membre pot revoca statutul de refugiat acordat de o autoritate guvernamental\u0103, administrativ\u0103, judiciar\u0103 sau cvasi-judiciar\u0103 unui resortisant al unei \u021b\u0103ri ter\u021be sau unui apatrid, dispun \u00eencetarea sau refuz\u0103 re\u00eennoirea acestuia, atunci c\u00e2nd se dovede\u0219te, dup\u0103 acordarea statutului conferit prin protec\u021bie subsidiar\u0103, c\u0103 persoana \u00een cauz\u0103 ar fi trebuit s\u0103 fie exclus\u0103 din categoria persoanelor eligibile pentru protec\u021bia subsidiar\u0103 \u00een temeiul articolului 17 alineatul (3).<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(3) Statele membre revoc\u0103 statutul conferit prin protec\u021bie subsidiar\u0103 oric\u0103rui resortisant al unei \u021b\u0103ri ter\u021be sau oric\u0103rui apatrid, dispun \u00eencetarea sau refuz\u0103 re\u00eennoirea acestuia \u00een cazul \u00een care:<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(a) dup\u0103 acordare acestui statut, se dovede\u0219te c\u0103 persoana \u00een cauz\u0103 este sau ar fi trebuit s\u0103 fie exclus\u0103 din categoria persoanelor eligibile pentru protec\u021bie subsidiar\u0103 \u00een temeiul articolului 17 alineatele (1) \u0219i (2);<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(b) alterarea sau omiterea anumitor fapte, inclusiv utilizarea unor documente false, au jucat un rol hot\u0103r\u00e2tor \u00een luarea deciziei de acordare a statutului conferit prin protec\u021bie subsidiar\u0103.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(4) F\u0103r\u0103 s\u0103 aduc\u0103 atingere obliga\u021biei oric\u0103rui resortisant al unei \u021b\u0103ri ter\u021be sau a unui apatrid, \u00een temeiul articolului 4 alineatul (1), de a declara toate faptele relevante \u0219i de a furniza toate documentele justificative de care dispune, statul membru care a acordat statutul conferit prin protec\u021bie subsidiar\u0103 demonstreaz\u0103, de la caz la caz, c\u0103 respectiva persoan\u0103 a \u00eencetat s\u0103 mai fac\u0103 parte sau nu face parte din categoria persoanelor eligibile pentru protec\u021bie subsidiar\u0103 \u00een temeiul alineatelor (1), (2) \u0219i (3) din prezentul articol.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">CAPITOLUL VII<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Dispozitii generale<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(1) Prezentul capitol nu aduce atingere drepturilor prev\u0103zute de Conven\u021bia de la Geneva.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(2) Prezentul capitol se aplic\u0103 at\u00e2t refugia\u021bilor, c\u00e2t \u0219i persoanelor care pot beneficia de protec\u021bie subsidiar\u0103, cu excep\u021bia cazului \u00een care se prevede altfel.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(3) Atunci c\u00e2nd aplic\u0103 prezentul capitol, statele membre \u021bin seama de situa\u021bia specific\u0103 persoanelor vulnerabile precum minorii, minorii ne\u00eenso\u021bi\u021bi, persoanele cu handicap, v\u00e2rstnicii, femeile \u00eens\u0103rcinate, p\u0103rin\u021bii singuri \u00eenso\u021bi\u021bi de copii minori \u0219i persoanele care au fost supuse torturii, violului sau altor forme grave de violen\u021b\u0103 psihologic\u0103, psihic\u0103 sau sexual\u0103.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(4) Alineatul (3) se aplic\u0103 numai persoanelor ale c\u0103ror nevoi speciale au fost constatate \u00een urma unei evalu\u0103ri individuale a situa\u021biei lor.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(5) Interesul superior al copilului reprezint\u0103 un considerent primordial pentru statele membre \u00een transpunerea dispozi\u021biilor prezentului capitol \u00een ceea ce prive\u0219te minorii.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(6) \u00cen limitele stabilite prin Conven\u021bia de la Geneva, statele membre pot reduce beneficiile acordate unui refugiat \u00een temeiul prezentului capitol atunci c\u00e2nd acesta a ob\u021binut statutul de refugiat pe baza activit\u0103\u021bilor \u00eentreprinse cu scopul unic sau cu scopul principal de a crea condi\u021biile necesare recunoa\u0219terii sale ca refugiat.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(7) \u00cen limitele stabilite prin obliga\u021biile interna\u021bionale ale statelor membre, acestea pot reduce beneficiile acordate \u00een temeiul prezentului capitol unei persoane care poate beneficia de protec\u021bie subsidiar\u0103, atunci c\u00e2nd aceasta a ob\u021binut protec\u021bia pe baza activit\u0103\u021bilor \u00eentreprinse cu scopul exclusiv sau cu scopul principal de a crea condi\u021biile necesare recunoa\u0219terii sale ca persoan\u0103 care poate beneficia de protec\u021bie subsidiar\u0103.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Articolul 21<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Protec\u021bia \u00eempotriva return\u0103rii<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(1) Statele membre respect\u0103 principiul nonrefoulment \u00een temeiul obliga\u021biilor interna\u021bionale.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(2) Atunci c\u00e2nd aceasta nu le este interzis \u00een temeiul obliga\u021biilor interna\u021bionale men\u021bionate la alineatul (1), statele membre pot returna un refugiat, indiferent dac\u0103 acesta este recunoscut oficial sau nu, \u00een cazul \u00een care:<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(a) exist\u0103 motive serioase pentru a considera c\u0103 acesta reprezint\u0103 o amenin\u021bare pentru siguran\u021ba statului membru pe teritoriul caruia care se afl\u0103;<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(b) ca urmare a faptului c\u0103 a fost condamnat printr-o hot\u0103r\u00e2re judec\u0103toreasc\u0103 definitiv\u0103 pentru o infrac\u021biune deosebit de grav\u0103, reprezint\u0103 o amenin\u021bare pentru comunitatea respectivului stat membru.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(3) Statele membre pot revoca, \u00eenceta sau refuza s\u0103 \u00eenoiasc\u0103 sau s\u0103 acorde un permis de \u0219edere unui refugiat care intr\u0103 \u00een domeniul de aplicare a alineatului (2).<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Articolul 22<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Informare<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">De \u00eendat\u0103 ce este posibil dup\u0103 acordarea statutului de protec\u021bie, statele membre furnizeaz\u0103 persoanelor c\u0103rora li s-a recunoscut nevoia unei protec\u021bii interna\u021bionale, accesul la informa\u021bii privind drepturile \u0219i obliga\u021biile aferente statutelor de protec\u021bie respective, \u00eentr-o limb\u0103 pe care respectivele persoane o pot \u00een\u021belege,<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\"><span class=\"Apple-style-span\">&nbsp;<\/span><span class=\"Apple-style-span\">Articolul 23<\/span><\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Men\u021binerea unit\u0103\u021bii familiei<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(1) Statele membre se asigur\u0103 c\u0103 unitatea familiei poate fi men\u021binut\u0103.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(2) Statele membre se asigur\u0103 c\u0103 membrii familiei beneficiarului statutului de refugiat sau al statutului conferit prin protec\u021bie subsidiar\u0103 care, \u00een mod individual, nu \u00eendeplinesc condi\u021biile necesare pentru a ob\u021bine un astfel de statut, au acces la beneficiile prev\u0103zute la articolele 24-34, \u00een conformitate cu procedurile de drept intern \u0219i \u00een m\u0103sura \u00een care aceasta este compatibil\u0103 cu statutul juridic personal al membrului familiei.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">\u00cen ceea ce prive\u0219te membrii familiei celor care beneficiaz\u0103 de statutul conferit prin protec\u021bie subsidiar\u0103, statele membre pot stabili condi\u021biile aplicabile acestora.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">\u00cen acest caz, statele membre se asigur\u0103 c\u0103 beneficiile acordate garanteaz\u0103 un nivel de trai adecvat.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(3) Alineatele (1) \u0219i (2) nu sunt aplicabile atunci c\u00e2nd membrul familiei este sau urmeaz\u0103 s\u0103 fie exclus de la recunoa\u0219terea statutului de refugiat sau a statutului conferit prin protec\u021bie subsidiar\u0103 \u00een temeiul capitolelor III \u0219i V.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(4) F\u0103r\u0103 a aduce atingere alineatelor (1) \u0219i (2), statele membre pot refuza, limita sau retrage beneficiile prev\u0103zute de respectivele alineate din motive de siguran\u021b\u0103 na\u021bional\u0103 sau de ordine public\u0103.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(5) Statele membre pot decide c\u0103 prezentul articol se aplic\u0103 \u0219i altor rude apropiate care faceau parte din familie la data plec\u0103rii din \u021bara de origine \u0219i care se aflau, integral sau par\u021bial, \u00een \u00eentre\u021binerea beneficiarului statutului de refugiat sau al protec\u021biei subsidiare.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Articolul 24<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Permisul de \u0219edere<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(1) De \u00eendat\u0103 ce este posibil dup\u0103 acordarea statutului, statele membre elibereaz\u0103 beneficiarilor statutului de refugiat un permis de \u0219edere care este valabil pentru o perioad\u0103 de cel pu\u021bin trei ani \u0219i care poate fi re\u00eennoit, cu excep\u021bia cazului \u00een care exist\u0103 motive imperioase de siguran\u021b\u0103 na\u021bional\u0103 sau de ordine public\u0103 ce impun altfel, \u0219i f\u0103r\u0103 s\u0103 aduc\u0103 atingere articolului 21 alineatul (3).<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">F\u0103r\u0103 a se aduce atingere articolului 23 alineatul (1), membrilor familiei beneficiarilor statutului de refugiat li se poate elibera un permis de \u0219edere care este valabil pentru o perioad\u0103 de mai pu\u021bin de trei ani \u0219i care poate fi re\u00eennoit.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(2) De \u00eendat\u0103 ce este posibil dup\u0103 acordarea statutului, statele membre elibereaz\u0103 beneficiarilor statutului conferit prin protec\u021bie subsidiar\u0103 un permis de \u0219edere care este valabil pentru o perioad\u0103 de cel pu\u021bin un an \u0219i care poate fi re\u00eennoit, cu excep\u021bia cazului \u00een care exist\u0103 motive imperioase de siguran\u021b\u0103 na\u021bional\u0103 sau de ordine public\u0103 ce impun altfel.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(1) Statele membre autorizeaz\u0103 beneficiarii statutului de refugiat s\u0103 exercite o activitate salariat\u0103 sau independent\u0103, sub rezerva normelor general aplicabile \u00een sectorul de activitate \u00een cauz\u0103 \u0219i \u00een serviciile publice, imediat dup\u0103 acordarea statutului de refugiat.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(2) Statele membre se asigur\u0103 c\u0103 beneficiarilor statutului de refugiat li se ofer\u0103 activit\u0103\u021bi precum posibilit\u0103\u021bi de formare ocupa\u021bional\u0103 pentru adul\u021bi, ac\u021biuni de formare profesional\u0103 \u0219i experien\u021b\u0103 practic\u0103 la locul de munc\u0103 \u00een condi\u021bii echivalente celor aplicabile propriilor resortisan\u021bi.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(3) Statele membre autorizeaz\u0103 beneficiarii protec\u021biei subsidiare s\u0103 exercite o activitate salariat\u0103 sau independent\u0103, sub rezerva normelor general aplicabile \u00een sectorul activit\u0103\u021bii \u00een cauz\u0103 \u0219i al serviciilor publice, imediat dup\u0103 acordarea statutului conferit prin protec\u021bie subsidiar\u0103. Se poate \u021bine seama de situa\u021bia pie\u021bei for\u021bei de munc\u0103 din statele membre, inclusiv \u00een vederea unei eventuale stabiliri a priorit\u0103\u021bilor de acces la locurile de munc\u0103 pentru o perioad\u0103 de timp limitat\u0103, care urmeaz\u0103 s\u0103 fie stabilit\u0103 \u00een conformitate cu legisla\u021bia intern\u0103. Statele membre se asigur\u0103 c\u0103 beneficiarul statutului conferit prin protec\u021bie subsidiar\u0103 are acces la un loc de munc\u0103 ce i-a fost oferit \u00een conformitate cu normele de drept intern privind stabilirea priorit\u0103\u021bilor pe pia\u021ba for\u021bei de munc\u0103.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(4) Statele membre se asigur\u0103 c\u0103 beneficiarii statutului conferit prin protec\u021bie subsidiar\u0103 au acces la activit\u0103\u021bi precum posibilit\u0103\u021bi de formare ocupa\u021bional\u0103 pentru adul\u021bi, activitati de formare profesional\u0103 \u0219i experien\u021b\u0103 practic\u0103 la locul de munc\u0103 \u00een condi\u021bii care urmeaz\u0103 s\u0103 fie stabilite de statele membre.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(5) \u00cen ceea ce prive\u0219te remunera\u021biile, accesul la sistemele de asigur\u0103ri sociale legate de activit\u0103\u021bi salariate sau independente, precum \u0219i alte condi\u021bii privind locurile de munc\u0103 se aplic\u0103 legisla\u021bia intern\u0103 in vigoare.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Articolul 27<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Accesul la educa\u021bie<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(1) Statele membre acord\u0103 acces deplin la sistemul de educa\u021bie tuturor minorilor c\u0103rora li s-a acordat statutul de refugiat sau protec\u021bie subsidiar\u0103, \u00een acelea\u0219i condi\u021bii ca cele aplicate propriilor cetateni.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(2) Statele membre permit adul\u021bilor c\u0103rora li s-a acordat statutul de refugiat sau protec\u021bie subsidiar\u0103 s\u0103 aib\u0103 acces la sistemul educa\u021bional general, precum \u0219i la perfec\u021bionare sau reformare profesional\u0103, \u00een acelea\u0219i condi\u021bii ca cele aplicate cetatenilor \u021b\u0103rilor ter\u021be care au re\u0219edin\u021ba \u00een mod legal pe teritoriul lor.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(3) Statele membre asigur\u0103 tratamentul egal \u00eentre beneficiarii statutului de refugiat sau ai protec\u021biei subsidiare \u0219i propriii cetateni \u00een cadrul procedurilor existente de recunoa\u0219tere a diplomelor, certificatelor sau a altor titluri oficiale de calificare.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Articolul 28<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(1) Statele membre se asigur\u0103 c\u0103 beneficiarii statutului de refugiat sau ai protec\u021biei subsidiare primesc, \u00een statul membru care a acordat statutul, aceea\u0219i asisten\u021b\u0103 social\u0103 necesar\u0103 ca cea prev\u0103zut\u0103 pentru cetatenii respectivului stat membru.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\"><span class=\"Apple-style-span\">(2) Prin derogare de la norma general\u0103 prev\u0103zut\u0103 la alineatul (1), statele membre pot limita asisten\u021ba social\u0103 acordat\u0103 beneficiarilor&nbsp;<\/span><span class=\"Apple-style-span\">&nbsp;<\/span><span class=\"Apple-style-span\">protec\u021biei subsidiare la presta\u021biile de baz\u0103, acordate la nivelul \u0219i \u00een condi\u021biile de acces aplicabile propriilor cetateni.<\/span><\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Articolul 29<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Asistenta medicala<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(1) Statele membre se asigur\u0103 c\u0103 beneficiarii statutului de refugiat sau ai protec\u021biei subsidiare au acces la asistenta medicala \u00een acelea\u0219i condi\u021bii de acces ca cele aplicabile cetatenilor statului membru care a acordat statutul.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(2) Prin derogare de la norma general\u0103 prev\u0103zut\u0103 la alineatul (1), statele membre pot limita asistenta medicala acordat\u0103 beneficiarilor protec\u021biei subsidiare la serviciile de baz\u0103, acordate la nivelul \u0219i \u00een condi\u021biile de acces aplicabile propriilor cetateni.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(3) Statele membre asigur\u0103, \u00een acelea\u0219i condi\u021bii de acces ca cele aplicabile cetatenilor statului membru care a acordat statutul, asistenta medicala corespunz\u0103toare pentru beneficiarii statutului de refugiat sau ai protec\u021biei subsidiare cu nevoi speciale, precum femeile \u00eens\u0103rcinate, persoanele cu handicap, victime ale torturii, ale violului sau altor forme grave de violen\u021b\u0103 psihologic\u0103, fizic\u0103 sau sexual\u0103 sau minorii care au fost victime ale oric\u0103ror forme de abuz, neglijen\u021b\u0103, exploatare, tortur\u0103, tratamente crude, inumane \u0219i degradante sau au avut de suferit in urma unui conflict armat.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Articolul 30<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Minorii ne\u00eenso\u021bi\u021bi<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\"><span class=\"Apple-style-span\">(1) De \u00eendat\u0103 ce este posibil, dup\u0103 acordarea statutului de refugiat sau al statutului conferit prin protec\u021bie subsidiar\u0103, statele membre iau m\u0103surile necesare pentru a asigura reprezentarea minorilor ne\u00eenso\u021bi\u021bi printr-un reprezentant&nbsp;<\/span><span class=\"Apple-style-span\">&nbsp;<\/span><span class=\"Apple-style-span\">legal sau, dac\u0103 este necesar, printr-un organism responsabil cu \u00eengrijirea \u0219i bun\u0103starea minorilor sau prin orice alt\u0103 form\u0103 corespunz\u0103toare de reprezentare, \u00een special cea stabilit\u0103 de legisla\u021bie sau printr-o masura legislativa.<\/span><\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(2) Statele membre se asigur\u0103 c\u0103, la punerea \u00een aplicare a prezentei directive, tutorele sau reprezentatul desemnat \u021bin seama \u00een mod adecvat de nevoile minorilor ne\u00eenso\u021bi\u021bi. Autorit\u0103\u021bile competente evalueaz\u0103 periodic situa\u021bia.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(3) Statele membre se asigur\u0103 c\u0103 minorii ne\u00eenso\u021bi\u021bi sunt plasa\u021bi:<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(a) la rude adulte;<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(b) \u00eentr-o familie gazd\u0103;<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(c) \u00een centre specializate \u00een primirea minorilor sau<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(d) \u00een alte locuri de cazare adaptate pentru minori.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">\u00cen acest context, se \u021bine seama de opinia copilului, \u00een func\u021bie de v\u00e2rsta \u0219i maturitatea acestuia.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(4) \u00cen m\u0103sura in care este posibil, fra\u021bii nu se separ\u0103, \u021bin\u00e2nd seama de interesul superior al minorului \u00een cauz\u0103 \u0219i, \u00een special, de v\u00e2rsta \u0219i maturitatea acestuia. \u00cen cazul minorilor ne\u00eenso\u021bi\u021bi, schimbarea locurilor de re\u0219edin\u021b\u0103 se limiteaz\u0103 la minimum.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(5) Pentru a proteja interesul superior al minorului ne\u00eenso\u021bit, statele membre caut\u0103 familia acestuia de \u00eendat\u0103 ce este posibil. \u00cen cazul \u00een care ar fi amenin\u021bat\u0103 via\u021ba sau integritatea fizic\u0103 a unui minor sau a rudelor apropiate, \u00een special \u00een cazul \u00een care au r\u0103mas \u00een \u021bara de origine, trebuie ac\u021bionat astfel \u00eenc\u00e2t colectarea, prelucrarea \u0219i difuzarea informa\u021biilor privind respectivele persoane s\u0103 fie confiden\u021biale.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(6) Personalul responsabil pentru minorii ne\u00eenso\u021bi\u021bi trebuie s\u0103 aib\u0103 sau s\u0103 primeasc\u0103 o formare profesional\u0103 corespunz\u0103toare nevoilor acestora.<\/span><\/div>\n<div style=\"background-attachment: initial; Respectivele propuneri de modific\u0103ri se refer\u0103 cu prioritate la articolele 15, 26 \u0219i 33. Statele membre transmit Comisiei orice informa\u021bie util\u0103 pentru preg\u0103tirea respectivului raport p\u00e2n\u0103 la 10 octombrie 2007.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(2) Dup\u0103 prezentarea respectivului raport, Comisia prezint\u0103 Parlamentului European \u0219i Consiliului, cel pu\u021bin o dat\u0103 la cinci ani, un raport privind punerea \u00een aplicare a prezentei directive.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Articolul 38<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Transpunerea<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">(1) Statele membre pun \u00een aplicare dispozitiile legislative, regulamente \u0219i actele administrative necesare pentru a se conforma prezentei directive p\u00e2n\u0103 la 10 octombrie 2006. Statele membre informeaz\u0103 de \u00eendat\u0103 Comisia cu privire la aceasta.<\/span><\/div>\n<div style=\"background-attachment: initial; background-clip: initial; background-image: initial; background-origin: initial; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Atunci c\u00e2nd statele membre adopt\u0103 aceste acte, acestea con\u021bin o trimitere la prezenta directiv\u0103 sau sunt \u00eenso\u021bite de o asemenea trimitere la data public\u0103rii lor oficiale.
