{"id":89630,"date":"2018-02-16T22:20:00","date_gmt":"2018-02-16T22:20:00","guid":{"rendered":""},"modified":"2023-01-06T20:35:47","modified_gmt":"2023-01-06T20:35:47","slug":"drepturile-omului_16","status":"publish","type":"post","link":"https:\/\/cvnextjob.com\/index.php\/2018\/02\/16\/drepturile-omului_16\/","title":{"rendered":"Drepturile Omului"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><h3 class=\"post-title entry-title\" itemprop=\"headline\" style=\"background-color: white; color: #333333; font-family: Oswald, sans-serif; font-size: 20px; font-stretch: normal; font-variant-east-asian: normal; font-variant-numeric: normal; font-weight: normal; line-height: 1.1; margin: 0px 0px 10px; padding: 0px; position: relative;\"><\/h3>\n<div class=\"post-body entry-content\" id=\"post-body-2440086492644992867\" style=\"background-color: white; color: #555555; font-family: Roboto, Arial, Helvetica, sans-serif; font-size: 13px; line-height: 1.7; margin: 0px; overflow: hidden; padding: 0px; width: 615px;\">\n<div style=\"text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">SISTEMUL EUROPEAN DE PROTECTIE A DREPTURILOR OMULUI &#8211; PRIVIRE SPECIALA ASUPRA CURTII EUROPENE A DREPTURILOR OMULUI.Conceptul drepturilor omului &#8211; scurt istoric \u00censcriindu-se \u00een filosofia ,,dreptului natural \u015fi al gin\u0163ilor\u201d \u015fi st\u00e2nd la baza teoriei ,,contractului social\u201d al lui Jean-Jacques Rousseau, conceptul drepturilor omului a fost formulat pentru prima dat\u0103 \u00een secolul al XVIII-lea, \u00eens\u0103 a fost concretizat \u00een timpul a dou\u0103 mari evenimente: revolu\u0163ia burghez\u0103 din Franta (1789) \u015fi rebeliunea coloniilor engleze din America de Nord \u00eempotriva Marii Britanii (1776).<\/span><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp;Astfel, Declaratia revolu\u0163iei franceze privind drepturile omului \u015fi cet\u0103\u0163eanului, din 26 august 1789, d\u0103 expresie filosofiei dreptului natural \u015fi consacr\u0103 principiul egalit\u0103\u0163ii tuturor persoanelor \u00een fa\u0163a legii, ca principiu pe care se \u00eentemeiaz\u0103 celelalte drepturi \u015fi libert\u0103\u0163i, cum sunt: dreptul la proprietate, la securitate, la rezistent\u0103 fa\u0163\u0103 de opresiune, libertatea de g\u00e2ndire, de expresie \u0163i de manifestare. Declara\u0163ia de independen\u0163\u0103 a coloniilor engleze din America, adoptat\u0103 la 4 iulie 1776 la Philadelphia, proclam\u0103 principiul egalit\u0103\u0163ii \u00eentre indivizi, dreptul la via\u0163\u0103 \u0163i libertate ca drepturi inalienabile \u015fi instituirea guvernelor cu consim\u0163\u0103m\u00e2ntul celor guverna\u0163i. Punerea \u00een aplicare a drepturilor astfel proclamate, at\u00e2t \u00een S.U.A., c\u00e2t \u015fi \u00een Fran\u0163a s-a realizat prin constitu\u0163ii scrise.<\/span><\/div>\n<div style=\"text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Contribu\u0163ii \u00eensemnate la definirea \u015fi cristalizarea drepturilor omului au adus \u015fi actele constitu\u0163ionale engleze de la sf\u00e2r\u015fitul sec. al XVII-lea.&nbsp; Astfel, ,,Habeas Corpus\u201d, act adoptat de parlament \u00een 1679, garanteaz\u0103 inviolabilitatea persoanei, iar ,,Bill of Rights\u201d (Declaratia drepturilor) din 1689 recunoa\u015fte dreptul la alegeri libere, libertatea cuv\u00e2ntului, eliberarea&nbsp; sub cau\u0163iune, dreptul de a fi judecat de un tribunal cu jurii, precum \u015fi alte drepturi, \u00eens\u0103 primul document european \u00een care au fost schi\u0163ate primele elemente ale protec\u0163iei juridice a persoanei umane este,,Magna Carta Libertatum\u201d, semnat\u0103 \u00een 1215 de regele Ioan F\u0103r\u0103 de \u0162ar\u0103, document prin&nbsp; care se reglementeaz\u0103 raporturile regelui cu nobilimea \u015fi biserica englez\u0103, \u015fi care consacr\u0103 dreptul la judecat\u0103 potrivit legii. ,,Nici un om liber nu va fi \u00eenchis sau expulzat sau nimicit \u00een vreun fel f\u0103r\u0103 a fi judecat \u00een mod legal &nbsp;de egalii s\u0103i, potrivit legilor \u0163\u0103rii\u201d.<\/span><\/div>\n<div style=\"text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Protec\u0163ia drepturilor omului prin instrumente juridice de transpunere a acestor drepturi \u00een prevederi legale, a devenit un imperativ al comunit\u0103\u0163ii interna\u0163ionale dupa al doilea r\u0103zboi mondial, \u00een urma dezv\u0103luirii atrocit\u0103\u0163ilor comise de nazi\u015fti, iar mai t\u00e2rziu, \u015fi ca urmare a perpetu\u0103rii practicii \u00e2nc\u0103lc\u0103rii drepturilor omului \u00een statele cu regimuri totalitare. Aceast\u0103 necesitate s-a concretizat \u00een reglement\u0103ri cu caracter universal sau regional ce au urmat semn\u0103rii Cartei O.N.U.(26 iunie 1945).<\/span><\/div>\n<div style=\"text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Astfel, Declaratia Universala a Drepturilor Omului, proclamat\u0103 \u015fi adoptat\u0103 de Adunarea Generala a O.N.U. la 10 decembrie 1948 este primul document cu voca\u0163ie universal\u0103 \u00een acest domeniu \u015fi stabile\u015fte o concep\u0163ie unitar\u0103 a comunit\u0103\u0163ii interna\u0163ionale despre drepturile \u015fi libert\u0103\u0163ile omului, deschiz\u00e2nd calea spre un sistem de protec\u0163ie interna\u0163ional\u0103 a drepturilor omului. Dupa 1948, Adunarea Generala a O.N.U. a adoptat \u00een acest domeniu peste 60 de conven\u0163ii \u015fi declara\u0163ii prin care s-a avut \u00een vedere \u015fi instituirea unor mecanisme specifice de protectie a acestor drepturi.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<h1 style=\"font-size: 40px; font-stretch: normal; font-variant-east-asian: normal; font-variant-numeric: normal; font-weight: normal; line-height: 1; margin: 0px 0px 16px; position: relative; text-align: justify;\"><span lang=\"RO\" style=\"font-family: &quot;Times New Roman&quot;; font-size: 12pt;\">Sistemul european de protec\u0163ie a drepturilor omului<\/span><\/h1>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Sistemul european de protec\u0163ie a drepturilor omului a fost stabilit de c\u0103tre Consiliul Europei, al c\u0103rui statut, semnat la Londra la 5 mai 1949, prevede \u00een art.3 c\u0103: ,,fiecare membru al Consiliului Europei trebuie s\u0103 accepte principiile statului de drept \u015fi principiul \u00een virtutea c\u0103ruia fiecare persoan\u0103 aflat\u0103 sub jurisdic\u0163ia sa trebuie s\u0103 se bucure de drepturile \u015fi libert\u0103\u0163ile fundamentale ale omului\u201d.<\/span><\/div>\n<div style=\"text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Principalul document, \u00een baza c\u0103ruia s-au instituit mecanismele \u0163i institu\u0163iile necesare punerii \u00een aplicare a acestor drepturi \u015fi libert\u0103\u0163i, este Conven\u0163ia pentru Ap\u0103rarea Drepturilor Omului \u015fi Libert\u0103\u0163ilor Fundamentale, semnat\u0103 la 4 noiembrie 1950, la Roma, de c\u0103tre reprezentan\u0163ii a 13 guverne, \u015fi care intr\u0103 \u00een vigoare la 3 septembrie 1953,&nbsp; odat\u0103 cu depunerea celui de-al doilea document de ratificare. Completat\u0103 sau modificat\u0103, p\u00e2n\u0103 \u00een prezent, de 11 protocoale adi\u0163ionale, Conven\u0163ia reune\u015fte toate statele membre ale Consiliului Europei, printre care \u015fi Rom\u00e2nia&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; (7 octombrie 1993).<b><\/b><\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<h1 style=\"font-size: 40px; font-stretch: normal; font-variant-east-asian: normal; font-variant-numeric: normal; font-weight: normal; line-height: 1; margin: 0px 0px 16px; position: relative; text-align: justify;\"><span lang=\"RO\" style=\"font-family: &quot;Times New Roman&quot;; font-size: 12pt;\">Drepturile garantate prin Conventia European\u0103 a Drepturilor Omului<\/span><\/h1>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Elementul de garan\u0163ie al drepturilor \u015fi libert\u0103\u0163ilor proclamate de Conven\u0163ie rezult\u0103 din art.1 al acesteia, care prevede c\u0103 ,,\u00cenaltele P\u0103r\u0163i contractante recunosc oric\u0103rei persoane de sub jurisdic\u0163ia lor drepturile \u015fi libert\u0103\u0163ile definite \u00een titlul 1 al prezentei Conven\u0163ii\u201d.&nbsp; Drepturile \u015fi libert\u0103\u0163ile \u00eenscrise \u00een Conven\u0163ie \u015fi \u00een Protocoalele adi\u0163ionale 1, 4, 6 \u015fi 7 pot fi grupate dup\u0103 cum urmeaz\u0103:<\/span><\/div>\n<div style=\"margin-left: 0in; text-align: justify; text-indent: 0in;\"><span lang=\"RO\" style=\"font-family: Arial; font-size: 13pt;\">a)&nbsp;<\/span><span lang=\"RO\" style=\"font-size: 12pt;\">drepturi \u015fi libert\u0103\u0163i privind persoana fizic\u0103: dreptul la via\u0163\u0103 (art.2), interdic\u0163ia torturii \u015fi tratamentelor inumane \u015fi degradante (art.3), interdic\u0163ia sclaviei, a muncii for\u0163ate (art.4), dreptul la libertate \u015fi siguran\u0163\u0103 (art.5), libertatea de circula\u0163ie (Protocol 4), abolirea pedepsei cu moartea (Protocol 6) ;<\/span><\/div>\n<div style=\"margin-left: 0in; text-align: justify; text-indent: 0in;\"><span lang=\"RO\" style=\"font-family: Arial; font-size: 13pt;\">b)&nbsp;<\/span><span lang=\"RO\" style=\"font-size: 12pt;\">dreptul la respect pentru via\u0163a privat\u0103 \u015fi de familie, domiciliu \u015fi coresponden\u0163\u0103 (art.8);<\/span><\/div>\n<div style=\"margin-left: 0in; text-align: justify; text-indent: 0in;\"><span lang=\"RO\" style=\"font-family: Arial; font-size: 13pt;\">c)&nbsp;<\/span><span lang=\"RO\" style=\"font-size: 12pt;\">dreptul la un proces public echitabil, desf\u0103\u015furat \u00eentr-un timp rezonabil, \u00een fa\u0163a unui tribunal independent \u015fi impar\u0163ial, stabilit conform legii (art.6), libertatea de recurs (Protocol 7);<\/span><\/div>\n<div style=\"margin-left: 0in; text-align: justify; text-indent: 0in;\"><span lang=\"RO\" style=\"font-family: Arial; font-size: 13pt;\">d)&nbsp;<\/span><span lang=\"RO\" style=\"font-size: 12pt;\">libertatea de g\u00e2ndire, con\u015ftiin\u0163\u0103 \u015fi religie (art.9);<\/span><\/div>\n<div style=\"margin-left: 0in; text-align: justify; text-indent: 0in;\"><span lang=\"RO\" style=\"font-family: Arial; font-size: 13pt;\">e)&nbsp;<\/span><span lang=\"RO\" style=\"font-size: 12pt;\">protec\u0163ia activit\u0103\u0163ii sociale \u015fi politice: libertatea de reuniune pa\u015fnic\u0103 \u015fi de asociere (art.11), drepturile la alegeri libere prin vot secret&nbsp; \u015fi la educa\u0163ie (Protocol 1);<\/span><\/div>\n<div style=\"margin-left: 0in; text-align: justify; text-indent: 0in;\"><span lang=\"RO\" style=\"font-family: Arial; font-size: 13pt;\">f)&nbsp;<span style=\"font-family: &quot;Times New Roman&quot;; font-size: 7pt; font-stretch: normal; font-variant-east-asian: normal; font-variant-numeric: normal; line-height: normal;\">&nbsp;&nbsp;<\/span><\/span><span lang=\"RO\" style=\"font-size: 12pt;\">dreptul la proprietate (Protocol 1);<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\"><b><span lang=\"RO\" style=\"font-size: 12pt;\">Sistemul ini\u0163ial<\/span><\/b><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp;<b>al mecanismului de control stabilit prin Conventie<\/b><\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Conventia European\u0103&nbsp; a drepturilor omului a avut \u00een vedere, prin art.19, instituirea unui sistem de protec\u0163ie a acestor drepturi structurat pe dou\u0103 nivele: o Comisie European\u0103 a drepturilor omului \u015fi o Curte European\u0103 a drepturilor omului. Astfel, la 18 mai 1954, Comitetul Mini\u015ftrilor al Consiliului Europei alege pentru prima dat\u0103 membrii Comisiei Europene a Drepturilor Omului, \u00een fa\u0163a c\u0103reia, \u00een mod obligatoriu \u00eencepea orice proces introdus \u00een baza Conven\u0163iei. Mai t\u00e2rziu, la 21 ianuarie 1959, Adunarea Consultativ\u0103 Parlamentara a Consiliului Europei alege, la r\u00e2ndul s\u0103u, pentru prima dat\u0103, judecatorii Curtii Europene a Drepturilor Omului, chemat\u0103 s\u0103 examineze, dupa Comisie, una din aceste cauze \u015fi s\u0103 le solu\u0163ioneze prin hot\u0103r\u00e2ri definitive \u015fi obligatorii. \u00cen afara competen\u0163ei contencioase, pe care a avut-o \u00eenc\u0103 de la \u00eenfiin\u0163are, Curtea cap\u0103t\u0103 \u015fi competen\u0163a consultativ\u0103 \u00een 1970, odat\u0103 cu intrarea \u00een vigoare a celui de-al doilea protocol adi\u0163ional al Conventiei.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/span><\/div>\n<div style=\"text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Mecanismul instituit de Conventie s-a dovedit neperformant, \u00eentruc\u00e2t&nbsp; \u00eenmul\u0163irea&nbsp; pl\u00e2ngerilor \u015fi complexitatea cauzelor au condus&nbsp; la solu\u0163ionarea acestora \u00een perioade lungi de timp (chiar 5 ani), astfel ca \u00een Protocolul adi\u0163ional nr.11, \u00eencheiat la Strasbourg la 11 mai 1994, s-a statuat inlocuirea fostului mecanism prev\u0103zut de art.19 (Comisia \u015fi Curtea) \u015fi constituirea unei instan\u0163e unice, cu caracter permanent &#8211; Curtea Europeana a Drepturilor&nbsp; Omului, cu sediul la Strasbourg.&nbsp; Protocolul a fost semnat de toate statele membre ale Consiliului Europei \u015fi a fost ratificat de marea lor majoritate \u015fi a intrat \u00een vigoare la 1 noiembrie 1998, dupa 40 de ani de activitate efectiv\u0103 a fostei&nbsp; Cur\u0163i.&nbsp; Rom\u00e2nia a ratificat&nbsp; Conventia pentru ap\u0103rarea drepturilor \u015fi libert\u0103\u0163ilor fundamentale ale omului prin Legea nr.30 din 18 mai 1994. Prin aceea\u015fi lege s-au&nbsp; ratificat \u015fi protocoalele adi\u0163ionale 1-10, \u00eens\u0103&nbsp; Protocolul nr.11 referitor la restructurarea mecanismului de control stabilit prin conven\u0163ie a fost ratificat prin legea nr.79 din 6 iunie 1995.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\"><b><span lang=\"RO\" style=\"font-size: 12pt;\">Curtea european\u0103 a drepturilor omului \u00een urma reformei<\/span><\/b><span lang=\"RO\" style=\"font-size: 12pt;\"><\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Prin Protocolul nr. 11 s-au adus numeroase modific\u0103ri Conven\u0163iei, \u015fi celorlalte Protocoale adi\u0163ionale, iar Protocolul nr.9 a&nbsp; fost abordat.&nbsp;<\/span><\/div>\n<div style=\"text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Reforma adoptat\u0103 prin Protocolul nr.11 a adus numeroase modificari mecanismului de control stabilit prin Conventie.<\/span><\/div>\n<div style=\"text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Fostele organe de control (Comisia \u015fi Curtea) \u015fi-au \u00eencetat existen\u0163a ,o nou\u0103 Curte func\u0163ioneaz\u0103 permanent, fiind instalat\u0103 la Strasbourg. Curtea se compune dintr-un num\u0103r de judec\u0103tori egal cu cel al p\u0103r\u0163ilor contractante, care \u00ee\u015fi exercit\u0103&nbsp; mandatul cu titlul individual.&nbsp; Ei sunt ale\u015fi de Adunarea Parlamentar\u0103, \u00een numele \u00cenaltelor P\u0103r\u0163i contractante, dintre candida\u0163ii propu\u015fi de acestea, pe o durat\u0103 de \u015fase ani, cu posibilitatea realegerii.<\/span><\/div>\n<div style=\"text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Competen\u0163a Cur\u0163ii, conform art. 32, acoper\u0103 toate problemele privind interpretarea \u015fi aplicarea Conven\u0163iei \u015fi a Protocoalelor sale, care \u00eei sunt supuse de c\u0103tre state (art.33), deci cauzele interstatale, de c\u0103tre persoane fizice sau alte entit\u0103\u0163i nestatale, prin cereri individuale (art.34), iar la cererea Comitetului Mini\u015ftrilor al Consiliului Europei, d\u0103 avize consultative asupra problemelor juridice privind interpretarea Conventiei \u015fi a Protocoalelor acesteia.<\/span><\/div>\n<div style=\"text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; To\u0163i reclaman\u0163ii au acces direct la noua Curte, \u00eens\u0103 numai dup\u0103 epuizarea c\u0103ilor de recurs intern, iar cauzele inadmisibile sunt declarate ca atare \u015fi sunt retrase din sistem, dup\u0103 filtrare, \u00eentr-un stadiu incipient, prin decizia Cur\u0163ii, care hot\u0103r\u0103\u015fte aceasta \u00een cadrul unui Comitet format din trei judecatori.<\/span><\/div>\n<div style=\"text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00cen marea majoritate a cazurilor, Curtea \u00ee\u015fi desf\u0103\u015foara activitatea \u00een Camera de \u015fapte judec\u0103tori \u015fi numai \u00een cazuri excep\u0163ionale func\u0163ioneaz\u0103 ca Mare Camer\u0103 \u015fi este compus\u0103 din \u015faptesprezece judec\u0103tori.
