Potrivit primului act normativ,articolul 1, toate \u00eentreprinderile , institu\u0163iile, exploat\u0103rile \u015fi a\u015fez\u0103mintele publice (sau serviciile din care sunt compuse) care nu au atribu\u0163ii exclusiv administrative, precum \u015fi toate bunurile \u015fi drepturile care fac parte din domeniul public sau privat al statului , unita\u0103\u0163ilor administrative-teritoriale sau din domeniul oric\u0103ror altor institu\u0163ii de utilitate public\u0103, aflate sub controlul acestora, se vor organiza \u00een una din urm\u0103toarele forme : arendare sau \u00eenchiriere; concesiune; regie public\u0103 sau regie mixt\u0103; regie comercial\u0103; regie cooperativ\u0103; o combina\u0163ie \u00eentre aceste sisteme.<\/span><\/div>\n<div style=\"margin-left: 36pt; text-align: justify;\"><span lang=\"EN-US\">Conform aceleia\u015fi legi, durata concesiunii pentru bunurile domeniului public nu putea fi mai mare de 30 de ani, iar pentru bunurile apar\u0163in\u00e2nd domeniului privat al statului, unit\u0103\u0163ilor administrativ-teritoriale sau institu\u0163iilor aflate sub controlul acestora, durata concesiunii era de 50 de ani ( art.25, lit.c).<\/span><\/div>\n<div style=\"margin-left: 36pt; text-align: justify;\"><span lang=\"EN-US\">\u00cen prezent, exist\u0103 o serie de dispozi\u0163ii legale privitoare la concesionarea bunurilor sau a serviciilor publice, \u00een Constitu\u0163ie, dar \u015fi \u00eentr-o serie de legi, cele mai multe anterioare legii fundamentale, cum ar fi&nbsp;<i>Legea nr. 15 din 1990<\/i><a href=\"http:\/\/www.blogger.com\/post-create.g?blogID=4202955034125599721#_ftn2\" name=\"_ftnref2\" style=\"color: #ee5307; outline: none; text-decoration-line: none;\" title=\"\"><span class=\"MsoFootnoteReference\"><span class=\"MsoFootnoteReference\"><span lang=\"EN-US\" style=\"font-family: &quot;Times New Roman&quot;; font-size: 12pt;\"><\/span><\/span><\/span><\/a>&nbsp;privind reorganizarea unit\u0103\u0163ilor economice de stat ca regii autonome \u015fi societ\u0103\u0163i comerciale,&nbsp;<i>Legea nr. 18\/1991<\/i>, privind fondul funciar<a href=\"http:\/\/www.blogger.com\/post-create.g?blogID=4202955034125599721#_ftn3\" name=\"_ftnref3\" style=\"color: #ee5307; outline: none; text-decoration-line: none;\" title=\"\"><span class=\"MsoFootnoteReference\"><span class=\"MsoFootnoteReference\"><span lang=\"EN-US\" style=\"font-family: &quot;Times New Roman&quot;; font-size: 12pt;\"><\/span><\/span><\/span><\/a>&nbsp;cu modific\u0103rile ulterioare,&nbsp;<i>Legea nr. 50\/1991<\/i><a href=\"http:\/\/www.blogger.com\/post-create.g?blogID=4202955034125599721#_ftn4\" name=\"_ftnref4\" style=\"color: #ee5307; outline: none; text-decoration-line: none;\" title=\"\"><span class=\"MsoFootnoteReference\"><span class=\"MsoFootnoteReference\"><span lang=\"EN-US\" style=\"font-family: &quot;Times New Roman&quot;; font-size: 12pt;\"><\/span><\/span><\/span><\/a>&nbsp;privind autorizarea execut\u0103rii construc\u0163iilor \u015fi unele m\u0103suri pentru realizarea locuin\u0163elor,&nbsp;<i>Legea nr.35 \/ 1991<\/i><a href=\"http:\/\/www.blogger.com\/post-create.g?blogID=4202955034125599721#_ftn5\" name=\"_ftnref5\" style=\"color: #ee5307; outline: none; text-decoration-line: none;\" title=\"\"><span class=\"MsoFootnoteReference\"><span class=\"MsoFootnoteReference\"><span lang=\"EN-US\" style=\"font-family: &quot;Times New Roman&quot;; font-size: 12pt;\"><\/span><\/span><\/span><\/a>&nbsp;privind regimul investi\u0163iilor str\u0103ine , la care se adaug\u0103 o serie de hot\u0103r\u00e2ri ale Guvernului, dintre care re\u0163inem&nbsp;<i>H.G. nr.1228 \/ 1990<\/i>&nbsp;pentru aprobarea Metodologiei concesion\u0103rii, \u00eenchirierii \u015fi loca\u0163iei de gestiune.
