text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Modific\u0103rile teritoriale, indiferent c\u0103 acestea duc la apari\u0163ia unor noi state, astfel cum s-a \u00eent\u00e2mplat \u00een cazul dezmembr\u0103rii unor imperii sau a desf\u0103\u015fur\u0103rii procesului de decolonizare, la schimb\u0103ri majore \u00een natura unui stat, determinate de procese revolu\u0163ionare sau la transferuri de teritorii de la un stat la altul, pun \u00een dreptul interna\u0163ional problema succesiunii noilor state la statele anterioare.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Modific\u0103rile teritoriale pot consta \u00een:<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; a) reunirea mai multor state \u00eentr-unul singur, pe calea fuziunii sau a absorb\u0163iei ( cazuri numeroase \u00een cadrul procesului de unificare a statelor europene, iar mai recent reuniunea R.F.G.cu R.D.G. \u00een 1990);<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; b) dezmembrarea unui stat, \u00een urma c\u0103ruia apar mai multe state independente (destr\u0103marea Imperiului Austro-Ungar \u00een 1919, iar mai recent dizolvarea U..R.S.S. \u015fi a Iugoslaviei dup\u0103 1989);<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; c) separarea sau secesiunea, c\u00e2nd din cadrul unui stat se desprinde un alt stat(Pakistanul sau Banglade\u015ful desprinse de India, Norvegia desprins\u0103 de Suedia etc);<\/span><\/div>\n<div style=\"line-height: 19.5px; \u00cen asemenea situa\u0163ii se pune problema \u00een ce m\u0103sur\u0103 \u00eentre statele noi \u015fi cele vechi sau \u00eentre statele implicate \u00een asemenea modific\u0103ri are loc transmiterea unor drepturi \u015fi obliga\u0163ii asumate de statele respective p\u00e2n\u0103 la apari\u0163ia modific\u0103rilor teritoriale.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Principalele probleme care se ridic\u0103 \u00een cadrul succesiunii statelor se refer\u0103 la succesiunea la tratate, la bunuri, la arhive \u015fi la datoria de stat, iar uneori \u015fi la cet\u0103\u0163enie.<a href=\"https:\/\/www.blogger.com\/blogger.g?blogID=4202955034125599721\" name=\"more\" style=\"color: #ee5307; outline: none; text-decoration-line: none;\"><\/a><\/span><\/div>\n<p><\/p>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00cen dreptul interna\u0163ional clasic rezolvarea unor asemenea probleme s-a f\u0103cut prin transpunerea automat\u0103 a principiilor succesiunii de drept civil din dreptul intern \u00een cadrul dreptului interna\u0163ional public.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00cen dreptul interna\u0163ional contemporan a devenit, \u00eens\u0103, clar c\u0103 o asemenea solu\u0163ie&nbsp; nu este cea indicat\u0103, \u00een dreptul interna\u0163ional afl\u00e2ndu-ne \u00een prezen\u0163a nu a unei simple succesiuni, ci a unui transfer de suveranitate, cu toate consecin\u0163ele ce decurg de aici.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Statul succesor nu este continuatorul statului predecesor.Fiecare dintre ele are o personalitate juridic\u0103 proprie. Succesiunea \u00eentr-un teritoriu determinat atrage \u00eenlocuirea ordinii juridice a statului predecesor cu ordinea juridic\u0103 a statului succesor. Ca urmare, statul succesor nu este \u00een principiu obligat s\u0103 preia automat \u015fi integral drepturile \u015fi obliga\u0163iile statului predecesor, \u00een virtutea suveranit\u0103\u0163ii sale are dreptul de a decide \u00een ce m\u0103sur\u0103 va men\u0163ine reporturile juridice ale predecesorului s\u0103u. Respingerea raporturilor juridice, a drepturilor \u015fi obliga\u0163iilor anterioare incompatibile cu politica intern\u0103 \u015fi extern\u0103, cu interesele legitime ale statului succesor, semnific\u0103 manifestarea suveranit\u0103\u0163ii sale.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Pe de alt\u0103 parte, \u00eens\u0103, statul succesor poate avea el \u00eensu\u015fi interesul de a men\u0163ine o anumit\u0103 continuitate juridic\u0103 \u015fi a nu \u00eenl\u0103tura \u00eentru totul ordinea juridic\u0103 a statului predecesor pentru a realiza o relativ\u0103 stabilitate \u00een ordinea sa intern\u0103 \u015fi a nu reconstrui ceea ce este deja bine construit. De asemenea , nu este nici \u00een interesul comunit\u0103\u0163ii interna\u0163ionale \u00een ansamblul s\u0103u \u015fi nici al statelor ter\u0163e ca succesiunea unui stat s\u0103 duc\u0103 la ruperea oric\u0103ror leg\u0103turi cu obliga\u0163iile asumate de statul predecesor.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; De aceea, noua autoritate a statului succesor va selecta \u015fi va prelua prin intermadiul succesiunii anumite elemente ale ordinii juridice vechi, at\u00e2t cu privire la garantarea unor drepturi ale unor persoane fizice sau juridice \u00een raport cu alte state, c\u00e2t \u015fi cu privire la respectarea unor angajamente interna\u0163ionale anterior asumate.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Succesiunea statelor \u00een dreptul interna\u0163ional este deosebit de controversat\u0103.P\u00e2n\u0103 \u00een prezent nu s-a putut ajunge, nici pe cale cutumiar\u0103, nici prin tratate, la reguli uniforme cu aplicabilitate general\u0103 privind modul \u00een care trebuie s\u0103 se procedeze la transferul de suveranitate.\u00cen majoritatea cazurilor problemele legate de succesiunea \u00eentre statul predecesor \u015fi statul seccesor s-au rezolvat prin acorduri speciale \u00eentre aceste state, sau prin unele legi interne ori prin declara\u0163ii unilaterale ale statului succesor.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Unele principii \u015fi tendin\u0163e generale ale practicii privind rezolvarea diferitelor cazuri de succesiune a statelor au fost codificate \u00een dou\u0103 conven\u0163ii interna\u0163ionale, ambele semnate la Viena, care nu au intrat, \u00eens\u0103, p\u00e2n\u0103 \u00een prezent \u00een vigoare: \u201e Conven\u0163ia referitoare la succesiunea statelor cu privire la tratate\u201d (1978) \u015fi \u201e Conven\u0163ia referitoare la succesiunea statelor \u00een ce prive\u015fte bunurile, arhivele \u015fi datoriile\u201d (1983).<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00cen continuare vom prezenta principiile \u015fi normele privind succesiunea statelor \u00een situa\u0163ii tipice de succesiune \u015fi anume fuziunea \u015fi dezmembrarea statelor, \u00een situa\u0163ii tipice de succesiune \u015fi anume fuziunea \u015fi dezmembrarea statelor, transferarea de teritorii \u015fi formarea noilor state ca urmare a lichid\u0103rii sistemului colonial, urm\u0103rind domeniile principale \u00een care se pun asemenea probleme: succesiunea la tratatele incheiate, situa\u0163ia bunurilor preluate, datoriile contractate de statul predecesor.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00cen cazul fuziunii sau dezmembr\u0103rii statelor \u00een principiu exist\u0103 o continuitate \u00eentre obliga\u0163iile statului predecesor \u015fi statul succesor.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Statul succesor trebuie s\u0103 men\u0163in\u0103 tratatele care legau statul predecesor cu privire la ansamblul teritoriului s\u0103u, cu unele preciz\u0103ri \u015fi anume:<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; -\u00ee\u015fi men\u0163in valabilitatea pentru statul sau statele succesoare tratatele care stabilesc frontiere sau orice alt regim teritorial, cum sunt cele privind naviga\u0163ia fluvial\u0103, transportul energiei electrice, comunica\u0163iile feroviare, statutul canalelor;<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; -\u00ee\u015fi continu\u0103 valabilitatea tratatelor prin care s-au creat situa\u0163ii obiective, opozabile erga omnes, cum ar fi neutralitatea, zonele demilitarizate sau libertatea naviga\u0163iei pentru to\u0163i \u00een anumite spa\u0163ii marine (\u00een marea liber\u0103, \u00een str\u00e2mtorile interna\u0163ionale etc.);<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; -r\u0103m\u00e2n de asemenea \u00een vigoare tratatele \u00een cuprinsul c\u0103rora se impun norme imperative (jus cogens);<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; -tratatele de comer\u0163, de extr\u0103dare, tratatele multilaterale, cele cu caracter tehnic \u00ee\u015fi pot continua aplicarea dac\u0103 noul stat \u015fi celelalte p\u0103r\u0163i la tratat convin \u00een acest sens sau dac\u0103 din conduita lor rezult\u0103 c\u0103 doresc acest lucru;<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; -\u00een principiu, statul succesor va putea deveni membru al unei organiza\u0163ii interna\u0163ionale din care f\u0103cea parte un&nbsp; stat predecesor dac\u0103 se manifest\u0103 \u00een acest sens \u00een mod expres conform procedurilor prev\u0103zute de actul constitutiv al organiza\u0163iei pentru primirea de noi membri. \u00cen cadrul fostei U.R.S..S. Rusia a fost considerat\u0103 continuatoarea dec drept a fostei U.R.S.S.;<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; -tratatele politice ( de alian\u0163\u0103) care sunt legate de existen\u0163a politic\u0103 a statului anterior, precum \u015fi cele care prev\u0103d stabilirea de baze militare, \u00ee\u015fi \u00eenceteaz\u0103 aplicabilitatea odat\u0103 cu dispari\u0163ia statului care le-a \u00eencheiat, ele neput\u00e2nd fi opozabile statului succesor.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Cu privire la bunurile \u015fi crean\u0163ele statului anterior, legate de teritoriul acestuia, indiferent dac\u0103 se g\u0103sesc \u00een interiorul s\u0103u ori \u00een str\u0103in\u0103tate, regula este c\u0103 se transmit statului succesor toate bunurile&nbsp; mobile \u015fi imobile care au apar\u0163inut statului predecesor, \u00een principiu f\u0103r\u0103 desp\u0103gubiri \u015fi f\u0103r\u0103 un tratat special \u00een acest scop.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00cen ce prive\u015fte datoriile statului anterior fa\u0163\u0103 de state sau creditori str\u0103ini regulile sunt mai nuan\u0163ate, neexist\u00e2nd norme unanim acceptate.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00cen cazul \u00een care statul anterior a disp\u0103rut fiind \u00eencorporat \u00een noul stat, practica este diversificat\u0103.Uneori statele noi au preluat datoriile statelor anterioare (Belgia, \u00een 1907, dup\u0103 \u00eencorporarea statului Congo), alteori le-au refuzat (Anglia, \u00een 1901, dup\u0103 anexarea Transvaalului).Tratatele de pace din 1919 au impus statelor succesoare ale Imperiului Austro-Ungar plata datoriilor contractate de vechiul stat imperial.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Datoriile contractate de autorit\u0103\u0163ile locale sau de cele centrale, dar \u00een folosul&nbsp; exclusiv al teritoriului \u00een leg\u0103tur\u0103 cu care se pune problema succesiunii, trec, de principiu, asupra statului succesor.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif;
