Sunt \u00een general asimila\u0163i str\u0103inilor persoanele f\u0103r\u0103 cet\u0103\u0163enie \u015fi refugia\u0163ii. Regimul juridic al str\u0103inilor, care se refer\u0103 la condi\u0163iile de intrare, de \u015eedere \u015fi de ie\u015fire a acestora din \u0163ar\u0103 \u015fi la drepturile \u015fi obliga\u0163iile \u00een raport cu statul pe teritoriul c\u0103ruia se afl\u0103, se stabile\u015fte \u00een principiu de c\u0103tre fiecare stat prin legisla\u0163ia proprie \u015fi prin acte ale administra\u0163iei sau ale justi\u0163iei statului primitor. \u00cen acela\u015fi timp, o sum\u0103 de reguli privind regimul juridic al str\u0103inilor sunt stabilite pe baz\u0103 de reciprocitate de c\u0103tre state prin conven\u0163ii interna\u0163ionale, \u00een general cu caracter bilateral.Str\u0103inii nu pot avea, potrivit dreptului interna\u0163ional, un regim mai favorabil dec\u00e2t cet\u0103\u0163enii proprii ai unui stat, de\u015fi istoria dreptului interna\u0163ional a cunoscut \u015fi situa\u0163ii c\u00e2nd pentru str\u0103ini se instituia un statut privilegiat (regimul capitula\u0163iilor, de exemplu).<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00cen dreptul interna\u0163ional contemporan un stat are \u00een principiu datoria s\u0103 admit\u0103 intrarea oric\u0103rui str\u0103in pe teritoriul s\u0103u, dar poate refuza o asemenea intrare unor persoane sau unor categorii de persoane considerate ca indezirabile datorit\u0103 atitudinii lor fa\u0163\u0103 de statul respectiv ori pentru c\u0103 acestea constituie un pericol pentru ordinea constitu\u0163ional\u0103 sau ordinea public\u0103 (consumatori de stupefiante, bolnavi de boli mintale sau contagioase etc.). De asemenea, fiecare stat poate condi\u0163iona aceast\u0103 intrare de \u00eendeplinirea unor cerin\u0163e de c\u0103tre str\u0103inul \u00een cauz\u0103 \u015fi poate supune o asemenea intrare unor proceduri de \u00eendeplinit. \u00cen general , intrarea str\u0103inilor pe teritoriul unei \u0163\u0103ri necesit\u0103 o autorizare prealabil\u0103 sau o viz\u0103 special\u0103, aplicat\u0103 de organelor abilitate ale statului pe pa\u015faportul persoanei respective.<a href=\"https:\/\/www.blogger.com\/blogger.g?blogID=4202955034125599721\" name=\"more\" style=\"color: #ee5307; outline: none; text-decoration-line: none;\"><\/a><\/span><\/div>\n<p><\/p>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Orice stat este \u00een drept ca, pentru motive temeinice, s\u0103 expulzeze&nbsp; un str\u0103in de pe teritoriul s\u0103u, iar \u00een cazul \u00een care acesta s\u0103v\u00e2r\u015fe\u015fte o infrac\u0163iune , s\u00e2-l extr\u0103deze.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00cen ce prive\u015fte drepturile \u015fi obliga\u0163iile pe care le poate avea un str\u0103in pe teritoriul altui stat nu exist\u0103 pe plan interna\u0163ional norme unitare, de aplicabilitate general\u0103.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Practica este unitar\u0103 \u00een sensul c\u0103 str\u0103inii nu se pot bucura de drepturile politice, deci nu pot fi ale\u015fi \u00een organele de stat eligibile \u015fi nu au drept de vot, nu pot fi numi\u0163i \u00een func\u0163ii publice, civile sau militare \u015fi nu sunt supu\u015fi obliga\u0163iei de efectuare a serviciului militar \u015fi c\u0103 ace\u015ftia trebuie s\u0103 se bucure de drepturile civile necesare. Statele \u00ee\u015fi pot rezerva, ins\u0103, dreptul de a restr\u00e2nge aplicarea fa\u0163\u0103 de str\u0103ini a unor drepturi civile prev\u0103zute de legisla\u0163ia lor intern\u0103, \u00een scopul protej\u0103rii propriilor cet\u0103\u0163eni , iar pentru motive de securitate pot lua \u00een ce-i prive\u015fte pe str\u0103ini unele m\u0103suri restrictive, cum sunt: \u00eenregistrarea la organele de poli\u0163ie, prezentarea periodic\u0103 la control, obliga\u0163ia ob\u0163inerii unei aprob\u0103ri pentru deplasarea \u00een teritoriu etc.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Str\u0103inii au obliga\u0163ia ca pe teritoriul statului \u00een care se afl\u0103 s\u0103 respecte legile \u015fi celelalte reglement\u0103ri, s\u0103 fie loiali \u015fi s\u0103 nu \u00eenterprind\u0103 nici o ac\u0163iune \u00eempotriva statului respectiv.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Practica interna\u0163ional\u0103 cunoa\u015fte urm\u0103toarele regimuri juridice ale str\u0103inilor:<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; a)Regimul na\u0163ional. Statele care au adoptat acest sistem de tratament recunosc str\u0103inilor pe teritoriul lor acelea\u015fi drepturi pe care le acord\u0103 propriilor cet\u0103\u0163eni \u00een domeniul social, economic, cultural sau \u00een cel al drepturilor civile, except\u00e2ndu-i de la beneficiul drepturilor politice \u015fi de la dreptul de a ocupa func\u0163ii publice;<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; c)Regimul standardelor interna\u0163ionale,care presupune ca str\u0103inii s\u0103 se bucure cel pu\u0163in de tratamentul minim ce se acord\u0103 pe plan interna\u0163ional unor asemenea persoane.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00cen prezent, legisla\u0163ia din majoritatea statelor lumii cuprinde un regim mixt de acordare a drepturilor str\u0103inilor, cu elemente din toate regimurile prezentate.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00cen Rom\u00e2nia regimul str\u0103inilor este stabilit prin Legea nr.25\/1969,dar se afl\u0103 \u00een curs de adoptare o nou\u0103 lege.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &nbsp;Potrivit dreptului interna\u0163ional dreptul de azil define\u015fte dreptul unui stat suveran de a aproba&nbsp; intrarea \u015fi stabilirea pe teritoriul s\u0103u a unor str\u0103ini supu\u015fi persecu\u0163iilor sau urm\u0103ri\u0163i \u00een \u0163ara lor pentru activit\u0103\u0163i politice ori pentru concep\u0163iiile lor care nu sunt \u00een concordan\u0163\u0103 cu regimul politic \u015fi juridic intern al statului de origine.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; O declara\u0163ie a Adun\u0103rii generate a O.N.U din 1967 referitore la dreptul de azil prevedea c\u0103orice persoan\u0103 supus\u0103 persecu\u0163iei \u00een \u0163ara sa are dreptul s\u0103 cear\u0103 \u015fi s\u0103 se bucure de azil \u00een alte \u0163\u0103ri, cu excep\u0163ia persoanelor urm\u0103rite pentru infrac\u0163iuni de drept comun sau pentru ac\u0163iuni contrare scopurilor \u015fi principiilor O.N.U.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Acordarea azilului implic\u0103 pentru statul primitor dreptul de a refuza extr\u0103darea persoanei \u00een cauz\u0103.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Majoritatea statelor nu recunosc azilul diplomatic, consider\u00e2nd c\u0103 acesta aduce atingere suveranit\u0103\u0163ii lor, dar, \u00een practic\u0103 , mai ales \u00een ultimii ani, datorit\u0103 tulbur\u0103rilor interne din unele state&nbsp; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; M\u0103sura se ia \u00een scopul ocrotirii ordinii juridice a statului, pentru ra\u0163iuni de securitate sau ap\u0103rare a ordinii publice, ori pentru ra\u0163iuni politice, economice sau de alt\u0103 natur\u0103.Statul care ia m\u0103sura expulz\u0103rii nu este obligat s\u0103 dea statului c\u0103ruia-i apar\u0163in str\u0103ini explica\u0163ii asupra motivelor care au determinat un asemenea act, dar o poate face din ra\u0163iuni de curtoazie.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Expulzarea nu este o sanc\u0163iune penal\u0103, ci o m\u0103sur\u0103 de siguran\u0163\u0103 cu caracter administrativ \u00eempotriva unor persoane care au devenit indezirabile \u00een statul respectiv.De regul\u0103 o asemenea m\u0103sur\u0103 se dispune de instan\u0163ele judiciare \u015fi se execut\u0103 de organele ordinii publice.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00cen principiu cet\u0103\u0163enii proprii nu pot fi expulza\u0163i, dar unele state au luat \u015fi asemenea m\u0103suri, \u00een special cu privire la membrii unor familii regale.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Expulzarea diploma\u0163ilor \u015fi consulilor este condi\u0163ionat\u0103 de declararea lor persoana non grata \u015fi de refuzul acestora de a p\u0103r\u0103si teritoriul statului de re\u015fedin\u0163\u0103.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><span style=\"font-family: &quot;Times New Roman&quot;, serif; font-size: 12pt; line-height: 24px;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00cen ce prive\u015fte condi\u0163iile \u00een care se poate face expulzarea exist\u0103 anumite limite.Astfel, dac\u0103 ra\u0163iuni imperioase de securitate nu se opun, celui expulzat trebuie s\u0103 i se ofere posibilitatea de a prezenta motivele care pledeaz\u0103 \u00eempotriva expulz\u0103rii sale \u015fi de a ob\u0163ine o reexaminare a cazului s\u0103u de c\u0103tre o autioritate competent\u0103, conditiile expulz\u0103rii s\u0103 nu fie excesiv de drastice \u015fi s\u0103 se respecte \u00een procesul expulz\u0103rii drepturile elementare ale persoanei, cel expulzat s\u0103 nu fie trimis \u00eentr-o \u0163ar\u0103 sau un teritoriu \u00een care existan\u0163a sau libertatea sa ar fi amenin\u0163ate din diverse motive etc.<\/span><\/div>\n<div style=\"line-height: 19.5px;
