p\u00e2n\u0103 la v\u0103rsarea lor \u00een mare.<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Fiecare stat este suveran&nbsp; asupra por\u0163iunii din aceste fluvii care \u00eel traverseaz\u0103 sau asupra p\u0103r\u0163ii din fluviu care \u00eei revine c\u00e2nd acesta desparte dou\u0103 state.<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Regimul interna\u0163ional al acestor fluvii se refer\u0103 numai la naviga\u0163ie, \u00een privin\u0163a c\u0103reia se aplic\u0103, potrivit conven\u0163iilor interna\u0163ionale, principiul libert\u0103\u0163ii de naviga\u0163ie.<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Prima afirmare a principiului libert\u0103\u0163ii de naviga\u0163ie s-a f\u0103cut printr-un tratat din 1177 \u00eencheiat \u00eentre mai multe state \u2013ora\u015fe italiene cu privire la r\u00e2ul Pad (Po).Tratatul de la Osnabruck din 1648 dintre Suedia, Fran\u0163a \u015fi Imperiul German prevedea pentru statele semnatare libertatea de naviga\u0163ie pe mai multe fluvii, iar Revolu\u0163ia francez\u0103 afirma \u00een 1792 principiul libert\u0103\u0163ii de naviga\u0163ie pe fluviile interna\u0163ionale.<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Prin Tratatul de pace de la Paris din 1814 se stabilea libertatea de naviga\u0163ie pe Rin, iar Congresul de la Viena (1815) stabilea regimul interna\u0163ional al Dun\u0103rii \u015fi extindea acest principiu \u015fi la alte fluvii europene, recomand\u00e2nd \u00eencheierea de conven\u0163ii speciale pentru fiecare fluviu, ceea ce s-a \u015fi realizat ulterior pentru Oder, Niemen, Elba \u015fi Escaut.<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Conferin\u0163a de la Berlin din 1885 a stabilit libertatea de naviga\u0163ie pe fluviile africane Congo \u015fi Niger, iar prin tratate \u015fi acte interne ale statelor riverane s-a declarat libertatea de naviga\u0163ie pe fluviul Amazon din America de Sud.<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Tratatul de la Versailles a reafirmat regimul de fluvii interna\u0163ionale pentru Elba, Oder, Niemen \u015fi Dun\u0103re.<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Din actul final al congresului de la Viena \u015fi din conventiile privind fluviile men\u0163ionate rezult\u0103 unele principii privind naviga\u0163ia pe fluviile interna\u0163ionale:<\/div>\n<p><a href=\"https:\/\/www.blogger.com\/blogger.g?blogID=4202955034125599721\" name=\"more\" style=\"color: #ee5307; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; -statele riverane au obliga\u0163ia de a men\u0163ine fluviile \u00een stare de naviga\u0163ie, iar pentru lucr\u0103rile de \u00eentre\u0163inere \u015fi amenajare pe care le execut\u0103 au dreptul de a percepe taxe corespunz\u0103toare;<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; -pentru coordonarea activit\u0103\u0163ii lor \u00een vederea asigur\u0103rii naviga\u0163iei statelor riverane pot constitui comisii interna\u0163ionale.<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Conferin\u0163a de la Barcelona din 1921, convocat\u0103 de Societatea Na\u0163iunilor, a elaborat o conven\u0163ie, un statut \u015fi un protocol privind cursurile de ap\u0103 navigabile de interes interna\u0163ional, care reafirmau principiul libert\u0103\u0163ii \u015fi egalit\u0103\u0163ii de tratament \u00een naviga\u0163ia pe fluviile interna\u0163ionale, relu\u00e2nd regulile stabilite anterior. Acestea au fost ratificate&nbsp; de un num\u0103r relativ mic de state, astfel c\u0103 p\u00e2n\u0103 \u00een prezent nu exist\u0103 o reglementare general\u0103 \u015fi uniform\u0103 pentru toate fluviile interna\u0163ionale, ci doar unele principii generale \u015fi reglement\u0103ri punctuale pentru diferite cursuri de ap\u0103.<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<i>Regimul naviga\u0163iei pe Dun\u0103re<\/i><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Statutul juridic de fluviu interna\u0163ional al Dun\u0103rii a fost stabilit prin reglement\u0103ri interna\u0163ionale succesive.<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Dup\u0103 ce la Congresul de la Viena din 1815 Dun\u0103rea a fost recunoscut\u0103 ca fluviu interna\u0163ional, interesul pentru domina\u0163ia asupra acestuia din partea marilor puteri a crescut, marile puteri europene \u00eencerc\u00e2nd s\u0103-\u015fi impun\u0103 controlul \u00een dauna Imperiului Otoman, apoi a Rusiei, iar prin \u00eenfr\u00e2ngerea Rusiei \u00een r\u0103zboiul Crimeei puterile Europei occidentale \u015fi-au asigurat domina\u0163ia asupra gurilor Dun\u0103rii \u015fi implicit asupra \u00eentregului fluviu.<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Prin tratatul de la Paris din 1856 se stabilea pentru prima dat\u0103 un regim juridic general privind naviga\u0163ia pe Dun\u0103re. Tratatul prevedea libertatea de naviga\u0163ie at\u00e2t pentru statele riverane, c\u00e2t \u015fi pentru cele neriverane \u015fi \u00eemp\u0103r\u0163ea fluviul, din punctul de vedere al administra\u0163iei naviga\u0163iei, \u00een 2 sectoare: Dun\u0103rea fluvial\u0103 \u015fi Dun\u0103rea maritim\u0103.Pentru ultima por\u0163iune a fost creat\u0103 Comisia European\u0103 a Dun\u0103rii, format\u0103 din reprezentan\u0163ii marilor puteri (Anglia, Fran\u0163a, Prusia \u015fi Sardinia) \u015fi ai marilor imperii riverane (Austria, Rusia \u015fi Turcia).<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00cens\u0103rcinat\u0103 ini\u0163ial doar cu competen\u0163e tehnice privind cur\u0103\u0163area \u015fi amenajarea por\u0163iunii navigabile de la Gurile Dun\u0103rii, Comisia \u015fi-a extins ulterior nepermis de mult atribu\u0163iile, devenind un adev\u0103rat stat \u00een stat. Ea elabora regulamentele de naviga\u0163ie, asigura poli\u0163ia fluvial\u0103, inclusiv prin folosirea for\u0163elor armate ale statelor membre, exercit\u00e2nd un drept de jurisdic\u0163ie privind \u00eenc\u0103lcarea regulilor de naviga\u0163ie, stabilea \u015fi percepea taxele pentru naviga\u0163ie, avea pavilion propriu \u015fi se bucura de imunit\u0103\u0163i \u015fi privilegii de orice natur\u0103 (diplomatic\u0103, fiscal\u0103, vamal\u0103, etc.), aduc\u00e2nd prin aceasta grave prejudicii Rom\u00e2niei, pe teritoriul c\u0103reia \u00ee\u015fi exercita competen\u0163ele \u015fi unde \u00ee\u015fi avea sediul (la Gala\u0163i).<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Dup\u0103 primul r\u0103zboi mondial, \u00een 1921, se \u00eencheia o nou\u0103 Conven\u0163ie a Dun\u0103rii la Paris, care instituia un regim interna\u0163ional pe toat\u0103 por\u0163iunea navigabil\u0103 a fluviului, da la Ulm p\u00e2n\u0103 la v\u0103rsarea \u00een mare, precum \u015fi asupra principalilor afluen\u0163i ai Dun\u0103rii (Mure\u015ful, Tisa, Morava \u015fi Drava) \u015fi a canalelor.<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Se \u00eenfiin\u0163au dou\u0103 organe interna\u0163ionale pentru administrarea naviga\u0163iei pe Dun\u0103re: Comisia European\u0103 a Dun\u0103rii, format\u0103 din reprezentan\u0163ii Angliei, Fran\u0163ei \u015fi Rom\u00e2niei, pentru Dun\u0103rea maritim\u0103, de la v\u0103rsare p\u00e2n\u0103 la Br\u0103ila, c\u0103reia i s-au conferit toate drepturile \u015fi privilegiile pe care le avusese \u015fi \u00eenainte de r\u0103zboi, \u015fi Comisia Interna\u0163ional\u0103 a Dun\u0103rii, pentru por\u0163iunea de la Br\u0103ila la Ulm, din care f\u0103ceau parte cele trei mari puteri \u015fi toate \u0163\u0103rile riverane.<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00centre cele dou\u0103 r\u0103zboaie mondiale Rom\u00e2nia a dus o lupt\u0103 continu\u0103 pentru suprimarea privilegiilor Comisiei Europene a Dun\u0103rii \u015fi pentru afirmarea propriei suveranit\u0103\u0163i \u00een ce prive\u015fte puterea de decizie \u00een probleme de reglementare a naviga\u0163iei, stabilirea \u015fi \u00eencasarea taxelor, exercitarea propriei jurisdic\u0163ii \u015fi ap\u0103rarea intereselor sale na\u0163ionale, ob\u0163in\u00e2nd unele midific\u0103ri ale statutului interna\u0163ional \u00een favoarea sa. Prin Conven\u0163ia de la Sinaia din 1938 o mare parte a atribu\u0163iilor Comisiei Europene a Dun\u0103rii au trecut asupra Rom\u00e2niei.<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Regimul actual al naviga\u0163iei pe Dun\u0103re este cel stabilit prin Conven\u0163ia de la Belgrad din 1948, \u00eencheiat\u0103 numai \u00eentre statele riverane.
