Carta Tribunalului de la Tokio d\u0103dea crimelor contra p\u0103cii o defini\u0163ie asem\u0103n\u0103toare.<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00cen cuprinsul sentin\u0163ei prin care a condamnat pentru crime contra p\u0103cii pe reprezentan\u0163ii statului german vinova\u0163i de dezl\u0103n\u0163uirea \u015fi purtarea unui r\u0103zboi de agresiune, Tribunalul de la N\u00fcrenberg statua c\u0103 declan\u015farea r\u0103zboiului de agresiune nu este o crim\u0103 interna\u0163ional\u0103 pur \u015fi simplu, ci crim\u0103 interna\u0163ional\u0103 suprem\u0103, care difer\u0103 de celelalte crime legate de r\u0103zboi prin faptul c\u0103 le con\u0163ine pe toate.<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Incriminarea r\u0103zboiului de agresiune a fost ulterior \u00eensu\u015fit\u0103 \u015fi de Adunarea General\u0103 a O.N.U., o dat\u0103 cu confirmarea principiilor de drept interna\u0163ional recunoscute de statutul \u015fi hot\u0103r\u00e2rea Tribunalului de la N\u00fcrenberg, prin Rezolu\u0163ia nr. 95 (I) din 1947.<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Se poate astfel afirma c\u0103, \u00een baza instrumentelor politice \u015fi juridice men\u0163ionate \u015fi a practicii celor dou\u0103 tribunale militare interna\u0163ionale, de la N\u00fcrenberg \u015fi Tokio, \u00eensu\u015fit\u0103 de cvasitotalitatea statelor lumii, ca \u015fi \u00een lumina principiilor fundamentale ale dreptului interna\u0163ional contemporan, crimele contra p\u0103cii constituie cele mai grave crime interna\u0163ionale.<\/div>\n<p><a href=\"https:\/\/www.blogger.com\/blogger.g?blogID=4202955034125599721\" name=\"more\" style=\"color: #ee5307; outline: none; text-decoration-line: none;\"><\/a><\/p>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Crimele contra p\u0103cii sunt agresiunea armat\u0103 \u015fi propaganda \u00een favoarea r\u0103zboiului.<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 2.&nbsp;<i>Agresiunea armat\u0103<\/i><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Definirea agresiunii armate \u00eentr-o form\u0103 care s\u0103 cuprind\u0103 toate actele agresive s\u0103v\u00e2r\u015fite de c\u0103tre state a constituit \u015fi constituie \u00eenc\u0103 un obiect de preocupare pentru comunitatea interna\u0163ional\u0103, \u00een condi\u0163iile \u00een care de\u015fi Carta O.N.U. interzice \u00een mod expres r\u0103zboiul de agresiune, aceasta nu cuprinde \u015fi o defini\u0163ie a agresiunii, iar defini\u0163ia agresorului cuprins\u0103 \u00een Conven\u0163iile de la Londra din 1933 a fost considerat\u0103 ca nefiind \u00eentru totul satisf\u0103c\u0103toare.<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Dup\u0103 eforturi intense&nbsp; care au \u00eenceput cu anul 1953, c\u00e2nd Adunarea General\u0103 a O.N.U. a \u00eenfiin\u0163at un Comitet special pentru definirea agresiunii, la 14 decembrie 1974, s-a ajuns la un acord asupra textului final al defini\u0163iei, care a fost adoptat de Adunarea General\u0103 prin Rezolu\u0163ia nr. 3314 (XXIX), deci nu printr-un tratat multilateral general, cu for\u0163a juridic\u0103 a unui asemenea instrument conven\u0163ional.<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Defini\u0163ia agresiunii, astfel cum a fost adoptat\u0103, constituie o formul\u0103 de compromis.<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Art. 2 al defini\u0163iei prevede c\u0103 \u201e Folosirea for\u0163ei armate prin violarea Cartei O.N.U., de c\u00e2te un stat care a ac\u0163ionat primul, constituie dovada suficient\u0103&nbsp;<i>prima facie<\/i>&nbsp;a unui act de agresiune\u201d.<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Deci, faptul de a ac\u0163iona primul \u00een modul ar\u0103tat constituie o prim\u0103 dovad\u0103, dar nu \u015fi suficient\u0103, pentru a se aprecia c\u0103 s-a comis un act de agresiune. Preambulul&nbsp; defini\u0163iei men\u0163ioneaz\u0103 c\u0103 problema de a stabili dac\u0103 s-a comis sau nu un act de agresiune trebuie s\u0103 fie examinat\u0103 \u00een lumina tuturor \u00eemprejur\u0103rilor proprii fiec\u0103rui&nbsp; caz \u00een parte, iar potrivit art. 2 al acesteia Consiliul de Securitate al O.N.U. poate, \u00een conformitate cu Carta, s\u0103 conchid\u0103 c\u0103 o apreciere \u00een sensul c\u0103 un act de agresiune a fost comis nu ar fi justificat\u0103 \u00een lumina altor \u00eemprejur\u0103ri relevante, inclusiv faptul c\u0103 actele \u00een cauz\u0103 sau consecin\u0163ele lor nu sunt de a agresivitate suficient\u0103.<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Defini\u0163ia cuprinde \u015fi men\u0163iunea \u201eNici un considerent, de orice natur\u0103 ar fi el, politic\u0103, economic\u0103, militar\u0103 sau de alt fel, nu poate s\u0103 justifice o agresiune\u201d (art.5 alin. 1).<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; De asemenea, actul privind defini\u0163ia agresiunii&nbsp; prevede \u00een mod expres c\u0103 r\u0103zboiul de agresiune constituie o crim\u0103 \u00eempotriva p\u0103cii, care d\u0103 na\u015ftere la r\u0103spundere interna\u0163ional\u0103 .<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00cen cuprinsul documentului menionat, prin care se adopt\u0103 defini\u0163ia agresiunii, sunt enumerate ca acte de agresiune urm\u0103toarele acte s\u0103v\u00e2r\u015fite cu sau f\u0103r\u0103 declara\u0163ie de r\u0103zboi:<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; a) Invadarea sau atacarea teritoriului unui stat de c\u0103tre for\u0163ele armate ale altui stat sau orice ocupa\u0163ie militar\u0103, chiar temporar\u0103, rezult\u00e2nd dintr-o asemenea invazie sau dintr-un asemenea atac, precum \u015fi orice anexare prin folosirea for\u0163ei a teritoriului sau a unei p\u0103r\u0163i a teritoriului altui stat;<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; b) Bombardarea de c\u0103tre for\u0163ele armate ale unui stat a teritoriului altui stat sau folosirea oric\u0103ror arme de c\u0103tre un stat \u00eempotriva teritoriului altui stat;<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; c) Blocada porturilor sau a coastelor unui stat de c\u0103tre for\u0163ele armate ale altui stat;<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; d) Atacul efectuat de c\u0103tre for\u0163ele armate ale unui stat \u00eempotriva for\u0163elor armate terestre, maritime sau aeriene, ori a marinei \u015fi avia\u0163iei civile a altui stat;<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; e) Folosirea for\u0163elor armate ale unui stat, acre sunt sta\u0163ionate pe teritoriul altui stat cu acordul statului&nbsp; gazd\u0103, contrar condi\u0163iilor stabilite \u00een acord, sau orice extindere a prezen\u0163ei lor pe teritoriul \u00een cauz\u0103, dup\u0103 expirarea acordului;<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; f) Fapta unui stat de a admite ca teritoriul s\u0103u, pe care l-a pus la dispozi\u0163ia altui stat, s\u0103 fie utilizat de c\u0103tre acesta din urm\u0103 pentru comiterea unui act de agresiune \u00eempotriva unui stat ter\u0163;<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; g) Trimiterea de c\u0103tre un stat sau \u00een numele lui de bande ori grupuri \u00eenarmate, de for\u0163e neregulate sau de mercenari, care se dedau la acte de for\u0163a armat\u0103 \u00eempotriva unui alt stat, de o gravitate care echivaleaz\u0103 cu cea a actelor enumerate mai sus, sau faptul de a se angaja \u00een mod substan\u0163ial \u00eentr-o asemenea ac\u0163iune.<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Art. 4 al defini\u0163iei cuprinde men\u0163iunea c\u0103 enumerarea actelor de agresiune nu este limitativ\u0103, Consiliul de Securitate al O.N.U. put\u00e2nd califica \u015fi alte atacuri armate ca acte de agresiune, potrivit competen\u0163elor sale conferite de Cart\u0103 \u00een men\u0163inerea p\u0103cii \u015fi securit\u0103\u0163ii interna\u0163ionale.<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00cen lumina principiilor de drept interna\u0163ional se apreciaz\u0103 c\u0103 pot fi considerate ca acte de agresiune, deci crime interna\u0163ionale, de\u015fi nu sunt cuprinse \u00een defini\u0163ia dat\u0103, \u015fi urm\u0103toarele:<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; -declara\u0163ia de r\u0103zboi;<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; -represaliile cu folosirea for\u0163ei armate \u00eempotriva popoarelor \u015fi na\u0163iunilor care lupt\u0103 pentru dreptul lor la autodeterminare, la libertate \u015fi independen\u0163\u0103.<\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 3.&nbsp;<i>Propaganda \u00een favoarea r\u0103zboiului<\/i><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\"><\/div>\n<div style=\"line-height: 19.5px; text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Propaganda prin care se face apologia r\u0103zboiului sau se \u00eendeamn\u0103 la recurgerea la r\u0103zboi, indiferent prin ce mijloace s-ar face aceasta, constituie \u015fi ea o crim\u0103 \u00eempotriva p\u0103cii \u015fi securit\u0103\u0163ii interna\u0163ionale.
