OBIECTUL CONTRACTULUI<\/span><\/b><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">2.1. Intretinutul declara ca transmite intretinatorului dreptul de proprietate asupra apartamentului nr. &#8230;&#8230;&#8230; din blocul &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;., scara &#8230;&#8230;&#8230;, etajul &#8230;&#8230;., situat in str. &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;. nr. &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;., apartament compus din &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230; camere de locuit si dependinte, impreuna cu dreptul de proprietate asupra partilor si dependintelor comune ale blocului, care, prin natura si destinatia lor, sunt in folosinta comuna a tuturor proprietarilor.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">2.2. Impreuna cu apartamentul se transmite si dreptul de folosinta asupra terenului aferent acestuia, in suprafata de &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.. mp, respectiv cota indiviza de &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.. % atribuita pe durata existentei constructiei.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">2.3. Intretinutul, creditor al obligatiei de intretinere, isi rezerva dreptul de habitatie viagera asupra unei camere in suprafata de &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230; mp cu acces la dependintele din apartamentul descris mai sus.<\/span><\/div>\n<div><b><span lang=\"RO\" style=\"font-family: Arial;\">III. OBLIGATIILE PARTILOR<\/span><\/b><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">3.1. Intretinutul declara ca:<\/span><\/div>\n<div style=\"margin-left: 53.85pt; text-indent: -17.85pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>a)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">a dobandit apartamentul in baza contractului de &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230; si a procesului-verbal de predare-primire nr. &#8230;&#8230;&#8230;&#8230;&#8230;.\/&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;\/&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;. din data de &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.., acte incheiate cu &#8230;&#8230;&#8230;&#8230;. transcrise sub nr. &#8230;&#8230;&#8230;&#8230;&#8230;\/&#8230;&#8230;&#8230;&#8230;&#8230;&#8230; de &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;;<\/span><\/div>\n<div style=\"margin-left: 53.85pt; text-indent: -17.85pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>b)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">declara pe proprie raspundere ca apartamentul mai sus mentionat este in intregime in proprietatea sa, nefiind instrainat sub nici o forma altei persoane, pana la data incheierii prezentului contract;<\/span><\/div>\n<div style=\"margin-left: 53.85pt; text-indent: -17.85pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>c)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">este de acord cu dreptul de habitatie viagera asupra camerei in suprafata de &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.. mp, cu acces la dependintele din apartamentul descris mai sus.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">3.2. Intretinatorul se obliga:<\/span><\/div>\n<div style=\"margin-left: 53.85pt; text-indent: -17.85pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>a)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">sa asigure intretinutului in schimbul apartamentului primit, un trai decent prin: prepararea hranei, procurarea de obiecte de imbracaminte si incaltaminte, medicamente, asigurarea asistentei medicale, efectuarea curateniei in locuinta etc.;<\/span><\/div>\n<div style=\"margin-left: 53.85pt; text-indent: -17.85pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>b)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">sa suporte toate cheltuielile necesare la decesul intretinutului pentru inhumarea dupa datinele crestinesti.<\/span><\/div>\n<div><b><span lang=\"RO\" style=\"font-family: Arial;\">IV. RASPUNDEREA PENTRU EVICTIUNE ASUPRA BUNULUI MOBIL<\/span><\/b><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">4.1. Creditorul declara sub sanctiunea art. 1337 Cod civil urmatoarele date despre apartament:<\/span><\/div>\n<div style=\"margin-left: 53.85pt; text-indent: -17.85pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>a)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">nu este grevat de sarcini;<\/span><\/div>\n<div style=\"margin-left: 53.85pt; text-indent: -17.85pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>b)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">nu a fost scos din circuitul civil prin trecere in proprietate publica;<\/span><\/div>\n<div style=\"margin-left: 53.85pt; text-indent: -17.85pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>c)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">este in proprietatea sa din &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230; si pana in prezent, in mod legal si continuu;<\/span><\/div>\n<div style=\"margin-left: 53.85pt; text-indent: -17.85pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>d)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span\n\n><\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">garanteaza pe debitorul obligatiei de intretinere impotriva oricaror evictiuni.<\/span><\/div>\n<div><b><span lang=\"RO\" style=\"font-family: Arial;\">V. DURATA CONTRACTULUI<\/span><\/b><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">5.1. Partile sunt de acord cu prevederile prezentului contract si dobanditorul se obliga sa-i presteze intretinerea si cele necesare traiului, pe tot timpul vietii creditorului, fiind de acord cu dreptul de habitatie viagera rezervat de acesta asupra camerei in suprafata de &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.. mp, cu acces la dependintele apartamentului.<\/span><\/div>\n<div><b><span lang=\"RO\" style=\"font-family: Arial;\">VI. PRETUL CONTRACTULUI<\/span><\/b><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">6.1. Pretul acestei instrainari il constituie intretinerea acordata de debitor pentru creditor pe tot restul vietii, precum si cheltuielile de inmormantare dupa moartea acestuia.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">6.2. Intretinerea se va acorda in natura si in bani astfel:<\/span><\/div>\n<div style=\"margin-left: 53.85pt; text-indent: -17.85pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>a)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">in natura, prin asigurarea hranei zilnice, a combustibilului necesar incalzirii locuintei, procurarea de obiecte de imbracaminte si incaltaminte, medicamente, asigurarea asistentei medicale, efectuarea curateniei in locuinta etc.;<\/span><\/div>\n<div style=\"margin-left: 53.85pt; text-indent: -17.85pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>b)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">in bani, prin plata unei sume lunare care reprezinta &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230; din pensia minima pe care o primeste &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;., al carei cuantum se va majora in raport cu majorarile pe care le va suferi pensia la care ne raportam.<\/span><\/div>\n<div><b><span lang=\"RO\" style=\"font-family: Arial;\">VII. CLAUZE FINALE<\/span><\/b><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">7.1. Taxele si impozitele catre stat, aferente apartamentului ce face obiectul prezentului contract de intretinere, sunt achitate la zi de creditor, astfel cum rezulta din certificatul nr. &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.. din &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.. eliberat de &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;., urmand ca de astazi, data autentificarii prezentului contract, sa treaca in sarcina dobanditorului, care suporta taxa de timbru judiciar si onorariul notarului public.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">7.2. Partile au evaluat obligatia de intretinere la suma de &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.. lei pe luna, exclusiv pentru stabilirea taxei de timbru.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">7.3.
