OBIECTUL CONTRACTULUI<\/span><\/b><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">2.1. Intretinutul transmite intretinatorului nuda proprietate asupra apartamentului nr. &#8230;&#8230;&#8230;&#8230;&#8230;.., situat in str. &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;. nr. &#8230;&#8230;&#8230;&#8230;, blocul &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;, scara &#8230;&#8230;&#8230;&#8230;&#8230;, etajul &#8230;&#8230;&#8230;&#8230;, din &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;., compus in intregime din &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230; camere de locuit si dependinte, impreuna cu dreptul de coproprietate in cota indiviza de &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;..%, asupra partilor si dependintelor comune ale imobilului, care prin natura si destinatia lor sunt in folosinta tuturor proprietarilor.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">2.2. Intretinutul transmite intretinatorului si dreptul de folosinta asupra terenului aferent acestuia, in suprafata de &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;. mp, adica cota indiviza de &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230; %, atribuit pe durata existentei constructiei.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">2.3. Intretinutul isi rezerva dreptul de uzufruct viager asupra apartamentului mai sus mentionat.<\/span><\/div>\n<div><b><span lang=\"RO\" style=\"font-family: Arial;\">III. OBLIGATIILE PARTILOR<\/span><\/b><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">3.1. Intretinutul declara ca:<\/span><\/div>\n<div style=\"margin-left: 53.85pt; text-indent: -17.85pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>a)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">apartamentul mai sus mentionat este in intregime proprietatea sa, conform contractului &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;\/certificatului de mostenitor &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;. nr. &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230; din &#8230;&#8230;&#8230;&#8230;&#8230;., nefiind instrainat sub nici o forma vreunei alte persoane, pana la data incheierii acestui contract;<\/span><\/div>\n<div style=\"margin-left: 53.85pt; text-indent: -17.85pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>b)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">apartamentul nu a fost scos din circuitul civil prin trecere in proprietate publica;<\/span><\/div>\n<div style=\"margin-left: 53.85pt; text-indent: -17.85pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>c)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">apartamentul nu face obiectul vreunui litigiu, nu este sechestrat si nici nu este grevat de sarcini, fiind in mod legal si continuu in proprietatea si posesia sa de la data dobandirii si pana in prezent.<\/span><\/div>\n<div><span lang=\"RO\" style=\"font-family: Arial;\">3.2. Intretinatorul:<\/span><\/div>\n<div style=\"margin-left: 53.55pt; text-indent: -17.85pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>a)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">isi asuma obligatia de intretinere a intretinutului pe tot timpul vietii, obligatie ce consta din: &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;. &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;. <\/span><\/div>\n<div style=\"margin-left: 53.55pt; text-indent: -17.85pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>b)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">declara ca a primit nuda proprietate de la intretinut asupra apartamentului descris mai sus si este de acord cu prevederile prezentului contract;<\/span><\/div>\n<div style=\"margin-left: 53.55pt; text-indent: -17.85pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>c)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">se obliga sa presteze pentru intretinut intretinere si cele necesare traiului, la domiciliul sau, pe tot timpul vietii sale, iar in caz de neexecutare a acestei obligatii este constient de aplicarea dispozitiilor articolului 1020\u20131021 Cod civil.<\/span><\/div>\n<div><b><span lang=\"RO\" style=\"font-family: Arial;\">IV. PRETUL CONTRACTULUI<\/span><\/b><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">4.1. Pretul contractului il constituie intretinerea acordata de intretinator pentru intretinut pe tot restul vietii, dupa care va suporta cheltuielile de inmormantare, potrivit obiceiului locului.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">4.2. Intretinerea se va acorda in natura prin: asigurarea hranei zilnice, a combustibilului necesar incalzirii locuintei in sezonul rece, obiecte necesare, imbracaminte, incaltaminte, la domiciliul intretinutului &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230; .<\/span><\/div>\n<div><b><span lang=\"RO\" style=\"font-family: Arial;\">V. CLAUZE FINALE<\/span><\/b><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">5.1. Transmiterea nudei proprietati asupra apartamentului se face de astazi, data autentificarii prezentului contract, fara indeplinirea altei formalitati, doba<\/p>\n<p>nditorul intrand in posesia si folosinta apartamentului la data decesului intretinutului.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">5.2. Impozitele si taxele catre stat, aferente apartamentului, ce face obiectul prezentului contract de intretinere, sunt achitate la zi de catre intretinut, astfel cum rezulta din certificatul fiscal nr. &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.\/&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;, eliberat de Administratia financiara &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;, urmand ca de astazi, data autentificarii, sa treaca in sarcina dobanditorului obligatiei de intretinere.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">5.3. Partile au evaluat obligatia de intretinere la suma de &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.. lei pe luna, numai in scopul stabilirii taxei de timbru.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">5.4.
