OBIECTUL CONTRACTULUI<\/span><\/b><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">2.1. Obiectul contractului il reprezinta garantarea imprumutului in valoare de &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230; lei cu o dobanda de &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;. % pe an, obtinut de debitorul ipotecar de la creditorul ipotecar conform contractului de imprumut nr. &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;. incheiat la data de &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.. .<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">2.2. a)<span>&nbsp;&nbsp; <\/span>Imobilul ipotecat prin care se garanteaza imprumutul este situat in &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;, <span>&nbsp;&nbsp;&nbsp; <\/span>str. &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230; nr. &#8230;&#8230;&#8230;&#8230;., sectorul\/judetul &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.. si se <span>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span>compune din &#8230;&#8230;&#8230;&#8230;. camere plus dependinte, fiind in suprafata totala de &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.. mp.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span>b)<span>&nbsp; <\/span>Acest apartament se afla in circuitul civil si a intrat in proprietatea debitorului ipotecar prin <span>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span>contractul de vanzare-cumparare nr. &#8230;&#8230;&#8230;&#8230;&#8230;&#8230; din &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;. transcris in Cartea <span>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span>funciara nr. &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.., fiind liber de orice sarcini asa cum rezulta din Certificatul <span>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span>nr. &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230; din &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230; anexat la prezentul contract.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">2.3. a)<span>&nbsp;&nbsp; <\/span>Debitorul ipotecar se obliga sa nu instraineze imobilul a carui ipoteca constituie obiectul <span>&nbsp; <\/span>prezentului contract pana la rambursarea imprumutului si a dobanzilor aferente la scadenta.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span>b)<span>&nbsp; <\/span>Totodata, debitorul ipotecar se obliga sa transcrie ipoteca in Cartea funciara nr. &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.., <span>&nbsp;&nbsp;&nbsp; <\/span>iar in baza ei, creditorul ipotecar poate trece la executarea silita, in cazul in care debitorul <span>&nbsp;&nbsp; <\/span>ipotecar nu-si lichideaza datoria la scadenta.<\/span><\/div>\n<div><b><span lang=\"RO\" style=\"font-family: Arial;\">III. LITIGII<\/span><\/b><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">3.1. Partile au convenit ca toate neintelegerile privind validitatea prezentului contract sau rezultate din interpretarea, executarea ori incetarea acestuia sa fie rezolvate pe cale amiabila de reprezentantii lor.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">3.2. In cazul in care nu este posibila rezolvarea litigiilor pe cale amiabila, partile se vor adresa instantelor judecatoresti competente.<\/span><\/div>\n<div><b><span lang=\"RO\" style=\"font-family: Arial;\">IV. CLAUZE FINALE<\/span><\/b><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">4.1. Modificarea prezentului contract se face numai prin act aditional incheiat intre partile contractante.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">4.2. Prezentul contract, impreuna cu anexele sale care fac parte integranta din cuprinsul sau, reprezinta vointa partilor si inlatura orice alta intelegere verbala dintre acestea, anterioara sau ulterioara incheierii lui.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">4.3. In cazul in care partile isi incalca obligatiile lor, neexercitarea de partea care sufera vreun prejudiciu a dreptului de a cere executarea intocmai sau prin echivalent banesc a obligatiei respective nu inseamna ca ea a renuntat la acest drept al sau.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">4.4.
