Bunurile ce constituie prezentul contract sunt<sup>1)<\/sup> &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;. &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;. .<\/span><\/div>\n<div><b><span lang=\"RO\" style=\"font-family: Arial;\">III. OBLIGATIILE PARTILOR<\/span><\/b><\/div>\n<div><span lang=\"RO\" style=\"font-family: Arial;\">3.1. Obligatiile locatorului sunt urmatoarele:<\/span><\/div>\n<div style=\"margin-left: 54pt; text-indent: -18pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>a)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">sa predea bunul in locatiune la termenul convenit de parti si la locul unde se gasea in momentul contractarii;<\/span><\/div>\n<div style=\"margin-left: 54pt; text-indent: -18pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>b)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">sa efectueze reparatiile necesare in tot timpul locatiunii;<\/span><\/div>\n<div style=\"margin-left: 54pt; text-indent: -18pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>c)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">sa se abtina de la orice fapt personal, care ar avea drept consecinta tulburarea locatarului in folosinta bunului;<\/span><\/div>\n<div style=\"margin-left: 54pt; text-indent: -18pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>d)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">sa raspunda pentru evictiune si viciile ascunse ale bunului care ii impiedica intrebuintarea;<sup> 2)<\/sup><\/span><\/div>\n<div><span lang=\"RO\" style=\"font-family: Arial;\">3.2. Obligatiile locatarului sunt urmatoarele:<\/span><\/div>\n<div style=\"margin-left: 54pt; text-indent: -18pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>a)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">sa plateasca chiria de &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.. lei\/luna\/an in conditiile stabilite;<\/span><\/div>\n<div style=\"margin-left: 54pt; text-indent: -18pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>b)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">sa foloseasca in perioada locatiunii bunurile care constituie obiectul prezentului contract, ca un posesor de buna-credinta, purtand raspunderea pentru toate pagubele produse din culpa sa;<\/span><\/div>\n<div style=\"margin-left: 54pt; text-indent: -18pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>c)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">sa restituie la sfarsitul locatiunii bunurile care fac obiectul prezentului contract in starea in care le-a preluat consemnata in procesul-verbal de predare-primire;<\/span><\/div>\n<div style=\"margin-left: 54pt; text-indent: -18pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>d)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">sa acorde asistenta tehnica pentru exploatarea normala a <sup>3)<\/sup>&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;..;<\/span><\/div>\n<div style=\"margin-left: 54pt; text-indent: -18pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>e)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">in cazul in care in exploatarea &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;. apar defectiuni tehnice din culpa locatarului, locatorul este indreptatit sa pretinda si sa i se plateasca despagubiri<sup>3)<\/sup>;<\n\n\/span><\/div>\n<div style=\"margin-left: 54pt; text-indent: -18pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>f)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">sa garanteze restituirea bunurilor in starea in care s-au preluat printr-un contract de garantie accesoriu contractului de locatiune<sup>3)<\/sup>.<\/span><\/div>\n<div><b><span lang=\"RO\" style=\"font-family: Arial;\">IV. DURATA CONTRACTULUI<\/span><\/b><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">4.1. Durata locatiunii este de &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.. incepand cu data de &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;. pana la data de &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;. .<\/span><\/div>\n<div><b><span lang=\"RO\" style=\"font-family: Arial;\">V. PRETUL CONTRACTULUI<\/span><\/b><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">5.1. Partile au convenit ca locatarul sa plateasca o chirie de &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.. zi\/luna\/an astfel: &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.. .<\/span><\/div>\n<div><b><span lang=\"RO\" style=\"font-family: Arial;\">VI. SUBLOCATIUNEA CONTRACTULUI{4)T<\/span><\/b><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">6.1. Locatarul are dreptul de a transmite, in tot sau in parte, cu acordul scris al proprietarului, dreptul de folosinta asupra unui tert, in baza unui contract de sublocatiune (subinchiriere).<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">6.2. Sublocutiunea sa nu fie convenita in conditii care sa contravina conditiilor din contractul de locatiune.<\/span><\/div>\n<div><b><span lang=\"RO\" style=\"font-family: Arial;\">VII. CESIUNEA CONTRACTULUI<\/span><\/b><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">7.1. Cesiunea contractului trebuie sa fie notificata locatorului sau acceptata de acesta printr-un act aditional la prezentul contract.<\/span><\/div>\n<div><b><span lang=\"RO\" style=\"font-family: Arial;\">VIII. INCETAREA CONTRACTULUI<\/span><\/b><\/div>\n<div><span lang=\"RO\" style=\"font-family: Arial;\">8.1. Contractul de locatiune inceteaza prin:<\/span><\/div>\n<div style=\"margin-left: 54pt; text-indent: -18pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>a)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">acordul de vointa al partilor;<\/span><\/div>\n<div style=\"margin-left: 54pt; text-indent: -18pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>b)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">denuntare unilaterala;<\/span><\/div>\n<div style=\"margin-left: 54pt; text-indent: -18pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>c)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">expirarea termenului;<\/span><\/div>\n<div style=\"margin-left: 54pt; text-indent: -18pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>d)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">pieirea bunului;<\/span><\/div>\n<div style=\"margin-left: 54pt; text-indent: -18pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>e)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">desfiintarea titlului locatorului;<\/span><\/div>\n<div style=\"margin-left: 54pt; text-indent: -18pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>f)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">prin efectul instrainarii, prin acte intre vii, cu titlu particular, a bunului dat in locatiune.<sup> 5)<\/sup><\/span><\/div>\n<div><b><span lang=\"RO\" style=\"font-family: Arial;\">IX. FORTA MAJORA<\/span><\/b><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">9.1. Nici una dintre partile contractante nu raspunde de neexecutarea la termen si\/sau executarea in mod necorespunzator &#8211; totala sau partiala &#8211; a oricarei obligatii care ii revine in baza prezentului contract, daca neexecutarea sau executarea necorespunzatoare a obligatiei respective a fost cauzata de forta majora asa cum este definita de lege.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">9.2. Partea care invoca forta majora este obligata sa notifice celeilalte parti in termen de &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.. zile\/ore producerea evenimentului si sa ia toate masurile posibile in vederea limitarii consecintelor lui.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">9.3. Daca in termen de &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;. zile\/ore de la producere evenimentul respectiv nu inceteaza, partile au dreptul sa-si notifice incetarea de plin drept a prezentului contract, fara ca vreuna dintre ele sa pretinda daune-interese.<\/span><\/div>\n<div><b><span lang=\"RO\" style=\"font-family: Arial;\">X. NOTIFICARI<\/span><\/b><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">10.1. In acceptiunea partilor contractante, orice notificare adresata de una dintre acestea celeilalte este valabil indeplinita daca va fi transmisa la adresa\/sediul prevazut in partea introductiva a prezentului contract.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">10.2. In cazul in care notificarea se face pe cale postala, ea va fi transmisa, prin scrisoare recomandata, cu confirmare de primire (A.R.) si se considera primita de destinatar la data mentionata pe confirmare de oficiul postal primitor.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">10.3. Daca confirmarea se trimite prin telex sau telefax, ea se considera primita in prima zi lucratoare dupa cea in care a fost expediata.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">10.4. Notificarile verbale nu se iau in considerare de nici una dintre parti, daca nu sunt confirmate, prin intermediul uneia dintre modalitatile prevazute la alineatele precedente.\u201d<\/span><\/div>\n<div><b><span lang=\"RO\" style=\"font-family: Arial;\">XI. LITIGII<\/span><\/b><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">11.1. In cazul in care rezolvarea neintelegerilor nu este posibila pe cale amiabila, ele vor fi supuse spre solutionare tribunalului arbitral, conform regulilor de procedura aplicabile arbitrajului comercial ad-hoc, organizat de Camera de Comert si Industrie a Romaniei.<\/span><\/div>\n<div><b><span lang=\"RO\" style=\"font-family: Arial;\">XII. CLAUZE FINALE<\/span><\/b><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">12.1. Modificarea prezentului contract se face numai prin act aditional incheiat intre partile contractante.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">12.2. Prezentul contract, impreuna cu anexele sale care fac parte integranta din cuprinsul sau, reprezinta vointa partilor si inlatura orice alta intelegere verbala dintre acestea, anterioara sau ulterioara incheierii lui<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">12.3. In cazul in care partile isi incalca obligatiile lor, neexe<\/p>\n<p>rcitarea de partea care sufera vreun prejudiciu a dreptului de a cere executarea intocmai sau prin echivalent banesc a obligatiei respective nu inseamna ca ea a renuntat la acest drept al sau.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">12.4. Prezentul contract a fost incheiat intr-un numar de &#8230;&#8230;&#8230;&#8230;&#8230; exemplare din care &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230; astazi &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;., data semnarii lui. &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230; <\/span>ATENTIE<\/span><\/b><span lang=\"RO\" style=\"font-family: Arial;\"><\/span><\/div>\n<div><span lang=\"RO\" style=\"font-family: Arial;\"><span>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span>In conformitate cu prevederile art. 1470 din Codul civil exista trei feluri de locatiuni a lucrarilor:<\/span><\/div>\n<div style=\"margin-left: 54pt; text-indent: -18pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>a)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; text-indent: -18pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>b)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">locatiunea unor lucrari (locatis operis faciendi), adica aceea care consta intr-un anumit fapt determinat (ex.: obligatia de a transporta persoane sau marfuri dintr-un loc in altul);<\/span><\/div>\n<div style=\"margin-left: 54pt; text-indent: -18pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>c)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">locatiunea de lucrari din partea unui antreprenor (ex.: arhitect, constructor, zidar, dulgher etc.).<\/span><\/div>\n<div>\n<\/div>\n<div><b><span lang=\"RO\" style=\"font-family: Arial;\"><span>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span>NOTE<\/span><\/b><span lang=\"RO\" style=\"font-family: Arial;\"><\/span><\/div>\n<div style=\"margin-left: 54pt; text-indent: -18pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>1)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">Pot fi bunuri mobile sau imobile, corporale sau incorporale, dar, indiferent de caz, aceste bunuri sa nu se distruga sau sa nu se consume prin folosinta conform destinatiei dupa natura obiectului sau conform destinatiei stabilite de parti.<\/span><\/div>\n<div style=\"margin-left: 54pt; text-indent: -18pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>2)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">Locatorul raspunde chiar daca a fost de buna credinta la incheierea contractului si nu a cunoscut viciile si indiferent daca viciile existau in momentul incheierii contractului sau provin din cauze ulterioare, deoarece obligatia locatorului de a asigura folosinta bunurilor este succesiva.<\/span><\/div>\n<div style=\"margin-left: 54pt; text-indent: -18pt;\"><span lang=\"RO\" style=\"font-family: Arial;\"><span>3)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">Daca este cazul.<\/span><\/div>\n<div style=\"margin-left: 54pt;
