{"id":20189,"date":"2011-03-07T11:05:00","date_gmt":"2011-03-07T11:05:00","guid":{"rendered":"http:\/\/trainingsnews.com\/autonomia-locala-si-reglementarea-ei-in-2"},"modified":"2011-03-07T11:05:00","modified_gmt":"2011-03-07T11:05:00","slug":"autonomia-locala-si-reglementarea-ei-in-2","status":"publish","type":"post","link":"https:\/\/cvnextjob.com\/index.php\/2011\/03\/07\/autonomia-locala-si-reglementarea-ei-in-2\/","title":{"rendered":"AUTONOMIA LOCAL\u0102 \u015eI REGLEMENTAREA EI \u00ceN CONSTITU\u0162IILE \u0162\u0102RILOR UNIUNII EROPENE"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><div class=\"MsoBodyTextIndent\" style=\"text-indent: 0cm;\"><span lang=\"RO\">Pentru a analiza modul de reglementare a autonomiei locale la nivelul constitu\u0163ional al fiec\u0103rui stat membru al Uniunii Europene trebuie s\u0103 facem o prim\u0103 distinc\u0163ie \u00eentre statele care au constitu\u0163ii adoptate \u00eenainte de deceniul \u015fase al secolului XX \u015fi cele care au adoptat constitu\u0163ii ulterior acestei date.<\/span><\/div>\n<div style=\"text-align: justify;\"><span lang=\"RO\">Astfel, dac\u0103 constitu\u0163iile unor state ca Germania (1949), Belgia (1831), Regatul Unit al Marii Britanii \u015fi Irlandei de Nord(1215,1628, 1679, 1689, 1911, 1949, 1958), Irlanda (1937), Danemarca (1953), nu utilizeaz\u0103 expres termenul de autonomie local\u0103, \u00een schimb state care au adoptat constitu\u0163ii mai recente: Spania (1978), Grecia (1975), Luxemburg (1868 cu revizuire \u00een 1948 \u015fi 1993), Portugalia (1976), au consacrat \u00een reglement\u0103rile lor fundamentale aceast\u0103 terminologie.<\/span><\/div>\n<div style=\"text-align: justify;\"><span lang=\"RO\">O a treia categorie o formeaz\u0103 statele care nu utilizeaz\u0103 \u00een mod expres o atare terminologie , dar care dispun de o legisla\u0163ie intern\u0103 ce con\u0163ine conceptul de autonomie local\u0103. Este cazul Fran\u0163ei.<\/span><\/div>\n<div style=\"text-align: justify;\"><span lang=\"RO\">Exist\u0103, \u00een principiu, dou\u0103 modalit\u0103\u0163i de recunoa\u015ftere a autonomiei locale:<\/span><\/div>\n<div style=\"margin-left: 73.5pt; text-align: justify; text-indent: 0cm;\"><span lang=\"RO\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"RO\">ca regim juridic unic \u015fi general;<\/span><\/div>\n<div style=\"margin-left: 73.5pt; text-align: justify; text-indent: 0cm;\"><span lang=\"RO\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"RO\">ca regim juridic excep\u0163ional \u015fi particular.<\/span><\/div>\n<div class=\"MsoBodyTextIndent\" style=\"text-indent: 0cm;\"><span lang=\"RO\">\u00cen prima categorie se \u00eencadreaz\u0103 acele state care asigur\u0103 o identitate de tratament juridic comunit\u0103\u0163ilor locale, utiliz\u00e2nd o baz\u0103 juridic\u0103 unic\u0103. De exemplu, Constitu\u0163ia Greciei reglementeaz\u0103 organizarea administra\u0163iei de stat pe baza unui sistem de desconcentrare, \u00eencredin\u0163\u00e2nd gestiunea afacerilor locale colectivit\u0103\u0163ilor locale, care se bucur\u0103 de autonomie administrativ\u0103 (art.102, pct.2). Constitu\u0163ia Luxemburgului comunele formate din comunit\u0103\u0163i autonome, constituite pe baz\u0103 teritorial\u0103, posed\u00e2nd personalitate juridic\u0103 \u015fi gir\u00e2nd, prin propriile organe, propriul patrimoniu \u015fi interes (art.107, pct.1).<\/span><\/div>\n<div style=\"text-align: justify;\"><span lang=\"RO\">\u00cen a doua categorie se \u00eencadreaz\u0103 acele state care, prin legea lor fundamental\u0103, av\u00e2nd \u00een vedere particularit\u0103\u0163ile istorice \u015fi lingvistice ale constituirii lor, atribuie un anumit sistem particular de autonomie fie comunit\u0103\u0163ilor locale, fie comunit\u0103\u0163ilor lingvistice, fie anumitor structuri teritoriale.<\/span><\/div>\n<div style=\"text-align: justify;\"><span lang=\"RO\">Astfel, Constitu\u0163ia Italiei, dup\u0103 ce consfin\u0163e\u015fte organizarea statului \u00een regiuni, provincii \u015fi comune (art.114), recunoa\u015fte, pe de o parte, calitatea regiunilor de organisme autonome ce dispun de puteri particulare \u015fi func\u0163ii proprii (art.115), iar pe de alt\u0103 parte, atribuie Sardiniei, Siciliei etc., forme \u015fi condi\u0163ii particulare de autonomie \u00een termenii unor statute speciale adoptate prin legi constitu\u0163ionale.<\/span><\/div>\n<div style=\"text-align: justify;\"><span lang=\"RO\">\u00cen Spania exist\u0103 dou\u0103 regimuri juridice aplicabile, disting\u00e2ndu-se \u00eentre autonomia comunal\u0103, guvernat\u0103 \u015fi administrat\u0103 de consilii municipale \u015fi comunit\u0103\u0163ile autonome. Art.113, pct.1 din Constitu\u0163ia Spaniei recunoa\u015fte provinciilor limitrofe, av\u00e2nd caracteristici istorice, culturale \u015fi economice comune, teritoriilor insulare \u015fi provinciilor av\u00e2nd o identitate regional\u0103 istoric\u0103, posibilitatea de a se guverna ele singure, prin constituirea \u00een Comunit\u0103\u0163i autonome. \u00cen art.2 se recunoa\u015fte \u015fi garanteaz\u0103 dreptul de autonomie a na\u0163ionalit\u0103\u0163ilor \u015fi a na\u0163iunilor care o compun \u015fi solidaritatea dintre ele.<\/span><\/div>\n<div style=\"text-align: justify;\"><span lang=\"RO\">\u00cen Portugalia este reglementat un anumit regim politic \u015fi administrativ arhipelagului Azorelor \u015fi Maderelor, bazat pe \u201ecaracteristicile geografice, economice, sociale \u015fi culturale a acestor regiuni \u015fi pe imemoriabilele aspira\u0163ii autonomiste ale popula\u0163iilor insulare\u201d (art.227 pct.3).<\/span><\/div>\n<div style=\"text-align: justify;\"><span lang=\"RO\">De\u015fi autonomia regiunilor vizeaz\u0103 participarea cet\u0103\u0163enilor la via\u0163a democratic\u0103 a acestora \u015fi la promovarea propriilor interese economice \u015fi sociale, ea este limitat\u0103 prin aceea c\u0103 \u201eAutonomia politic\u0103 \u015fi administrativ\u0103 regional\u0103 nu poate atenta la suveranitatea statului. Ea se exercit\u0103 \u00een cadrul conferit de Constitu\u0163ie\u201d (art.227 pct.3).<\/span><\/div>\n<div style=\"text-align: justify;\"><span lang=\"RO\">Situa\u0163ia Fran\u0163ei este oarecum diferit\u0103, deoarece constitu\u0163ia acesteia din 1958 nu utilizeaz\u0103 \u00een mod expres termenul de autonomie local\u0103, colectivit\u0103\u0163ile teritoriale (comunele, departamentele \u015fi comunit\u0103\u0163ile de peste m\u0103ri) se administreaz\u0103 liber prin consilii alese \u00een condi\u0163iile prev\u0103zute de lege (art.72 aln.2).<\/span><\/div>\n<div style=\"text-align: justify;\"><span lang=\"RO\">Din punctul de vedere al tehnicii juridice utilizate de legiuitorul constituant \u00een consacrarea autonomiei locale, se pot distinge dou\u0103 sisteme: unul ce const\u0103 din simpla enun\u0163are a termenului \u015fi altul con\u0163in\u00e2nd elementele definitorii ale autonomiei locale.<\/span><\/div>\n<div style=\"text-align: justify;\"><span lang=\"RO\">Din cel de-al doilea sistem face parte \u015fi Constitu\u0163ia Belgiei, care d\u0103 competen\u0163\u0103 legii de a reglementa institu\u0163iile provinciale \u015fi comunale, pe baza urm\u0103toarelor principii:<\/span><\/div>\n<div style=\"margin-left: 73.5pt; text-align: justify; text-indent: 0cm;\"><span lang=\"RO\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"RO\">alegerea direct\u0103 a membrilor consiliilor provinciale \u015fi comunale;<\/span><\/div>\n<div style=\"margin-left: 73.5pt; text-align: justify; text-indent: 0cm;\"><span lang=\"RO\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"RO\">exercitarea atribu\u0163iilor consiliilor \u00een limita determinat\u0103 de interesul provincial \u015fi comunal;<\/span><\/div>\n<div style=\"margin-left: 73.5pt; text-align: justify; text-indent: 0cm;\"><span lang=\"RO\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"RO\">descentralizarea atribu\u0163iilor c\u0103tre institu\u0163iile provinciale \u015fi comunale;<\/span><\/div>\n<div style=\"margin-left: 73.5pt; text-align: justify; text-indent: 0cm;\"><span lang=\"RO\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"RO\">publicitatea \u015fedin\u0163elor consiliilor;<\/span><\/div>\n<div style=\"margin-left: 73.5pt; text-align: justify; text-indent: 0cm;\"><span lang=\"RO\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"RO\">interven\u0163ia autorit\u0103\u0163ii de tutel\u0103 ori a puterii legislative pentru asigurarea respect\u0103rii legii \u015fi a protej\u0103rii interesului general (art.108 aln.1).<\/span><\/div>\n<div style=\"text-align: justify;\"><span lang=\"RO\">Exemplele utilizate permit surprinderea contextului constitu\u0163ional european al reglement\u0103rii autonomiei locale la care se adaug\u0103 concl<\/p>\n<p>uzia diversit\u0103\u0163ii modalit\u0103\u0163ilor de a concepe autonomia local\u0103.<\/span><\/div>\n<div style=\"text-align: justify;\"><span lang=\"RO\">Practic fiecare constitu\u0163ie \u00eenglobeaz\u0103 o form\u0103 particular\u0103 de reglementare a autonomiei locale ce \u0163ine de condi\u0163iile istorice ale form\u0103rii statului respectiv, de structura acestuia \u015fi forma de guvern\u0103m\u00e2nt, de coloratura etnic\u0103 a popula\u0163iei \u015fi de tradi\u0163iile \u015fi aspira\u0163iile cet\u0103\u0163enilor respectivi.<\/span><\/div>\n<div style=\"text-align: justify;\"><span lang=\"RO\">Concluzia lui Henri Oberdorff, \u00een lucrarea \u201eLes Constitusions de L<\/span><span lang=\"FR\">\u2019<\/span><span lang=\"RO\">Europe de Douze\u201d, este c\u0103 \u201eaceste diferite constitu\u0163ii europene, prin demersul lor descentralizator, autorizeaz\u0103 \u00eenflorirea unei Europe infraetatic\u0103 complementar\u0103 unei Europe a comunit\u0103\u0163ii de state \u201d.<\/span><\/div>\n<div style=\"text-align: justify;\"><span lang=\"RO\">Domnul Eugen Popa, \u00een lucrarea \u201eAutonomia local\u0103 \u00een Rom\u00e2nia\u201d, editura ALL BECK, 1999, nu este \u00eentru totul de acord cu afirma\u0163ia lui H. Oberdorff sus\u0163in\u00e2nd c\u0103 \u00een marea majoritate a cazurilor autonomiile locale nu exercit\u0103 atribu\u0163ii de suveranitate intern\u0103 sau extern\u0103, la care se adaug\u0103 \u015fi neutilizarea terminologiei respective \u00een \u015fase din cele dou\u0103sprezece constitu\u0163ii ale statelor Uniunii Europene. Autorul lucr\u0103rii scoate \u00een eviden\u0163\u0103 dou\u0103 tendin\u0163e ce, \u00een opinia sa, se contureaz\u0103 cu claritate:<\/span><\/div>\n<div style=\"margin-left: 73.5pt; text-align: justify; text-indent: 0cm;\"><span lang=\"RO\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"RO\">preocuparea statelor de a integra autonomia local\u0103 \u00een contextul mai general al principiilor democratice, al particip\u0103rii comunit\u0103\u0163ilor locale la afirmarea propriilor interese, tendin\u0163\u0103 afirmat\u0103 mai pregnant \u00een legisla\u0163ia special\u0103;<\/span><\/div>\n<div style=\"margin-left: 73.5pt; text-align: justify; text-indent: 0cm;\"><span lang=\"RO\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"RO\">conturarea conceptului de autonomie local\u0103, \u00een ultimii patruzeci de ani, culmin\u00e2nd cu adoptarea Cartei europene a autonomiei locale, la Strasbourg, \u00een anul 1985 .<\/span><\/div>\n<div class=\"MsoBodyTextIndent\" style=\"text-indent: 0cm;\"><span lang=\"RO\">Document politic \u015fi juridic deopotriv\u0103, Carta european\u0103 a autonomiei locale a fost deschis\u0103 semn\u0103rii la 15 octombrie 1985 \u015fi a intrat \u00een vigoare la data de 1 septembrie 1988. importan\u0163a a fost apreciat\u0103 \u00een felul urm\u0103tor: \u201eCarta european\u0103 a autonomiei locale este pentru comunit\u0103\u0163ile locale ceea ce este pentru popoarele europene Conven\u0163ia pentru ap\u0103rarea drepturilor omului \u015fi a libert\u0103\u0163ilor fundamentale\u201d.<\/span><\/div>\n<div style=\"text-align: justify;\"><span lang=\"RO\">Este de remarcat \u00een acela\u015fi timp faptul c\u0103, \u00een cadrul primei sesiuni a Congresului Puterilor Locale \u015fi Regionale din europa, desf\u0103\u015furat\u0103 la Strasbourg \u00eentre 31 mai \u2013 3 iunie 1994, s-a adoptat ini\u0163iativa preg\u0103tirii unei Carte europene pentru autonomie regional\u0103 care ar urma s\u0103 utilizeze ca model Carta european\u0103 pentru autonomie local\u0103.<\/span><\/div>\n<div style=\"text-align: justify;\"><span lang=\"RO\">Scopul principal urm\u0103rit de o asemenea cart\u0103 este crearea mecanismelor de realizare \u015fi concentrare \u00een vederea elimin\u0103rii dublei impuneri \u015fi de asigurare a complementarit\u0103\u0163ii ac\u0163iunii colectivit\u0103\u0163ilor locale. \u00cen acest context se recomand\u0103 autorit\u0103\u0163ilor na\u0163ionale realizarea cadrului juridic corespunz\u0103tor \u2013 \u00een cadrul dreptului intern \u2013 care s\u0103 permit\u0103 promovarea \u015fi aprofundarea cooper\u0103rii interregionale \u015fi transfrontaliere.<\/span><\/div>\n<div style=\"text-align: justify;\"><span lang=\"RO\"><br \/>\n<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Pentru a analiza modul de reglementare a autonomiei locale la nivelul constitu\u0163ional al fiec\u0103rui stat membru al Uniunii Europene trebuie s\u0103 facem o prim\u0103 distinc\u0163ie \u00eentre statele care au constitu\u0163ii adoptate \u00eenainte de deceniul \u015fase al secolului XX \u015fi cele care au adoptat constitu\u0163ii ulterior acestei date.
