at\u00e2t de vast al reglement\u0103rilor juridice privind Drepturile Copilului, voi \u00eencerca s\u0103 schi\u0163ez principalele direc\u0163ii de orientare ce guverneaz\u0103 problema unui t\u00e2n\u0103r sub 18 ani care intr\u0103 \u00een contact cu sistemul de justi\u0163ie, ca urmare a unei suspect\u0103ri ori a unei acuza\u0163ii de comitere a unui delict, viz\u00e2nd c\u00e2teva aspecte legate de aplicarea acelor m\u0103suri ce afecteaz\u0103 starea de libertate a minorului.\u00cemi propun ca \u00een cadrul acestei analize s\u0103 abordez problematica respect\u0103rii dreptului copilului delicvent din perspectiva a trei factori :<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 1) recomand\u0103rile din legisla\u0163ia interna\u0163ional\u0103 cu privire la copii \u00een contradic\u0163ie cu legea rom\u00e2n\u0103 ;<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 2) contradic\u0163iile legisla\u0163iei rom\u00e2ne\u015fti cu privire la copii care r\u0103spund penal ;<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 3) contradic\u0163iile dintre lege \u015fi practic\u0103 ;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"RO\" s\n\ntyle=\"font-size: 12pt;\">\u201cexploatarea minorilor, folosirea lor \u00een activit\u0103\u0163i care le-ar putea d\u0103una s\u0103n\u0103t\u0103\u0163ii, moralit\u0103\u0163ii sau care le-ar pune \u00een primejdie via\u0163a ori dezvoltarea normal\u0103 sunt interzise \u201c<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <b>b) <\/b>Articolul 2 din Legea 18\/1990 (prin care Rom\u00e2nia ratific\u0103 Conven\u0163ia Na\u0163iunilor Unite cu privire la Drepturile Copilului) care prevede c\u0103 :<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u201cStatele p\u0103r\u0163i se angajeaz\u0103 s\u0103 respeste drepturile care sunt enun\u0163ate \u00een prezenta conven\u0163ie \u015fi s\u0103 le garanteze tuturor copiilor care \u0163in de jurisdic\u0163ia lor, f\u0103r\u0103 nici o distinc\u0163ie, indiferent de ras\u0103, culoare, sex, limb\u0103, religie, opinie politic\u0103 sau alt\u0103 opinie a copilului, a p\u0103rin\u0163ilor sau a reprezentan\u0163ilor s\u0103i legali, de originea lor na\u0163ional\u0103, etnic\u0103, sau social\u0103, de situa\u015fia lor material\u0103, de incapacitatea lor, de na\u015fterea lor sau de alt\u0103 situa\u0163ie .<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Statele p\u0103r\u0163i vor lua toate m\u0103surile corespunz\u0103toare pentru ca acesta s\u0103 fie efectiv protejat \u00eempotriva oric\u0103rei forme de discriminare sau de sanc\u0163iuni motivate de situa\u0163ia juridic\u0103, activit\u0103\u0163ile, opiniile declarate ori convingerile p\u0103rin\u0163ilor s\u0103i, ale reprezentan\u0163ilor s\u0103i legali ori ale membrilor familiei sale .\u201d<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Trebuie f\u0103cut\u0103 precizarea c\u0103 odat\u0103 cu ratificarea de c\u0103tre Rom\u00e2nia a Conven\u0163iei Na\u0163iunilor Unite cu privire la Drepturile Copilului prin Legea 18\/1990, aceasta devine obligatorie pentru Rom\u00e2nia \u015fi are aceea\u015fi putere de lege ca \u015fi Constitu\u0163ia.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <b>c) <\/b>\u00een completarea cadrului juridic, \u00een afar\u0103 de aceste texte fundamentale prezentate mai sus, mai putem prezenta :<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Regulile Na\u0163iunilor Unite pentru Ap\u0103rarea Minorilor Priva\u0163i de Libertate \u015fi Regulile de la Beijing- Standardul de Reguli Minime al Na\u0163iunilo Unite- Administrarea Justi\u0163iei pentru minori- se constituie ca un \u00eendrumar, stabilind recomand\u0103ri \u00eens\u0103 nu sunt obligatorii pentru state .<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp;Prima etap\u0103 \u00een drumul st\u0103b\u0103tut de un asfel de dosar o reprezint\u0103 <b>re\u0163inerea de c\u0103tre organele de poli\u0163ie<\/b>.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Legea nr. 26\/1994 privind organizarea \u015fi func\u0163ionarea Poli\u0163iei Rom\u00e2ne prevede \u00een articolul 16 (1) litera <b>&nbsp;b)<\/b> :\u201ds\u0103 conduc\u0103 la sediul poli\u0163iei \u00een vederea lu\u0103rii de m\u0103suri legale, pe cei care, prin ac\u0163iunile lor, pericliteaz\u0103 ordinea public\u0103, via\u0163a persoanelor sau alte valori sociale, precum \u015fi persoanele suspecte a c\u0103ror identitate nu a putut fi stabilit\u0103.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Persoanele suspecte de ac\u0163iuni prin care se pericliteaz\u0103 ordinea public\u0103, via\u0163a persoanelor sau alte valori sociale, care refuz\u0103 s\u0103-\u015fi decline identitatea ori aceasta nu poate fi stabilit\u0103, sunt conduse la sediul poli\u0163iei pentru clarificarea situa\u0163iei \u015fi, dup\u0103 caz, prezentarea acestora de \u00eendat\u0103 \u00een fa\u0163a organului de urm\u0103rire penal\u0103 competent, activit\u0103\u0163i ce nu pot dura mai mult de 24 de ore .\u201c <\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Din nefericire, legea respectiv\u0103 nu prevede \u00eens\u0103 obliga\u0163ia pentru reprezentan\u0163ii poli\u0163iei ca \u00een cazul conducerii la sc\u0163ie a unui copil (minor) \u00een vederea stabilirii identit\u0103\u0163ii acestuia sau a unor aspecte legate de sv\u00e2r\u015firea unei infrac\u0163iuni, s\u0103 cheme de \u00eendat\u0103 pe unul din p\u0103rin\u0163i, tutorele sau un<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"mar\n\ngin: 0cm 14.2pt 0.0001pt; text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">reprezentant al Autorit\u0103\u0163ii Tutelare ori altor organiza\u0163ii pentru protec\u0163ia copilului.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp;Minorul,de asemenea, datorit\u0103 v\u00e2rstei, nu \u015ftie c\u0103 are dreptul s\u0103 solicite prezen\u0163a acestora la sec\u0163ia de poli\u0163ie, poli\u0163istul fiind singura persoan\u0103 care poate s\u0103 cheme p\u0103rin\u0163ii sau Autoritatea Tutelar\u0103, el \u00eentreprinz\u00e2nd aceast\u0103 ac\u0163iune dup\u0103 bunul plac.&nbsp;&nbsp; <\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">\u00cen legisla\u0163ia rom\u00e2n\u0103 \u015fi interna\u0163ional\u0103 nu exist\u0103 prevederi speciale cu privire la metodologia de re\u0163inere a unui copil suspect de s\u0103v\u00e2r\u015firea unui delict criteriile aplicabile fiind cele generale. Astfel : <\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt 21.3pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Art. 136 din Codul de Procedur\u0103 Penal\u0103 prevede scopul \u015fi categoriile m\u0103surilor preventive:\u201d \u00cen cauzele privitoare la infrac\u0163iuni pedepsite cu \u00eenchisoarea, \u2026 se poate lua fa\u0163\u0103 de acesta una din urm\u0103toarele m\u0103suri preventive: re\u0163inerea, obligarea de a nu p\u0103r\u0103si localitatea \u015fi arestarea preventiv\u0103.\u201d&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Art. 143 din C.P.P. prevede: \u201dM\u0103sura re\u0163inerii poate fi luat\u0103 ce organul de cercetare penal\u0103 fa\u0163\u0103 de \u00eenvinuit dac\u0103 sunt probe sau indicii temeinice c\u0103 a s\u0103v\u00e2r\u015fit o fapt\u0103 prev\u0103zut\u0103 de legea penal\u0103.\u201d&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Tot astfel, art. 480 din C.P.P. prevede: \u201dUrm\u0103rirea \u015fi judecata infrac\u0163iunilor s\u0103v\u00e2r\u015fite de minori, precum \u015fi punerea \u00een executare a hot\u0103r\u00e2rilor privitoare la ace\u015ftia, se fac potrivit procedurii obi\u015fnuite,\u2026\u201d<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin-left: 14.2pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Art. 481<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &nbsp;\u201c(1) \u2013 C\u00e2nd \u00eenvinuitul sau inculpatul este un minor ce nu a \u00eemplinit 16 ani, la orice ascultare sau confruntare a minorului, dac\u0103 organul de urm\u0103rire penal\u0103&nbsp; consider\u0103 necesar, citeaz\u0103 delegatul Autorit\u0103\u0163ii Tutelare, precum \u015fi p\u0103rin\u0163ii, iar c\u00e2nd este cazul, tutorele, curatorul sau persoana \u00een \u00eengrijirea ori supravegherea c\u0103rea se afl\u0103 minorul.&nbsp; <\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; (2) \u2013Citarea persoanelor prev\u0103zute \u00een aliniatul precedent este obligatorie la efectuarea prezent\u0103rii materialului de urm\u0103rire penal\u0103. <\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; (3) \u2013Neprezentarea persoanelor legal citate la efectuarea actelor ar\u0103tate \u00een aliniatul 1 \u015fi 2 nu \u00eempiedic\u0103 efectuarea acelor acte.\u201d&nbsp;&nbsp;&nbsp; <\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Dup\u0103 cum observ\u0103m, prezen\u0163a Autorit\u0103\u0163ii Tutelare, a p\u0103rin\u0163ilor, a tutorelui ori a curatorului este l\u0103sat\u0103 la aprecierea organului de urm\u0103rire. Consider\u0103m necesar\u0103 prezen\u0163a acestora \u015fi implicit a avocatului, \u00eenc\u00e2t din faza urm\u0103ririi penale \u015fi, mai mult, \u00een momentul c\u00e2nd minorul a fost adus la poli\u0163ie pentru cercet\u0103ri sau \u00een baza unui mandat de arestare, pentru c\u0103, at\u00e2t timp c\u00e2t minorul, potrivit Constitu\u0163iei \u015fi altor legi, nu are drept de vot, nu are drept de a dispune de bunurile sale, nu are drept de asociere, nu se poate c\u0103s\u0103tori, atunci cum ar putea s\u0103 semneze \u015fi s\u0103-\u015fi asume, fie \u015fi numai o declara\u0163ie, \u00een prezen\u0163a organului de urm\u0103rire penal\u0103?&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Practica consemneaz\u0103 c\u0103, \u00een majoritatea cazurilor, persoanele prev\u0103zute la articolul 481 nu sunt citate, copilul nu beneficiaz\u0103 \u00een aceast\u0103 faz\u0103 de prezen\u0163a lor.&nbsp;&nbsp; <\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp; &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &nbsp;Minorii pot fi du\u015fi la sec\u0163ia de poli\u0163ie unde, sub pretextul indentific\u0103rii acestora sau stabilirea domiciliului, pot fi \u0163inu\u0163i p\u00e2n\u0103 la 24 de ore, <\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp;\u00eenc\u0103lc\u00e2ndu-se prevederile Constitu\u0163iei, \u00een care se spune c\u0103 nimeni nu poate fi re\u0163inut mai mult de 24 ore f\u0103r\u0103 mandat de arestare.&nbsp;&nbsp;&nbsp;&nbsp; &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; O a doua etap\u0103 a desf\u0103\u015fur\u0103rii acestei ac\u0163iuni o reprezint\u0103 <b>arestarea<\/b>.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Reglement\u0103rile interna\u0163ionale accept\u0103 privarea de libertate a minorilori \u00een anumite cazuri. Nici unul din aceste documente nu se refer\u0103 \u00een mod expres <\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">la condi\u0163iile aplic\u0103rii arestului preventiv, ci vorbesc despre privarea de libertate.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Privarea de libertate este reglementat\u0103 ca \u015fi sentin\u0163\u0103 de Regulile de la Beijing.&nbsp; De\u015fi acestea nu au caracter obligatoriu, ele trebuie s\u0103 constituie o serie de norme valoroase dup\u0103 care statele trebuie s\u0103 se ghideze. <\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Acestea, asemeni Conven\u0163iei, stipuleaz\u0103 c\u0103 pedeapsa cu lipsirea de libertate trebuie s\u0103 fie ultima m\u0103sur\u0103 luat\u0103 \u015fi pe c\u00e2t mai&nbsp; scurt timp posibil. Acest fapt este consfin\u0163it \u015fi de c\u0103tre Regulile de la Tokio, care sunt cunoscute \u015fi sub numele de \u201cStandarde \u015fi Reguli minime ale Na\u0163iunilor Unite privind m\u0103surile non- custodiale.\u201d<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Conform documentelor enun\u0163ate anterior, m\u0103sura lipsirii de libertate a minorului trebuie s\u0103 aib\u0103 la baz\u0103 principiul reabilit\u0103rii.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00cen C.P.P., articolul 146 reglementeaz\u0103 condi\u0163iile pentru arestarea \u00eenvinuitului. Arestul preventiv&nbsp; poate fi dispus de c\u0103tre procuror dac\u0103 el consider\u0103 c\u0103 este \u00een interesul urm\u0103rii penale privarea de libertate a \u00eenvinuitului sau de c\u0103tre instan\u0163a de judecat\u0103.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Tot astfel, cu privire la termenul arest\u0103rii, nici Comisia \u015fi nici Curtea nu au stabilit nici un termenminim, \u00eens\u0103 termenul \u201cde \u00eendat\u0103\u201d reprezint\u0103 un criteriu mai riguros dec\u00e2t acela de \u201ctermen scurt\u201d<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Din aceste prevederi reiese c\u0103 arestarea ar trebui dispus\u0103 de un judec\u0103tor \u015fi nu de un procuror, iar arestul preventiv ar trebui s\u0103 fie dispus pentru un termen rezonabil.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">\u00cen contradic\u0163ie cu&nbsp; Comisia European\u0103 a Drepturilor Omului, arestul preventiv \u00een Rom\u00e2nia este dispus de procuror sau de judec\u0103tor, iar articolul 150 din Codul Penal prevede c\u0103 \u201cm\u0103sura arest\u0103rii inculpatului poate fi luat\u0103 numai dup\u0103 ascultarea acestuia de c\u0103tre un procuror sau de c\u0103tre instan\u0163a de judecat\u0103 \u2026\u201d \u00een condi\u0163iile \u00een care prevederile Comisiei Europene a Drepturilor Omului spun c\u0103 ascultarea inculpatului trebuie f\u0103cut\u0103 de c\u0103tre judec\u0103tor, nu de c\u0103tre procuror.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Referitor la condi\u0163iile oferite de arestul sec\u0163iilor de poli\u0163ie putem men\u0163iona \u015fi alte probleme, cum ar fi : accesul dificil la sursele de ap\u0103, la grupul sanitar, la asisten\u0163\u0103 medical\u0103, la \u015fcolarizare.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp; Tot astfel, av\u00e2nd \u00een vedere spa\u0163iile \u00eenguste ale unei celule, nu este asigurat nici minimum de oxigen necesar unei persoane, iar la asisten\u0163a juridic\u0103 din oficiu, aceasta este pus\u0103 la dispozi\u0163ie de organele de poli\u0163ie, neexist\u00e2nd niciun control vis-\u00e0-vis de avocatul chemat s\u0103-l reprezinte pe minor.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">O alt\u0103 problem\u0103 caracteristic\u0103 o reprezint\u0103 durata arest\u0103rii minorului, conform prevederilor articolului 155 C.P.P. care stipuleaz\u0103 c\u0103 : \u201cDurata arest\u0103rii inculpatului poate fi prelungit\u0103 \u00een caz de necesitate \u015fi numai motiat\u201d.&nbsp; Arestul \u00eenceteaz\u0103 de drept \u015fi \u00een situa\u0163ia c\u00e2nd a atins jum\u0103tatea maximului pedepsei prev\u0103zute de lege pentru infrac\u0163iunea care face obiectul \u00eenvinuirii (articolul 140 C.P.P.).<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Durata pentru care se&nbsp; poate lua m\u0103sura poate atinge c\u00e2\u0163iva ani (ajunge p\u00e2n\u0103 la 3 ani \u00een cazul furtului calificat).&nbsp; De re\u0163inut este \u015fi aspectul c\u0103 \u00een legisla\u0163ia actual\u0103 nu exist\u0103 reglement\u0103ri care s\u0103 stabilesc\u0103 clar motivele ori cazurile de necesitate invocate de articolul 155 C.P.P., \u00een cazul infractorilor minori intr\u00e2ndu-se \u00een litigiu cu dispozi\u0163iile articolului 37 din Legea 18\/1990 care prevede la litera b) : \u201cArestarea, de\u0163inerea sau \u00eentemni\u0163area unui copil trebuie s\u0103 fie conform\u0103 cu legea \u015fi nu va fi dec\u00e2t o m\u0103sur\u0103 extrem\u0103 \u015fi va fi c\u00e2t mai scurt\u0103 posibil\u201d.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Din punctul de vedere al asisten\u0163ei acordate de institu\u0163iile publice de ocrotire a copilului este demn de men\u0163ionat aspectul c\u0103 legile de organizare \u015fi func\u0163ionare a Agen\u0163iei de Protec\u0163ie a Copilului, Direc\u0163iei de Protec\u0163ie a Copilului (la nivel jude\u0163ean) ori a Autorit\u0103\u0163ii Tutelare (la nivel de prim\u0103rie) nu le oblig\u0103 \u00een nici un fel pe aceste s\u0103 fie prezente la toate ac\u0163iunile \u00eentreprinse de organul de cercetare penal\u0103 \u00een interesul copilului \u015fi s\u0103 ia anumite m\u0103suri pentru verificarea condi\u0163iilor de arest \u00een cazul minorilor, nefiind stipulate nici sanc\u0163iunile care se aplic\u0103 \u00een cazul \u00een care o institu\u0163ie nu-\u015fi respect\u0103 obliga\u0163iile.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">O alt\u0103 etap\u0103 important\u0103 pe care o str\u0103bate un dosar o reprezint\u0103 <b>procesul<\/b>.&nbsp; Legat de aceast\u0103 etap\u0103 voi face referire la compatibilitatea instan\u0163ei, la ancheta social\u0103 precum \u015fi la stabilirea descern\u0103m\u00e2ntului infractorului minor.&nbsp; <\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Astfel : articolul 40 litera b) punctul iii) din Legea 18\/1990 prevede&nbsp; : \u201ccauza s\u0103 fie examinat\u0103, f\u0103r\u0103 \u00eent\u00e2rziere de c\u0103tre o autoritate sau de c\u0103tre o instan\u0163\u0103 judiciar\u0103 competent\u0103, independent\u0103 \u015fi impar\u0163ial\u0103, dup\u0103 o procedur\u0103 echitabil\u0103, conform prevederilor legii, \u00een prezen\u0163a avocatului s\u0103u \u015fi dac\u0103 acest lucru nu este contrar interesului superior al copilului datorit\u0103 \u00een special v\u00e2rstei \u015fi situa\u0163iei sale, \u00een prezen\u0163a p\u0103rin\u0163ilor s\u0103i sau a reprezentan\u0163ilor legali.\u201d<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Tot astfel, \u00een articolul 3(1) din acela\u015fi text de lege se prevede c\u0103 : \u201d \u00een toate deciziile care \u00eei privesc pe copii, fie c\u0103 sunt luate de institu\u0163ii publice ori private de ocrotire social\u0103, de c\u0103tre tribunale, autorit\u0103\u0163i administrative sau de alte organe legislative, interesele superioare ale copilului trebuie s\u0103 fie luate \u00een considerare cu prioritate. \u201c <\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Referitor la completul de judecat\u0103 care este competent \u00een cauzele cu infractori minori, g\u0103sim unele reglement\u0103ri \u00een articolul 483 C.P.P. care prevede&nbsp; : \u201d Cauzele \u00een care inculpatul este minor se judec\u0103 potrivit regulilor de competen\u0163\u0103 obi\u015fnuit\u0103&nbsp; de judec\u0103tori desemna\u0163i de c\u0103tre ministrul justi\u0163iei&#8221;.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">\u00cen practic\u0103 nu exist\u0103 complete de judecat\u0103 speciale pentru minori, ace\u015fti fiind judeca\u0163i \u00eenpreun\u0103 cu majorii, de acela\u015fi complet de judecat\u0103, \u00een cadrul aceleia\u015fi \u015fedin\u0163e de judecat\u0103.&nbsp; Minorii sunt transporta\u0163i \u00een acelea\u015fi ma\u015fini cu care sunt transporta\u0163i adul\u0163ii de la locul de de\u0163inere p\u00e2n\u0103 la instan\u0163\u0103, \u00een cele mai multe dintre cazuri aceste mijloace de transport neput\u00e2nd asigura separa\u0163iunea diferitelor categorii de de\u0163inu\u0163i.&nbsp; Procedurile folosite la escortare precum \u015fi m\u0103surile de siguran\u0163\u0103 ce se iau \u00eempotriva evad\u0103rii minorilor sunt acelea\u015fi ca la adul\u0163i.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Textul Codului de Procedur\u0103 Penal\u0103 nu ne ofer\u0103 date concrete privind componen\u0163a completului care judec\u0103 \u00een cauzele cu minori, \u00eens\u0103 nu exist\u0103 complete de judecat\u0103 separate sau speciale pentru cauzele \u00een care sunt implica\u0163i minori, dec\u00e2t cu rare excep\u0163ii.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Tot \u00een cadrul etapei privitoare la procesul intentat infractorilor minori, o component\u0103 esen\u0163ial\u0103 o reprezint\u0103 <b>ancheta social\u0103.<\/b><\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; \u00cen cadrul aceluia\u015fi text de lege la articolul 40 este men\u0163ionat un alt aspect important : \u201cPersoanele aflate \u00een stare de re\u0163inere sau de\u0163inere se vor examina \u00een prezen\u0163a personalului de paz\u0103 de acela\u015fi sex.&nbsp; Minorii vor fi examina\u0163i \u00een prezen\u0163a unuia dintre p\u0103rin\u0163i sau a tutorelui, iar \u00een lipsa acestora \u00een prezen\u0163a unui membru major al familiei, de acela\u015fi sex cu minorul.&nbsp; Persoanele internate \u00een spitale se vor examina \u00een prezen\u0163a medicului care are \u00een \u00eengrijirea sa bolnavul.\u201d<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Dup\u0103 cum se observ\u0103, din aceste texte de lege, reiese obliga\u0163ia prev\u0103zut\u0103 \u00een cazul minorilor re\u0163inu\u0163i sau condamna\u0163i de a fi \u00eenso\u0163i\u0163i la institutele de medicin\u0103 legal\u0103 \u00een vederea unor expertize de unul din p\u0103rin\u0163i.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; De altfel, practica a demonstrat c\u0103 examinarea medico-legal\u0103 nu este eficient\u0103 \u00een prezen\u0163a personalului de paz\u0103, iar rezultatul expertizei nu poate fi exact av\u00e2nd \u00een vedere faptul c\u0103, minorul poate fi speriat datorit\u0103 faptului c\u0103 este \u00een stare de arest, av\u00e2d c\u0103tu\u015fe la m\u00e2ini, este \u015focat \u015fi nu \u00een\u0163elege ce se \u00eent\u00e2mpl\u0103 cu el, iar explica\u0163iile referitoare la situa\u0163ia \u00een care se afl\u0103, dac\u0103 I se dau, nu pot fi \u00een\u0163elese de c\u0103tre un copil, examinarea f\u0103c\u00e2ndu-se repede, \u00een fa\u0163a unui reprezentant al pazei.&nbsp; \u00cen prezent, Ordonan\u0163a de Guvern 1\/2000 abrog\u0103 Decretul 446\/1966, \u00eens\u0103 regulamentul de aplicare \u015fi normele metodologice la aceas\u0103 Ordonan\u0163\u0103 nu au ap\u0103rut \u00eenc\u0103, prezum\u00e2ndu-se c\u0103, p\u00e2n\u0103 la publicarea Regulamentului de aplicare a O.G. 1\/2000 sunt aplicabile vechile dispozi\u0163ii.&nbsp; <\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">O alt\u0103 etap\u0103 o reprezint\u0103 <b>sanc\u0163ionarea.<\/b><\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Articolul 100 C.P. prevede c\u0103 : \u201cfa\u0163\u0103 de minorul care r\u0103spunde penal se poate lua o m\u0103sur\u0103 educativ\u0103 sau se poate aplica o pedeaps\u0103. La alegerea sanc\u0163iunii se \u0163ine seama de gradul de pericol social al faptei s\u0103v\u00e2r\u015fite, de starea fizic\u0103, de dezvoltarea intelectual\u0103 \u015fi moral\u0103, de comportarea lui, de condi\u0163iile \u00een care a fost crescut \u015fi \u00een care a tr\u0103it \u015fi de orice alte elemente de natur\u0103 s\u0103 caracterizeze persoana minorului.&nbsp; Pedeapsa se aplic\u0103 numai dac\u0103 se apreciaz\u0103 c\u0103 luarea unei m\u0103suri educative nu este suficient\u0103 pentru \u00eendreptarea minorului.\u201d<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Datorit\u0103 faptului c\u0103 anchetele sociale nu ofer\u0103 date suficiente, iar procesul se poate judeca \u00een lipsa unor persoane care pot s\u0103 ofere aceste date (articolul 484 aliniat 4), instan\u0163a nu are datele necesare pentru a aprecia corect persoana minorului \u00een scopul aplic\u0103rii unei sanc\u0163iuni potrivite, \u00een raport cu dezvoltarea fizic\u0103, moral\u0103 \u015fi educativ\u0103 a acestuia.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Ca m\u0103suri educative, Codul Penal rom\u00e2n prevede un num\u0103r de 4 m\u0103suri, grupate c\u00e2te dou\u0103.&nbsp; Primele dou\u0103, <b>mustrarea <\/b>(prev\u0103zut\u0103 de articolul 102 C.P.) \u015fi <b>libertatea supravegheat\u0103 <\/b>(prev\u0103zut\u0103 de articolul 103 C.P.) prezint\u0103 avantajul c\u0103 nu afecteaz\u0103 starea de libertate a minorului, <\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">celelalte dou\u0103, <b>internarea \u00eentr-un centru de reeducare <\/b>(prev\u0103zut\u0103 de articolul 104 C.P.) \u015fi <b>internarea \u00eentr-un institut medical educativ <\/b>(prev\u0103zut\u0103 de articolul 105 C.P.) presupun\u00e2nd \u00eengr\u0103direa st\u0103rii de libertate a minorului.&nbsp; Al\u0103turi de aceste 4 m\u0103suri educative, articolul 109 C.P. prevede ca m\u0103suri ce pot fi aplicate minorului, \u00eenchisoarea sau amenda, cu men\u0163iunea c\u0103 limitele acestora se reduc la jum\u0103tate.&nbsp; Deasemenea, tot \u00een acest text de lege, la urm\u0103toarele aliniate se prevede c\u0103 pedepsele complementare nu se aplic\u0103 minorului, iar condamn\u0103rile pentru faptele s\u0103v\u00e2r\u015fite \u00een timpul c\u00e2t sunt minori nu atrag incapacit\u0103\u0163i sau dec\u0103deri.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Av\u00e2nd \u00een vedere c\u0103 m\u0103surile educative sunt rar aplicate, voi trata doar m\u0103surile privative de libertate, acestea necesit\u00e2nd o mai mare aten\u0163ie.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">\u00cen Rom\u00e2nia, \u00een prezent unit\u0103\u0163ile de deten\u0163ie pentru minori sunt \u00een num\u0103r de trei, toate \u00een subordinea Direc\u0163iei Generale a Penitenciarelor.&nbsp; Astfel avem o \u00eenchisoare pentru minori la Craiova \u015fi dou\u0103 centre de reeducare pentru minori, unul la Tichile\u015fti (l\u00e2ng\u0103 Br\u0103ila), cel de-al doilea la G\u0103e\u015fti (l\u00e2ng\u0103 Pite\u015fti).<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Aceste centre de reeducare pentru minori sunt de fapt unit\u0103\u0163i militare cu o structur\u0103 similar\u0103 cu cea a unui penitenciar, av\u00e2d at\u00e2t personal militar c\u00e2t \u015fi civil.&nbsp; Capacitatea acestor centre de minori este de aproximativ 2000 de locuri, \u00eens\u0103 pe l\u00e2ng\u0103 fiecare astfel de centru sunt caza\u0163i \u00een pavilioane separate, \u015fi un num\u0103r de adul\u0163i care \u00eendeplinesc anumite activit\u0103\u0163i gospod\u0103re\u015fi.&nbsp; \u00cen ceea ce prive\u015fte regimul de paz\u0103, nu exist\u0103 nici o diferen\u0163\u0103 \u00eentre centrele pentru minori \u015fi \u00eenchisori, directorul fiind civil iar loc\u0163iitorul acestuia este responsabilul cu paza.&nbsp; Pozi\u0163ionarea geografic\u0103 a celor dou\u0103 centre (distan\u0163a mare \u015fi faptul c\u0103 nu sunt pe artere principale de trafic) face dificil accesul familiilor la copii afla\u0163i \u00een aceste centre.&nbsp; Pentru eliminarea acestor neajunsuri,&nbsp; pentru minorii condamna\u0163i la pedeapsa cu \u00eenchisoarea, s-a luat m\u0103sura ca ace\u015ftia s\u0103 poat\u0103 executa pedeapsa \u015fi \u00een \u00eenchisorile pentru adul\u0163i, \u00een sec\u0163ii separate.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Spre deosebire de m\u0103sura intern\u0103rii \u00eentr-un centru de reeducare unde pedeapsa nu este determinat\u0103, ea put\u00e2nd dura p\u00e2n\u0103 la \u00eemplinirea v\u00e2rstei de 18 ani, pedeapsa cu \u00eenchisoarea se aplic\u0103 pe o perioad\u0103 determinat\u0103 de timp, prin hot\u0103r\u00e2re definitiv\u0103.&nbsp; Copilul poate beneficia de liberarea condi\u0163ionat\u0103 \u00een conformitate cu prevederile C.P.(conform articolului 59 C.P., dup\u0103 executarea a 2\/3 din pedeaps\u0103 pentru pedepsele p\u00e2n\u0103 la 10 ani).<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">\u00cen contextul celor ar\u0103tate mai sus, \u00een practic\u0103 se \u00eent\u00e2lnesc multe situa\u0163ii c\u00e2nd avoca\u0163ii copiilor solicit\u0103 aplicarea unei pedepse cu \u00eenchisoarea \u00een locul unei m\u0103suri educative, pentru ca minorul s\u0103 poat\u0103 beneficia de liberarea condi\u0163ionat\u0103, \u00een acest mod perioada de privare de libertate fiind mult mai redus\u0103 dec\u00e2t dac\u0103 i s-ar aplica o m\u0103sur\u0103 educativ\u0103 caz \u00een care ar trebui s\u0103 stea \u00een centrul de reeducare p\u00e2n\u0103 \u015fi-ar \u00eensu\u015fi un minim de preg\u0103tire \u015fcolar\u0103 sau profesional\u0103 sau cel pu\u0163in p\u00e2n\u0103 la \u00eemplinirea v\u00e2rstei de 18 ani.&nbsp; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Cu toate acestea, legisla\u0163ia rom\u00e2n\u0103 nu prevede astfel de dispozi\u0163ii referitoare la asigurarea unui tratament special adecvat necesit\u0103\u0163ilor copilului, f\u0103r\u0103 a fi nevoie s\u0103 se recurg\u0103 la procedura judiciar\u0103.&nbsp; O caracteristic\u0103 de baz\u0103 a acestor m\u0103suri privative de libertate o reprezint\u0103 durata acestora.&nbsp; Referiri la perioada de timp pentru&nbsp; care se poate aplica o m\u0103sur\u0103 educativ\u0103 sau o pedeaps\u0103 pentru un minor g\u0103sim \u00een Legea 18\/1990 unde, \u00een prevederile articolului 37 g\u0103sim : \u201c Statele p\u0103r\u0163i vor veghea ca :nici un copil s\u0103 nu fie privat de libertate \u00een mod ilegal sau arbitrar.&nbsp; Arestarea, de\u0163inerea sau \u00eentemni\u0163area unui copil trebuie s\u0103 fie conform\u0103 cu legea \u015fi nu va fi dec\u00e2t o m\u0103sur\u0103 extrem\u0103 \u015fi va fi c\u00e2t mai scurt\u0103 posibil.\u201d&nbsp; Articolul 106 C.P. prevede : \u201cM\u0103surile prev\u0103zute la articolele 104 \u015fi 105 se iau pe timp nedeterminat \u00eens\u0103 nu pot dura dec\u00e2t p\u00e2na la \u00eemplinirea v\u00e2rstei de 18 ani.&nbsp; La data c\u00e2nd minorul devine major, instan\u0163a poate dispune prelungirea intern\u0103rii pe o perioad\u0103 de cel mult 2 ani dac\u0103 aceasta este necesar\u0103 pentru realiuarea scopului intern\u0103rii.\u201d<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Aceste prevederi sunt \u00eens\u0103 \u00een contradictoriu, \u015fi, \u00een conformitate cu articolul 20 aliniat 2 din Constitu\u0163ia Rom\u00e2niei, reglement\u0103rile interna\u0163ionale la care Rom\u00e2nia este parte au prioritate fa\u0163\u0103 de legile interne \u00een caz de neconcordan\u0163\u0103, de unde reiese c\u0103 o m\u0103sur\u0103 nu poate fi aplicat\u0103 pe o perioad\u0103 de timp nedeterminat\u0103 \u00een cazul unui minor.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Cu toate acestea, \u00een practica curent\u0103, exist\u0103 cazuri de minori care au fost condamna\u0163i la v\u00e2rsta de 14 ani \u015fi \u0163inu\u0163i \u00eentr-un centru de reeducare p\u00e2n\u0103 la 18 ani (\u00een unele cazuri chiar p\u00e2n\u0103 la 20 de ani) , \u00een acest mod \u00eenc\u0103lc\u00e2ndu-se prevederile Legii 18\/1990.&nbsp; <\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">\u00cen afar\u0103 de durata m\u0103surilor, o alt\u0103 problem\u0103 o constituie condi\u0163iile de deten\u0163ie.&nbsp; Acestea sunt guvernate de principiul separ\u0103rii copiilor de adul\u0163i, principiu enun\u0163at \u015fi \u00een articolul 37 din Legea 18\/1990 care prevede c\u0103 : \u201cOrice copil privat de libertate trebuie s\u0103 fie tratat cu omenie \u015fi cu respect datorat demnit\u0103\u0163ii umane \u015fi de o manier\u0103 care s\u0103 \u0163in\u0103 seama de nevoile personale generate de v\u00e2rsta sa.&nbsp; \u00cen special, orice copil privat de libertate va fi separat de adul\u0163i, \u00een afar\u0103 de cazul \u00een care se consider\u0103 preferabil s\u0103 nu fie separa\u0163i, \u00een interesul suprem al copilului.&nbsp; Acesta are dreptul de a fi contactat de familia sa prin coresponden\u0163\u0103 \u015fi prin vizite, \u00een afara unor cazuri excep\u0163ionale.\u201d<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Acest principiu este reglementat \u015fi de Legea 23\/1969 \u00een articolul 3 unde se specific\u0103 criteriile de separa\u0163iune, precum \u015fi dreptul la intimitate, accesul la \u00eengrijire medical\u0103, accesul la hran\u0103 adecvat\u0103, la haine, la educa\u0163ie \u015fi activit\u0103\u0163i recreative, dar \u015fi accesul la familie, contactul cu lumea exterioar\u0103 \u015fi preg\u0103tirea pentru libertate. <\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">\u00cen continuare ne vom opri asupra unor <b>m\u0103suri de protec\u0163ie alternative.<\/b><\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Potrivit articolului 19 din Legea 18\/1990 :\u201dStatele p\u0103r\u0163i vor lua toate m\u0103surile legislative, administrative, sociale \u015fi educative corespunz\u0103toare pentru protejarea copilului \u00eempotriva oric\u0103ror forme de violen\u0163\u0103, v\u0103t\u0103mare sau de abuz fizic sau mental, de abandon sau de neglijen\u0163\u0103, de rele tratamente sau de exploatare, inclusiv violen\u0163\u0103 sexual\u0103, \u00een timpul c\u00e2t se afl\u0103 \u00een \u00eengrijirea p\u0103rin\u0163ilor sau a unuia dintre ei, a reprezentan\u0163ilor s\u0103i legali sau a oric\u0103rei persoane c\u0103reia I-a fost \u00eencredin\u0163at.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Aceste m\u0103suri de protec\u0163ie vor cuprinde, dup\u0103 cum se va conveni, proceduri eficiente pentru stabilirea de programe sociale viz\u00e2nd furnizarea de sprijin necesar copilului \u015fi celor c\u0103rora le-a fost \u00eencredin\u0163at precum \u015fi alte forme de prevenire, \u00een vederea identific\u0103rii, raport\u0103rii, anchet\u0103rii, trat\u0103rii \u015fi urm\u0103ririi pentru cazurile de rele tratamente aplicabile minorului descrise mai sus \u015fi vor cuprinde, deasemenea, \u015fi proceduri de interven\u0163ie judiciar\u0103.\u201d<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Practica \u00eens\u0103 ne consemneaz\u0103 c\u0103 nu exist\u0103 nici un program de reabilitare social\u0103 pentru ace\u015fti copii, care s\u0103 se poat\u0103 m\u0103car compara cu programele din str\u0103in\u0103tate, \u015fi care acolo sunt normale ; faptul c\u0103 exist\u0103 numai aceste forme de reeducare denot\u0103 o atitudine fa\u0163\u0103 de copilul delincvent prin faptul c\u0103 a comis o infrac\u0163iune sau este suspect, nu mai este protejat, din momentul \u00een care a dovedit c\u0103 este r\u0103u el nemaibeneficiind de nimic ; atitudinea fa\u0163\u0103 de copii infractori este mai dur\u0103 fa\u0163\u0103 de adul\u0163ii infractori.&nbsp; \u00cen Rom\u00e2nia, tinerii nu se bucur\u0103 de respect din partea adul\u0163ilor \u015fi, cu at\u00e2t mai mult c\u00e2nd copilul este suspect de o infrac\u0163iune el \u00ee\u015fi pierde \u015fi ultima pic\u0103tur\u0103 de respect.&nbsp; Paradoxal este faptul c\u0103 cel care hot\u0103r\u0103\u015fte unde ajunge minorul suspect de infrac\u0163iune este agentul constatator (poli\u0163istul de teren).&nbsp; Acest lucru genereaz\u0103 o serie de \u00eentreb\u0103ri de genul : Sunt ei oare preg\u0103ti\u0163i s\u0103 r\u0103spund\u0103 de soarta unui copil?, Sunt ei oare abilita\u0163i de lege s\u0103 fac\u0103 lucrul acesta ? \u00cen cazul \u00een care experien\u0163ele lui \u00een leg\u0103tur\u0103 cu institu\u0163iile statului sunt dominate de arbitrar \u015fi violen\u0163\u0103 acesta va \u00eenv\u0103\u0163a odat\u0103 pentru totdeauna c\u0103 statul este violent.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; <\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">\u00cen concluzie, practica ne arat\u0103 c\u0103 minorii interna\u0163i \u00een centrele de reeducare \u015fi pu\u015fc\u0103riile pentru minori se confrunt\u0103 de foarte multe ori cu grave \u00eenc\u0103lc\u0103ri ale drepturilor lor, exost\u00e2nd posibilitatea ca cineva s\u0103 r\u0103m\u00e2n\u0103 \u00een custodie foarte mult timp p\u00e2n\u0103 la pronun\u0163area pedepsei.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Pe l\u00e2ng\u0103 toate aceste aspecte anterior enun\u0163ate, mai exist\u0103 \u015fi problema economic\u0103 a ineficien\u0163ei acestor m\u0103suri, privarea de libertate fiind foarte costisitoare \u015fi foarte pu\u0163in eficient\u0103 la o analiz\u0103 cost\/beneficiu.&nbsp; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Aceste centre nu se deosebesc de o \u00eenchisoare, fiind institu\u0163ii militarizate, cu paz\u0103 continu\u0103, 24\/24 de ore, cu gratii la ferestre, deplasarea minorilor \u00eentr-un astfel de centru fiind posibil\u0103 doar cu \u00eenso\u0163itor, dormitoarele sunt la comun, copii sunt \u00eenchi\u015fi pe timpul nop\u0163ii iar \u00een ceea ce prive\u015fte alimenta\u0163ia , nu exist\u0103 prevederi referitoare la o hran\u0103 adecvat\u0103, necesar\u0103 copilului, lucru ce este \u00eens\u0103 posibil \u0103n cadrul unei unit\u0103\u0163i penitenciare (unde de\u0163inu\u0163ii minori se pot bucura de anumite avantaje) etc.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Un alt dezavantaj prezentat de militarizarea acestor institu\u0163ii \u00eel reprezint\u0103 faptul c\u0103 personalul nu se poate adapta la fluctua\u0163ia problematicii minorilor \u015fi nu este instruit \u00een acest sens.&nbsp; <\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Care este atunci scopul m\u0103surii educative ?<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Cum se poate realiza acest scop ?<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Cum se poate educa, reeduca un minor \u00eentr-o \u00eenchisoare ?<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">\u00cen baza Decretului 575\/1972 (art.21.), \u00een cazul \u00een care un minor internat \u00eentr-un C.R.M. fuge din \u00eenstitu\u0163ie, aceasta constituie abatere disciplinar\u0103 \u015fi se sanc\u0163ioneaz\u0103 cu separarea \u00een sec\u0163ii cu regim restrictiv, asta \u00een condi\u0163iile \u00een care, pentru un minor ce execut\u0103 pedeapsa cu \u00eenchisoarea, fuga din aceast\u0103 institu\u0163ie constituie infrac\u0163iunea de evadare \u015fi se sanc\u0163ioneaz\u0103 \u00een condi\u0163iile art.269 C.P. ca infrac\u0163iune de sine st\u0103t\u0103toare.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">\u00cen cazul \u00een care un copil fuge dintr-un C.R.M., nu se poate trage foc de arm\u0103 pentru a-l \u00eempiedica, lucru ce este \u00eens\u0103 posibil \u00een cazul unui copil ce execut\u0103 pedeapsa \u00een \u00eenchisoare.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Acest aspect poate crea probleme \u00een cadrul Penitenciarului pentru Tineri de la Craiova unde sunt \u015fi minori interna\u0163i \u00een baza art.104 C.P., iar \u00een cazul \u00een care unul dintre ace\u015ftia fuge ori \u00eencearc\u0103 s\u0103 fug\u0103, cei ce asigur\u0103 paza locului de de\u0163inere nu au de unde s\u0103 cunoasc\u0103 dac\u0103 acesta execut\u0103 o pedeaps\u0103 privativ\u0103 de libertate ori o m\u0103sur\u0103 educativ\u0103, pentru a folosi sau nu focul de arm\u0103.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">O alt\u0103 diferen\u0163\u0103 \u00eentre regimurile ce se aplic\u0103 copiilor interna\u0163i \u00een aceste centre vis-\u00e0-vis de regimul aplicat celor din \u00eenchisori este aceea c\u0103, \u00een cazul \u00een care dau dovezi temeinice de \u00eendreptare, au o comportare bun\u0103, au rezultate bune la \u00eenv\u0103\u0163\u0103tur\u0103 \u015fi sunt st\u0103ruitori \u00een munc\u0103, li se pot acorda ca drept recompense, \u00eenvoiri \u00een perioada vacan\u0163elor \u015fcolare pentru a-\u015fi vizita familiile (art.22 alin.1, lit .f&nbsp; din Decretul 545\/72 ), lucru ce nu este posibil \u00een cazul copiilor de\u0163inu\u0163i \u00een penitenciare.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">\u00cen leg\u0103tur\u0103 cu educa\u0163ia \u00een Centrele de Reeducare a Minorilor . \u00cen aceste institu\u0163ii, minorii sunt repartiza\u0163i pe clase, \u00een func\u0163ie de preg\u0103tirea pe care o au ace\u015ftia.&nbsp; Acest fapt prezint\u0103 \u00eens\u0103 dezavantajul c\u0103 \u00een aceea\u015fi clas\u0103 pot fi \u00eent\u00e2lni\u0163i copii cu v\u00eerste cuprinse \u00eentre 14 \u015fi 18 ani, unii foarte dezvolta\u0163i din punct de vedere fizic, lucru ce conduce \u00een mod inevitabil la alterca\u0163ii, av\u00e2nd loc abuzuri.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify; text-indent: 0cm;\"><span lang=\"RO\" style=\"font-family: Wingdings; font-size: 12pt;\">v<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"RO\" style=\"font-size: 12pt;\">Art.8(2)- \u201c\u00een \u015fcolile \u015fi cursurile din cadrul centrelor de reeducare, clasele sunt formate di 15-20 elevi, fiecare clas\u0103 av\u00e2nd c\u00e2te un educator.\u201d<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt 53.45pt; text-align: justify; text-indent: 0cm;\"><span lang=\"RO\" style=\"font-family: Wingdings; font-size: 12pt;\">v<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"RO\" style=\"font-size: 12pt;\">Art.12- \u201cplanurile de \u00eenv\u0103\u0163\u0103m\u00e2nt \u015fi programele \u015fcolare pentru \u00eenv\u0103m\u00e2ntul general obligatoriu la cursurile de zi, precum \u015fi \u00eenv\u0103\u0163\u0103m\u00e2ntul profesional, vor fi cele ale \u015fcolilor sau cursurilor similare.&nbsp; Planurile de \u00eenv\u0103\u0163\u0103m\u00e2nt \u015fi programele \u015fcolare pentru \u00eenv\u0103\u0163\u0103m\u00e2ntul general obligatoriu la cursurile serale \u015fi f\u0103r\u0103 frecven\u0163\u0103, precum \u015fi planurile de \u00eenv\u0103\u0163\u0103m\u00e2nt \u015fi programele \u015fcolare pentru cursurile de calificare, se vor elabora de Ministerul de Justi\u0163ie, cu consultarea Ministerului Educa\u0163iei \u015fi \u00cenv\u0103\u0163\u0103m\u00e2ntului.\u201d<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Din aceste prevederi tragem concluzia c\u0103 \u00een centrele de reeducare activeaz\u0103 educatori care efectueaz\u0103 preg\u0103tirea \u015fcolar\u0103 \u015fi nu numai, a minorilor care execut\u0103 o m\u0103sur\u0103 educativ\u0103 \u00eentr-un centru de reeducare.&nbsp; Ace\u015fti educatori sunt profesori sau \u00eenv\u0103\u0163\u0103tori \u00eentr-o \u015fcoal\u0103 obi\u015fnuit\u0103, care desf\u0103\u015foar\u0103 ore de alfabetizare sau ore dup\u0103 programa general\u0103 de \u00eenv\u0103\u0163\u0103m\u00e2nt. <\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Av\u00e2ndu-se \u00een vedere c\u0103 ace\u015fti copii reprezint\u0103 totu\u015fi o categorie aparte, ar fi de preferat ca de educarea lor s\u0103 se ocupe \u015fi persoane specializate, cu aptitudini sociale \u015fi preg\u0103tire special\u0103, buni pedagogi. \u00cen sprijinul acestei afirma\u0163ii aduc ca argument faptul c\u0103 tinerii delicven\u0163i nu beneficiaz\u0103 de o evaluare psihologic\u0103 \u015fi pedagogic\u0103 corespunz\u0103toare \u015fi nici de un curriculum educa\u0163ional adecvat nevoilor \u015fi posibilit\u0103\u0163ilor lor.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">De\u015fi \u00een articolul 5 al Decretului 545\/72 este stipulat c\u0103 centrele de reeducare au ca drept scop reeducarea acestor copii, \u00een realitate, func\u0163ia custodial\u0103 are prioritate, iar cea de educare \u015fi reeducare este subsidiar\u0103 acesteia.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Acest lucru \u00eel putem observa \u015fi dac\u0103 studiem Regulamentul de Ordine Interioar\u0103 al \u00cenchisorii pentru Tineri-Craiova, unde g\u0103sim programul unei zile \u00een acest a\u015fez\u0103m\u00e2nt .&nbsp; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Conex\u0103 cu aceste probleme este \u015fi cea ridicat\u0103 de \u00eenregistrarea \u015fi depunerea unor pl\u00e2ngeri, ignoran\u0163a de\u0163inu\u0163ilor fiind uneori \u00eencurajat\u0103 de c\u0103tre administra\u0163ia \u00eenchisorii, alte ori pl\u00e2ngerile pierz\u00e2ndu-se \u00een h\u0103\u0163i\u015ful administrativ.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt;\">Aceste probleme sunt accentuate \u015fi de faptul c\u0103 func\u0163ionarea&nbsp; acestor spa\u0163ii de deten\u0163ie pentru minori se face \u00een baza unor acte normative \u015fi legi din anii \u201960 \u015fi nici nu exist\u0103 preocup\u0103ri de aliniere a legisla\u0163iei respective la nevoile \u015fi condi\u0163iile actuale.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"margin: 0cm 14.2pt 0.0001pt;
