{"id":20119,"date":"2011-03-08T13:08:00","date_gmt":"2011-03-08T13:08:00","guid":{"rendered":"http:\/\/trainingsnews.com\/ipoteca-2"},"modified":"2011-03-08T13:08:00","modified_gmt":"2011-03-08T13:08:00","slug":"ipoteca-2","status":"publish","type":"post","link":"https:\/\/cvnextjob.com\/index.php\/2011\/03\/08\/ipoteca-2\/","title":{"rendered":"Ipoteca"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><div style=\"text-align: justify;\"><span lang=\"EN-US\" style=\"font-size: 11pt;\">1)ipoteca este o garantie reala, servind la garantarea obligatiilor unui debitor fata de creditorul sau, printr-un bun imobil din propriul sau patrimoniu, anume desemnat pe cale legala in acest scop (ipoteca nu presupune deposedarea debitorului de imobil)<\/span><br \/>\n<span lang=\"EN-US\" style=\"font-size: 11pt;\">2)sintetic, ipoteca este o garantie reala, imobiliara, constand dintr-un drept real accesoriu asupra unui imobil al debitorului.<\/span><\/div>\n<div style=\"text-align: justify;\"><b><span lang=\"EN-US\" style=\"font-size: 11pt;\">CONDITII <\/span><\/b><\/div>\n<div style=\"margin-left: 36pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\" style=\"font-size: 11pt;\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"EN-US\" style=\"font-size: 11pt;\">ipoteca nu va putea fi constituita decat prin act autentic.<\/span><\/div>\n<div style=\"margin-left: 36pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\" style=\"font-size: 11pt;\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"EN-US\" style=\"font-size: 11pt;\">inscriptiile ipotecare se fac la judecatoria in a carei raza teritoriala sunt situate imobilele ipotecate.<\/span><\/div>\n<div style=\"margin-left: 36pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\" style=\"font-size: 11pt;\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"EN-US\" style=\"font-size: 11pt;\">pot fi ipotecate numai imobilele (care se afla in circuitul civil) impreuna cu accesoriile lor care sunt imobile prin destinatie, precum si uzufructul asupra unor imobile.<\/span><\/div>\n<div style=\"margin-left: 36pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\" style=\"font-size: 11pt;\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"EN-US\" style=\"font-size: 11pt;\">ipoteca trebuie sa fie specializata sub un dublu aspect:<\/span><\/div>\n<div style=\"margin-left: 72pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\" style=\"font-family: Wingdings; font-size: 11pt;\">\u00d8<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"EN-US\" style=\"font-size: 11pt;\">sa fie determinata cu privire la imobilul afectat.<\/span><\/div>\n<div style=\"margin-left: 72pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\" style=\"font-family: Wingdings; font-size: 11pt;\">\u00d8<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"EN-US\" style=\"font-size: 11pt;\">sa fie determinata in ceea ce priveste valoarea creantei.<\/span><\/div>\n<div style=\"margin-left: 36pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\" style=\"font-size: 11pt;\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"EN-US\" style=\"font-size: 11pt;\">conditii privind persoana constituientului:<\/span><\/div>\n<div style=\"margin-left: 72pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\" style=\"font-family: Wingdings; font-size: 11pt;\">\u00d8<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"EN-US\" style=\"font-size: 11pt;\">cel ce o constituie trebuie sa aiba capacitatea deplina de exercitiu.<\/span><\/div>\n<div style=\"margin-left: 72pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\" style=\"font-family: Wingdings; font-size: 11pt;\">\u00d8<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"EN-US\" style=\"font-size: 11pt;\">cel ce o constituie trebuie sa aiba calitatea de proprietar actual al imobilului ce se ipotecheaza. Bunurile viitoare ale debitorului nu pot forma obiectul unei ipoteci. Iar, daca dreptul de proprietate al constituientului este sub conditie suspensiva sau rezolutorie, aceeasi conditie va afecta si ipoteca. Deasemenea, nu se pot ipoteca bunurile altuia, indiferent daca acestea apartin persoanelor fizice sau juridice, decat cu consimtamantul lor expres.<\/span><\/div>\n<div style=\"margin-left: 36pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\" style=\"font-size: 11pt;\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"EN-US\" style=\"font-size: 11pt;\">conditii de forma:<\/span><\/div>\n<div style=\"margin-left: 72pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\" style=\"font-family: Wingdings; font-size: 11pt;\">\u00d8<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"EN-US\" style=\"font-size: 11pt;\">contractul de ipoteca este un contract solemn, ipoteca trebuind sa fie incheiata prin inscris autentic.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"margin-left: 36pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\" style=\"font-size: 11pt;\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"EN-US\" style=\"font-size: 11pt;\">conditii de publicitate:<\/span><\/div>\n<div style=\"margin-left: 72pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\" style=\"font-family: Wingdings; font-size: 11pt;\">\u00d8<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"EN-US\" style=\"font-size: 11pt;\">acestea nu tin de caracterul solemn al contractului de ipoteca, ci numai de asigurarea opozabilitatii si a rangului de preferinta ale ipotecii.<\/span><\/div>\n<div style=\"margin-left: 72pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\" style=\"font-family: Wingdings; font-size: 11pt;\">\u00d8<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"EN-US\" style=\"font-size: 11pt;\">publicitatea consta in inscrierea ipotecii in cartea funciara de la judecatoria din raza teritoriala a caruia se afla situat imobilul, astfel: partile incheie un contract de ipoteca dupa care se prezinta cu acesta la notariat personal (sau prin mandatari cu procura speciala si autentica). Pe baza actelor autentificate, a unei cereri si a unei taxe de timbru judiciar judecatorul delegat cu tinerea cadastrului va dispune (binenteles, dupa verificarea actelor) prin incheiere inscrierea ipotecii in registrul de carte funciara.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\"><b><span lang=\"EN-US\" style=\"font-size: 11pt;\">EFECTE<\/span><\/b><\/div>\n<div style=\"margin-left: 36pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\" style=\"font-size: 11pt;\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"EN-US\" style=\"font-size: 11pt;\">se constituie un drept de creanta a creditorului numai asupra bunurilor imobile (sau imobile prin destinatie) ale debitorului.<\/span><\/div>\n<div class=\"MsoBodyText\" style=\"margin-left: 36pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\" style=\"font-family: Wingdings; font-size: 11pt;\">\u00d8<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"EN-US\" style=\"font-size: 11pt;\">are dreptul sa culeaga fructele ca orice proprietar.<\/span><\/div>\n<div class=\"MsoBodyText\" style=\"margin-left: 72pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\" style=\"font-family: Wingdings; font-size: 11pt;\">\u00d8<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"EN-US\" style=\"font-size: 11pt;\">are dreptul de a instraina imobilul ipotecat, dar, in acest caz, imobilul se va stramuta catre noul dobanditor, grevat de ipoteca constituita asupra lui.<\/span><\/div>\n<div style=\"margin-left: 36pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\" style=\"font-size: 11pt;\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"EN-US\" style=\"font-size: 11pt;\">in raport cu creditorul:<\/span><\/div>\n<div style=\"margin-left: 72pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\" style=\"font-family: Wingdings; font-size: 11pt;\">\u00d8<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"EN-US\" style=\"font-size: 11pt;\">are un drept de urmarire a imobilului in mana oricui s-ar afla.<\/span><\/div>\n<div style=\"margin-left: 72pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\" style=\"font-family: Wingdings; font-size: 11pt;\">\u00d8<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"EN-US\" style=\"font-size: 11pt;\">are un drept de preferinta fata de ceilalti creditori (luandu-se in calcul rangul ipotecii).<\/span><\/div>\n<div style=\"margin-left: 36pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\" style=\"font-size: 11pt;\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"EN-US\" style=\"font-size: 11pt;\">in raport cu tertii dobanditori ai imobilului ipotecat:<\/span><\/div>\n<div style=\"margin-left: 72pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\" style=\"font-family: Wingdings; font-size: 11pt;\">\u00d8<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"EN-US\" style=\"font-size: 11pt;\">fata de acestia, ipoteca nu constituie o indisponibilizare, ei putand achizitiona imobilul ipotecat sub conditia de a-l prelua cu tot cu sarcina ce-l greveaza.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\"><b><span lang=\"EN-US\" style=\"font-size: 11pt;\">ACTE CE TREBUIESC VERIFICATE<\/span><\/b><\/div>\n<div style=\"margin-left: 36pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\" style=\"font-size: 11pt;\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"EN-US\" style=\"font-size: 11pt;\">se va verifica cine este\/sunt proprietarul\/-rii precum si titlul de proprietate asupra imobilului ce se doreste a fi ipotecat. Se va prezenta titlul de proprietate in original precum si dovada transcrierii acestuia in cadastrul de carte funciara.<\/span><\/div>\n<div style=\"margin-left: 36pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\" style=\"font-size: 11pt;\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"EN-US\" style=\"font-size: 11pt;\">se va verifica daca reprezentantul persoanei juridice are imputernicire expresa sau sunt mandatari cu procura autentica pentru a constitui ipoteca.<\/span><\/div>\n<div style=\"margin-left: 36pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\" style=\"font-size: 11pt;\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"EN-US\" style=\"font-size: 11pt;\">se va urmari existenta aprobarii adunarii generale (sau a consiliului de administratie) pentru ipotecarea bunurilor respective, daca in actele constitutive ale societatii nu se prevede altfel.<\/span><\/div>\n<div style=\"margin-left: 36pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\" style=\"font-size: 11pt;\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"EN-US\" style=\"font-size: 11pt;\">se va urmari daca taxele si impozitele aferente bunului imobil sunt achitate la zi si daca acesta este liber de orice sarcini.<\/span><\/div>\n<div style=\"margin-left: 18pt; text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\"><b><span lang=\"EN-US\" style=\"font-size: 11pt;\">AVANTAJE<\/span><\/b><\/div>\n<div style=\"margin-left: 36pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\" style=\"font-size: 11pt;\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"EN-US\" style=\"font-size: 11pt;\">creditorul ipotecar are dreptul de a urmari imobilul ipotecat in mana oricui s-ar gasi acesta.<\/span><\/div>\n<div style=\"margin-left: 36pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\" style=\"font-size: 11pt;\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"EN-US\" style=\"font-size: 11pt;\">in caz de executare silita, faliment, etc creditorii ipotecari sunt preferati celor chirografari, iar cei de rangul I creditorilor cu inscriptii ulterioare.<\/span><\/div>\n<div style=\"margin-left: 36pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\" style=\"font-size: 11pt;\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"EN-US\" style=\"font-size: 11pt;\">inscriptiile ipotecare conserva dreptul de privilegiu si de ipoteca&nbsp; in curs de 15 ani din ziua in care s-au facut inscriptiile (dupa aceasta data efectul lor incetand daca nu au fost prelungite \u2013 pentru ca inscriptia reinnoita sa-si pastreze rangul initial, este necesar sa se indice inscriptia primitiva).<\/span><\/div>\n<div style=\"margin-left: 36pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\" style=\"font-size: 11pt;\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"EN-US\" style=\"font-size: 11pt;\">ipoteca continua sa existe asupra intregului imobil, chiar daca a fost platita o parte din datorie&nbsp; si chiar daca, in caz de partaj a unui imobil ipotecat, imobilul trece in lotul unuia dintre copartasi (acesta va trebui sa suporte urmarirea pentru intreaga datorie, intrucat garantia este incorporata in imobil).<\/span><\/div>\n<div style=\"margin-left: 36pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\" style=\"font-size: 11pt;\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"EN-US\" style=\"font-size: 11pt;\">la scadenta daca debitorul nu onoreaza creanta, creditorul poate cere executarea silita (in cf. cu OG nr.11\/1996 (cu toate modificarile sale) privind executarea creantelor bugetare).<\/span><\/div>\n<div style=\"margin-left: 36pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\" style=\"font-size: 11pt;\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"EN-US\" style=\"font-size: 11pt;\">cheltuielile privind inregistrarea si asigurarea&nbsp; imobilului ipotecat&nbsp; sunt in sarcina debitorului (imprumutatului).<\/span><\/div>\n<div style=\"margin-left: 18pt; text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\"><b><span lang=\"EN-US\" style=\"font-size: 11pt;\">RISCURI\/DEZAVANTAJE<\/span><\/b><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div class=\"MsoBodyText\" style=\"margin-left: 36pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\" style=\"font-size: 11pt;\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"EN-US\" style=\"font-size: 11pt;\">fiind o obligatie accesorie obligatiei principale garantate, ipoteca are aceeasi soarta ca si principalul \u2013 \u201caccesorium sequitur principale\u201d (accesoriul urmeaza principalul).
