{"id":20065,"date":"2011-03-27T16:16:00","date_gmt":"2011-03-27T16:16:00","guid":{"rendered":"http:\/\/trainingsnews.com\/prezentarea-de-asamblu-principiilor-de-2"},"modified":"2011-03-27T16:16:00","modified_gmt":"2011-03-27T16:16:00","slug":"prezentarea-de-asamblu-principiilor-de-2","status":"publish","type":"post","link":"https:\/\/cvnextjob.com\/index.php\/2011\/03\/27\/prezentarea-de-asamblu-principiilor-de-2\/","title":{"rendered":"Prezentarea de asamblu a principiilor de organizare \u015fi func\u0163ionare a administra\u0163iei publice."},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><div class=\"NormalWeb2\" style=\"margin-left: 0in; text-align: justify;\"><span lang=\"RO\">Principiile de organizare \u015fi func\u0163ionare a administra\u0163iei publice locale au o importan\u0163\u0103 deodebit\u0103 \u00een configurarea structurii organizatorice \u015fi func\u0163ionale a autorit\u0103\u0163ilor publice locale, motiv pentru care ele sunt reglementate la nivel constitu\u0163ional \u00een felul urm\u0103tor: <\/span><span lang=\"FR\">\u201c <i>Administra\u0163ia public\u0103 din unit\u0103\u0163ile administrativ \u2013 teritoriale se \u00eentemeiaz\u0103 pe principiul autonomiei locale \u015fi pe cel al descentraliz\u0103rii servicilor publice\u201d.<\/i><\/span><span lang=\"FR\"> <\/span><span lang=\"FR\">Pentru \u00een\u0163elegerea sistemului promovat de Constitu\u0163ia Rom\u00e2niei \u00een organizarea \u015fi func\u0163ionarea administra\u0163iei publice, ar\u0103t\u0103m c\u0103 se cunosc dou\u0103 modalit\u0103\u0163i principale de organizare administrativ\u0103&nbsp;: organizarea centralizat\u0103 \u015fi cea descentralizat\u0103 la care se adaug\u0103 un sistem intermediar&nbsp; \u015fi secundar, respectiv organizarea desconcentrat\u0103.<\/span><span lang=\"FR\"> <\/span>\u00cen cadrul <i>centralizarii<\/i>, statul \u00ee\u015fi asum\u0103 singur sarcina administr\u0103rii ( a realiz\u0103rii func\u0163iei executive), dispun\u00e2nd de o structur\u0103 organizatoric\u0103 ce promoveaz\u0103 cu prioritate interesul general. Un alt element definitoriu pentru organizarea centralizat\u0103, este&nbsp; acela al puterii ierarhice, definit\u0103 ca un raport \u00een cadrul c\u0103ruia \u015frful este \u00een m\u0103sur\u0103 s\u0103 se impun\u0103 subordona\u0163ilor s\u0103i. <span lang=\"FR\">\u00cen cazul <i>descentraliz\u0103rii<\/i>, statul nu \u00ee\u015fi&nbsp; asum\u0103 singur sarcina administr\u0103rii, ci o \u00eemparte, \u00een anumite cote, cu alte categorii de persoane, cum sunt colectivit\u0103\u0163ile locale.<\/span><span lang=\"FR\"> <\/span><span lang=\"FR\">Sistemul descentraliz\u0103rii \u00eenlocuie\u015fte puterea ierarhic\u0103 \u2013 specific\u0103 centraliz\u0103rii \u2013 cu controlul administrativ de legalitate.<\/span><span lang=\"FR\"> <\/span><span lang=\"FR\">Desconcentrarea administrativ\u0103 este considerat\u0103 ca fiind o form\u0103 intermediar\u0103 \u00eentre organizarea centralizat\u0103 \u015fi cea descantralizat\u0103, caracterizat\u0103 fiind \u201c<i>printr-o oarecare independen\u0163\u0103, bine\u00een\u0163eles formal\u0103, a organelor locale \u00een fruntea c\u0103rora sunt func\u0163ionarii numi\u0163i de organele centrale\u201d <\/i><\/span><span lang=\"FR\">&nbsp;<\/span><span lang=\"FR\">Principiul autonomiei locale<\/span><span lang=\"FR\"> \u2013 fundament al organiz\u0103rii \u015fi func\u0163ion\u0103rii administra\u0163iei publice locale.<\/span><span lang=\"FR\"> <\/span><span lang=\"FR\">\u201c<i>Prin principii \u00een domeniul dreptului \u00een\u0163elegem at\u00e2t un fundament al sistemului de drept, c\u00e2t \u015fi o modalitate de coordonare a normelor juridice \u00een jurul unei idei c\u0103l\u0103uzitoare<\/i>\u2019\u2019.<\/span><span lang=\"FR\"> <\/span><span lang=\"FR\">Pornind de la defini\u0163ia legal\u0103 a acestui principiu \u015fi de la analiza con\u0163inutului Legii Administra\u0163iei publice locale \u00een corela\u0163ie cu dispozi\u0163iile constitu\u0163ionale \u015fi cu documentele interne\u0163ionale semnate de Rom\u00e2nia, \u00een doctrin\u0103 s\u00e2a ar\u0103tat c\u0103, din punct de vedere structural, principiul autonomiei locale este compus din trei elemente&nbsp;: <i>organizatoric, func\u0163ional, gestionar.<\/i><\/span><span lang=\"FR\"> <\/span><span lang=\"FR\">Din punct de vedere <i>organizatoric <\/i>autonomia local\u0103 se manifest\u0103 prin alegerea autorit\u0103\u0163ilor administra\u0163iei publice locale de c\u0103tre popula\u0163ia cu drept de vot care domiciliaz\u0103 \u00een unitatea administrativ \u2013 teritorial\u0103 respectiv\u0103, prin posibilitatea recunoscut\u0103 consiliilor locale de a adopta statutul localit\u0103\u0163ii, organigramele \u015fi num\u0103rul de personal, a orgamiz\u0103rii serviciilor publice locale \u015fi a \u00eenfin\u0163\u0103rii persoanelor de drept public \u015fi privat.<\/span><span lang=\"FR\"> <\/span><i><span lang=\"FR\">Func\u0163ional<\/span><\/i><span lang=\"FR\"> autonomia local\u0103 presupune determinarea atribu\u0163iilor autorit\u00ee\u0163iilor locale prin consacrarea plenitudinii de competen\u0163\u0103 \u00een solu\u0163ionarea problemelor de interes local \u0163i exclude ingerin\u0163a&nbsp; altor autorit\u0103\u0163i.<\/span><span lang=\"FR\"> <\/span><i><span lang=\"FR\">Gestionar<\/span><\/i><span lang=\"FR\">, autonomia local\u0103 vizeaz\u0103 competen\u0163a autorit\u0103\u0163ilor locale de a utiliza patrimoniul persoanei juridice, respectiv a unit\u0103\u0163ii administrativ \u2013 teritoriale, \u00een conformitate cu interenul cet\u0103\u0163enilor.<\/span><span lang=\"FR\"> <\/span><span lang=\"RO\">Alte principii ale administra\u0163iei publice locale &#8211;
