Conform Constitu\u0163iei Republicii Moldova<span class=\"MsoFootnoteReference\"><span class=\"MsoFootnoteReference\"><span lang=\"RO\" style=\"font-family: &quot;Times New Roman&quot;; font-size: 12pt;\"><\/span><\/span><\/span> administra\u0163ia local\u0103 \u0163ine s\u0103 fie realizat\u0103 prin voin\u0163a poporului, exercit\u0103 prin forme ale democra\u0163iei directe \u015fi reprezentative, adic\u0103 prin participarea popula\u0163iei la discutarea \u015fi rezolvarea celor mai importante problem, alegerea organelor reprezentative, participarea la rezolvarea hot\u0103r\u00e2rilor adoptate \u015fi exercitarea controlului asupra activit\u0103\u0163ii organelor administr\u0103rii locale. Administra\u0163ia public\u0103 local\u0103 ofer\u0103 infrastructura fizic\u0103 \u015fi politic\u0103 care sprijin\u0103 eforturile comunit\u0103\u0163ii \u015fi cet\u0103\u0163enilor \u00een domeniul economic, politic, social \u015fi cultural. Rolul administra\u0163iei publice locale se schimb\u0103 \u015fi va continua s\u0103 se schimbe pe m\u0103sur\u0103 ce problemele economice \u015fi sociale pe care le \u00eent\u00e2mpin\u0103 continu\u0103 s\u0103 creasc\u0103. Conform Legii privind organizarea administrativ-teritorial\u0103 a Republicii Moldova, art. 4 (1) \u201cTeritoriul Republicii Moldova este organizat sub aspect administrativ de jude\u0163e, ora\u015fe \u015fi sate. Organizarea administrativ\u0103 a teritoriului Republicii Moldova se efectueaz\u0103 pe dou\u0103 niveluri: satele (comunele) \u015fi ora\u015fele (municipiile) constituie primul nivel, iar jude\u0163ele, unitatea teritorial\u0103 autonom\u0103 G\u0103g\u0103uzia \u015fi municipiul Chi\u015fin\u0103u constituie nivelul al doilea\u201d.<span class=\"MsoFootnoteReference\"><span class=\"MsoFootnoteReference\"><span lang=\"RO\" style=\"font-family: &quot;Times New Roman&quot;; font-size: 12pt;\"><\/span><\/span><\/span><\/span><\/div>\n<div style=\"line-height: 150%; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Satul este o unitate administrativ teritorial\u0103 care cuprinde popula\u0163ia rural\u0103 unit\u0103 prin teritoriu, condi\u0163iile geografice, rela\u0163ii economice, social-culturale, tradi\u0163ii \u015fi obiceiuri. Dou\u0103 sau mai multe sate se pot uni, form\u00e2nd o singur\u0103 unitate administrativ-teritorial\u0103 numit\u0103 comun\u0103.<\/span><\/div>\n<div>\n<\/div>\n<div style=\"text-indent: 0.5in;\">\n<\/div>\n<div style=\"line-height: 150%; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Municipiul este o localitate de tip urban cu rol deosebit \u00een via\u0163a economic\u0103, social-cultural\u0103, \u015ftiin\u0163ific\u0103, politic\u0103, \u015fi administrativ\u0103 a republicii, cu importante structuri edilitar-gospod\u0103re\u015fti \u015fi unit\u0103\u0163i din domeniul \u00eenv\u0103\u0163\u0103m\u00e2ntului, ocrotirii s\u0103n\u0103t\u0103\u0163ii \u015fi culturii.<\/span><\/div>\n<div style=\"line-height: 150%; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Jude\u0163ul este o unitate administrativ-teritorial\u0103 alc\u0103tuit\u0103 din sate (comune) \u015fi ora\u015fe (municipii) \u015fi reprezint\u0103 denumirea unit\u0103\u0163ii administrativ-teritoriale de nivelul doi.<\/span><\/div>\n<div style=\"line-height: 150%; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Unit\u0103\u0163ile administrativ-teritoriale au personalitate juridic\u0103, dispun de patrimoniu, beneficiaz\u0103 de autonomie financiar\u0103, au dreptul la ini\u0163iativ\u0103 \u00een tot ceea ce prive\u015fte administrarea treburilor publice locale, exercit\u00e2ndu-\u015fi \u00een condi\u0163iile legii, autoritatea \u00een limitele administrativ-teritoriale stabilite.<\/span><\/div>\n<div style=\"line-height: 150%; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Autorit\u0103\u0163i ale administra\u0163iei publice, prin care se realizeaz\u0103 autonomia local\u0103 \u00een sate (comune), ora\u015fe (municipii) sunt consiliile locale, ca autorit\u0103\u0163i deliberative, \u015fi primarii, ca autorit\u0103\u0163i executive. Consiliile locale \u015fi primarii se aleg conform codului electoral, Consiliile locale \u015fi primarii func\u0163ioneaz\u0103 ca autorit\u0103\u0163i administrative autonome \u015fi gestioneaz\u0103 treburile publice din sate (comune), ora\u015fe (municipii) \u00een condi\u0163iile Legii.<\/span><\/div>\n<div style=\"line-height: 150%; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">\u00cen fiecare jude\u0163 \u015fi municipiul Chi\u015fin\u0103u este un consiliu, ca autoritate deliberativ\u0103 a administra\u0163iei publice, care coordoneaz\u0103 activitatea consiliilor locale \u00een vederea realiz\u0103rii serviciilor publice de interes jude\u0163ean sau, respectiv, municipal. \u00cen executarea atribu\u0163iilor lor, autorit\u0103\u0163ile administra\u0163iei publice locale dispun de autonomie consfin\u0163it\u0103 \u015fi garantat\u0103 de Legea suprem\u0103 a Republicii \u015fi alte legi.<\/span><\/div>\n<div style=\"line-height: 150%; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Pentru asigurarea autonomiei locale, autorit\u0103\u0163ile administra\u0163iei publice locale elaboreaz\u0103 \u015fi aprob\u0103 bugetele unit\u0103\u0163ilor administrativ-teritoriale \u015fi au dreptul s\u0103 instituie impozite \u015fi taxe locale, \u00een condi\u0163iile legii, deoarece o adev\u0103rat\u0103 autonomie local\u0103 nu poate exista f\u0103r\u0103 o autonomie financiar\u0103, care ar cuprinde o serie de principii reglementare prin acte juridice normative.<\/span><\/div>\n<div style=\"line-height: 150%; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">\u00cen Cartea European\u0103&nbsp; \u201cExerci\u0163iul autonom al puterii locale\u201d (art. 9)<span class=\"MsoFootnoteReference\"><span class=\"MsoFootnoteReference\"><span lang=\"RO\" style=\"font-family: &quot;Times New Roman&quot;; font-size: 12pt;\"><\/span><\/span><\/span> c\u00e2t \u015fi \u00een \u201cDeclara\u0163ia cu privire la autonomia local\u0103\u201d adoptat\u0103 la Rio de Janero \u00een 1985<span class=\"MsoFootnoteReference\"><span class=\"MsoFootnoteReference\"><span lang=\"RO\" style=\"font-family: &quot;Times New Roman&quot;; font-size: 12pt;\"><\/span><\/span><\/span>, la compartimentele despre resursele colectivit\u0103\u0163ilor locale se men\u0163ioneaz\u0103 c\u0103 ele au dreptul \u00een cadrul politicii economice na\u0163ionale, la resursele proprii suficiente, de care ele pot dispune \u00een mod liber \u00een exercitarea competen\u0163elor lor, distincte de cele ale altor e\u015faloane administrative.<\/span><\/div>\n<div style=\"line-height: 150%; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">\u00cen conformitate cu prevederile art. 109 din Constitu\u0163ia Republicii Moldova \u015fi art. 3 al Legii privind administra\u0163ia public\u0103 local\u0103, administra\u0163ia public\u0103 \u00een unit\u0103\u0163ile administrativ-teritoriale se \u00eentemeiaz\u0103 pe principiile:<\/span><\/div>\n<div style=\"line-height: 150%; margin-left: 0.75in; text-align: justify; text-indent: 0in;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><b><i><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">autonomiei locale;<\/span><\/i><\/b><\/div>\n<div style=\"line-height: 150%; margin-left: 0.75in; text-align: justify; text-indent: 0in;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><b><i><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">descentraliz\u0103rii serviciilor publice;<\/span><\/i><\/b><\/div>\n<div style=\"line-height: 150%; margin-left: 0.75in; text-align: justify; text-indent: 0in;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><b><i><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">eligibilit\u0103\u0163ii autorit\u0103\u0163ilor administra\u0163iei publice locale;<\/span><\/i><\/b><\/div>\n<div style=\"line-height: 150%; margin-left: 0.75in; text-align: justify; text-indent: 0in;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><b><i><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">consult\u0103rilor cet\u0103\u0163enilor \u00een problemele locale de interes deosebit.<\/span><\/i><\/b><\/div>\n<div style=\"line-height: 150%; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Aceste principii constituie \u00eenceputul unei noi etape \u00een dezvoltarea \u015fi organizarea administra\u0163iei publice locale \u00een republic\u0103, fiind bazate pe cele mai \u00eenaintate teorii existente \u00een acest domeniu \u00een practica interna\u0163ional\u0103.<\/span><\/div>\n<div style=\"line-height: 150%; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Conceptul de autonomie local\u0103, definit prin art. 3 din Cartea European\u0103 \u201cexerci\u0163iul autonom al puterii locale\u201d,<span class=\"MsoFootnoteReference\"><span class=\"MsoFootnoteReference\"><span lang=\"RO\" style=\"font-family: &quot;Times New Roman&quot;; font-size: 12pt;\">[<\/span><\/span><\/span> prevede dreptul \u015fi capacitatea efectiv\u0103 a colectivit\u0103\u0163ilor locale de a realiza \u015fi de a gira \u00een cadrul legii sub propria r\u0103spundere \u015fi \u00een favoarea popula\u0163iei o parte important\u0103 din treburile publice.<\/span><\/div>\n<div style=\"line-height: 150%; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Realizarea autonomiei locale \u00een Republica Moldova este unul din obiectivele esen\u0163iale ale reformei administrative. Resursele financiare ale colectivit\u0103\u0163ilor provin din:<\/span><\/div>\n<div style=\"line-height: 150%; margin-left: 0.75in; text-align: justify; text-indent: 0in;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">impozite locale, \u00een limitele stabilite de lege;<\/span><\/div>\n<div style=\"line-height: 150%; margin-left: 0.75in; text-align: justify; text-indent: 0in;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">venituri realizate din activit\u0103\u0163i proprii (prin prest\u0103ri de servicii descentralizate);<\/span><\/div>\n<div style=\"line-height: 150%; margin-left: 0.75in; text-align: justify; text-indent: 0in;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"RO\" style=\n\n\"font-size: 12pt; line-height: 150%;\">subven\u0163ii pe e posibil necondi\u0163ionate, acordate \u00een condi\u0163ii de repartizare just\u0103;<\/span><\/div>\n<div style=\"line-height: 150%; margin-left: 0.75in; text-align: justify; text-indent: 0in;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">taxe locale.<\/span><\/div>\n<div style=\"line-height: 150%; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Principiul autonomiei locale nu presupune o independen\u0163\u0103 total\u0103, o izolare a organelor administra\u0163iei publice locale de administra\u0163ia public\u0103 central\u0103. Autonomia local\u0103 este o putere de decizie liber\u0103, \u00een facultatea de a decide \u00eentr-o sfer\u0103 de atribu\u0163ii locale, \u00een care interesele locale trebuie reglate \u015fi gestionate, dar sub un control al unei autorit\u0103\u0163i superioare. Autorit\u0103\u0163ile autonomiei locale nu au putere de decizie major\u0103, ele trebuie s\u0103-\u015fi desf\u0103\u015foare activitatea \u00een limitele \u015fi condi\u0163iile legii.<\/span><\/div>\n<div style=\"line-height: 150%; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">\u00cen art. 5 al Legii privind administra\u0163ia public\u0103 local\u0103<span class=\"MsoFootnoteReference\"><span class=\"MsoFootnoteReference\"><span lang=\"RO\" style=\"font-family: &quot;Times New Roman&quot;; font-size: 12pt;\"><\/span><\/span><\/span> se men\u0163ioneaz\u0103 c\u0103 autorit\u0103\u0163i ale administra\u0163iei publice, prin care se realizeaz\u0103 autonomia local\u0103 \u00een sate (comune), ora\u015fe (municipii), sunt consiliile locale, ca autorit\u0103\u0163i deliberative, \u015fi primarii ca autorit\u0103\u0163i executive. Consiliile locale \u015fi primarii se aleg \u00een condi\u0163iile prev\u0103zute de Codul electoral. \u00cen executarea atribu\u0163iilor lor, autorit\u0103\u0163ile administra\u0163iei publice locale dispun de autonomie consfin\u0163it\u0103 \u015fi garantat\u0103 prin Constitu\u0163ie \u015fi alte legi (art. 9).<\/span><\/div>\n<div class=\"MsoBodyTextIndent2\" style=\"line-height: 150%; text-indent: 0in;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Autorit\u0103\u0163ile administra\u0163iei publice locale sunt persoane juridice autonome \u015fi sunt investite cu prerogativele de putere public\u0103. Unit\u0103\u0163ile administrativ-teritoriale ale administra\u0163iei publice locale constituie un sistem din dou\u0103 niveluri:<\/span><\/div>\n<div style=\"line-height: 150%; margin-left: 0.75in; text-align: justify; text-indent: 0in;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><b><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">primul<\/span><\/b><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\"> \u2013consiliile s\u0103te\u015fti (comunale), or\u0103\u015fene\u015fti (municipale);<\/span><\/div>\n<div style=\"line-height: 150%; margin-left: 0.75in; text-align: justify; text-indent: 0in;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><b><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">doi<\/span><\/b><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\"> \u2013 consiliile jude\u0163ene.<\/span><\/div>\n<div class=\"MsoBodyTextIndent2\" style=\"line-height: 150%; text-indent: 0in;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Competen\u0163a cu care sunt investite autorit\u0103\u0163ile administra\u0163iei publice locale este deplin\u0103 \u00eentreag\u0103. Ea nu poate fi pus\u0103 \u00een cauz\u0103 sau limit\u0103 de autoritate public\u0103 ierarhic superioar\u0103, dec\u00e2t \u00een condi\u0163iile legii. Autorit\u0103\u0163ile administra\u0163iei publice locale se conduc \u00een activitatea lor de Statutul unit\u0103\u0163ii administrativ-teritoriale \u015fi de regulamentele consiliului respectiv, elaborat \u00een baza unui statut-cadru \u015fi regulament-cadru, elaborat de c\u0103tre organul legislativ.<\/span><\/div>\n<div class=\"MsoBodyTextIndent2\" style=\"line-height: 150%; text-indent: 0in;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Autorit\u0103\u0163ile administra\u0163iei publice locale nu mai sunt supuse puterii ierarhice a autorit\u0103\u0163ilor centrale, ele fiind independente de acestea pentru c\u0103 nu sunt numite de la centru, ci sunt alese de cet\u0103\u0163enii unit\u0103\u0163ilor administrativ-teritoriale.<\/span><\/div>\n<div class=\"MsoBodyTextIndent2\" style=\"line-height: 150%; text-indent: 0in;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Consiliul local este o autoritate colegial\u0103 a administra\u0163iei publice locale, se bucur\u0103 de un statut autonom, \u00een sensul c\u0103 el delibereaz\u0103 asupra intereselor specifice ale colectivit\u0103\u0163ilor locale \u015fi decide cu privire la modul de realizare a acestora f\u0103r\u0103 amestecul din partea autorit\u0103\u0163ilor administra\u0163iei de stat.<\/span><\/div>\n<div class=\"MsoBodyTextIndent2\" style=\"line-height: 150%; text-indent: 0in;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Fiind ale\u015fi dup\u0103 sistemul pluripartid, r\u0103spunderea lor politic\u0103 este numai de ordin electoral, \u00een sensul c\u0103 ele sunt \u00eenzestrate cu competen\u0163\u0103 specific\u0103 administra\u0163iei publice locale pentru a decide asupra modului de solu\u0163ionare a problemelor administrative ale colectivit\u0103\u0163ilor locale.<\/span><\/div>\n<div class=\"MsoBodyTextIndent2\" style=\"line-height: 150%; text-indent: 0in;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Primarul este un organ executiv, ce deriv\u0103 din faptul c\u0103 el este cel care r\u0103spundere de ducere la \u00eendeplinire a hot\u0103r\u00e2rii consiliului local \u015fi tot el trebuie s\u0103 realizeze \u00een colectivit\u0103\u0163ile locale legile republicii \u015fi toate actele normative.<\/span><\/div>\n<div class=\"MsoBodyTextIndent2\" style=\"line-height: 150%; text-indent: 0in;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Conform noii legi privind administra\u0163ia public\u0103 local\u0103 din 6 noiembrie 1998, Guvernul, prin hot\u0103r\u00e2re, nume\u015fte \u00een fiecare jude\u0163, \u00een unitatea teritorial\u0103 autonom\u0103 cu statut special \u015fi \u00een municipiul Chi\u015fin\u0103u c\u00e2te un prefect, confirmat de Pre\u015fedintele Republicii Moldova.
