De r\u00e2nd cu \u00eentreaga societate din \u0163ar\u0103 se schimb\u0103 \u015fi administra\u0163ia public\u0103. Ea trebuie s\u0103 serveasc\u0103 rela\u0163iilor sociale pornind de la dinamica lor concret\u0103. Fiecare popor trebuie s\u0103-\u015fi f\u0103ureasc\u0103 o administra\u0163ie public\u0103 proprie, iar limitele \u015fi caracterul acestei administra\u0163ii vor depinde de regimul politic al statului respectiv, de rela\u0163iile ce exist\u0103 \u00eentre organele administra\u0163iei publice de diferite niveluri, de istoria \u015fi tradi\u0163ia poporului, de principiile de organizare \u015fi func\u0163iile exercitate de administra\u0163ia public\u0103. Autorit\u0103\u0163ile administra\u0163iei publice \u00een procesul realiz\u0103rii func\u0163iilor sale, stabilite de lege, sunt implicate \u00een diferite rela\u0163ii \u00een cadrul sistemului autorit\u0103\u0163ilor administra\u0163iei publice c\u00e2t \u015fi cu elementele exterioare acestui sistem.<\/span><\/div>\n<div style=\"line-height: 150%; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Aceasta reiese din faptul c\u0103 autorit\u0103\u0163ile publice activeaz\u0103 \u015fi sunt influen\u0163ate de&nbsp; mediul social, politic \u015fi juridic.<\/span><\/div>\n<div style=\"line-height: 150%; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Mediul social al administra\u0163iei este ansamblul factorilor externi care \u00eei influen\u0163eaz\u0103 structura, formele \u015fi con\u0163inutul ac\u0163iunii ei. Activitatea \u015fi structura administra\u0163iei publice evolueaz\u0103 \u00een concordan\u0163\u0103 cu dinamica exigen\u0163ilor mediului social.<\/span><\/div>\n<div style=\"line-height: 150%; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">O mare influen\u0163\u0103&nbsp; asupra administra\u0163iei publice o are mediul politic. Aceasta se \u00eent\u00e2mpl\u0103 din cauza c\u0103 autorit\u0103\u0163ile administra\u0163iei publice sunt cele mai importante instrumente de care dispune puterea politic\u0103 pentru satisfacerea necesit\u0103\u0163ilor societ\u0103\u0163ii. Administra\u0163ia trebuie s\u0103 se sprijine pe o putere politic\u0103, a c\u0103rei autoritate fa\u0163\u0103 de cet\u0103\u0163eni este un factor principal al eficien\u0163ei sale. Activitatea administra\u0163iei publice este influen\u0163at\u0103 \u015fi difer\u0103 \u00een dependen\u0163\u0103 de mediul juridic \u00een care se exercit\u0103. \u00cendeplinind sarcinile primite de la puterea politic\u0103, autorit\u0103\u0163ile administra\u0163iei politice asigur\u0103 ap\u0103rarea drepturilor \u015fi intereselor legitime ale persoanelor fizice \u015fi juridice. Pe de alt\u0103 parte, \u00eens\u0103\u015fi structura administra\u0163iei, func\u0163iile ei, sunt stabilite \u015fi reglementate prin lege, influen\u0163a mediului juridic asupra administra\u0163iei fiind destul de evident\u0103.<\/span><\/div>\n<div style=\"line-height: 150%; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">\u00cen activitatea organelor administrative accentul se deplaseaz\u0103 tot mai frecvent \u015fi mai pronun\u0163at de la administrarea direct\u0103 spre dirijarea indirect\u0103, de la solu\u0163ionarea problemelor curent spre exercitarea managementului strategic.<\/span><\/div>\n<div style=\"line-height: 150%; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Modificarea func\u0163iilor are influen\u0163\u0103 direct\u0103 \u015fi asupra mecanismului practic de lucru al organelor administra\u0163iei publice. Tendin\u0163a predominat\u0103 \u00een prezent este descentralizarea func\u0163iilor administra\u0163iei publice. Exercit\u00e2ndu-\u015fi func\u0163iile, autorit\u0103\u0163ile administra\u0163iei publice se afl\u0103 \u00een anumite raporturi at\u00e2t cu elementele interne ale sistemului administra\u0163iei publice care activeaz\u0103 sub influen\u0163a mediului social, politic \u015fi juridic, c\u00e2t \u015fi cu institu\u0163iile ce reprezint\u0103 aceste medii.<\/span><\/div>\n<div style=\"line-height: 150%; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Sistemul administra\u0163iei publice cuprinde, pe de o parte, autorit\u0103\u0163ile administra\u0163iei centrale \u015fi locale, iar pe de alt\u0103 parte autorit\u0103\u0163ile administra\u0163iei publice cu competen\u0163e generale \u015fi speciale. \u00centre aceste autorit\u0103\u0163i ale administra\u0163iei publice se cunosc mai multe tipuri de raporturi.<\/span><\/div>\n<div style=\"line-height: 150%; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Cunoa\u015fterea \u015fi aprofundarea rela\u0163iilor structurale interne ale administra\u0163iei publice \u015fi institu\u0163iile administrative, autorit\u0103\u0163ile administrative cu colectivit\u0103\u0163ile locale, regulile juridice sau nejuridice, mijloacele materiale \u015fi umane nu se pot realiza \u00een bune condi\u0163ii dac\u0103 nu stabilim mai \u00eent\u00e2i care sunt rela\u0163iile, de pe o parte, \u00eentre administra\u0163ia public\u0103 central\u0103 sau administra\u0163ia public\u0103 local\u0103, ca subsisteme ale sistemului social global, \u015fi celelalte elemente ce formeaz\u0103 sistemele distincte \u015fi care, \u00eempreun\u0103, compun mediul sau cadrul social \u00eenconjur\u0103tor al administra\u0163iei publice.<\/span><\/div>\n<div class=\"MsoBodyTextIndent2\" style=\"line-height: 150%; text-indent: 0in;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Conform Legii privind administrarea public\u0103 local\u0103 avem dou\u0103 nivele:<\/span><\/div>\n<div style=\"line-height: 150%; margin-left: 0.75in; text-align: justify; text-indent: 0in;\"><span lang=\"RO\" style=\"font-family: Symbol; font-size: 12pt; line-height: 150%;\">\u00b7<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Primul nivel \u00eel formeaz\u0103 consiliile s\u0103te\u015fti (comunale), or\u0103\u015fene\u015fti \u015fi prim\u0103riile satelor, comunelor, ora\u015felor. Fiind mai aproape de cet\u0103\u0163eni, anume aceste organe se confrunt\u0103 zilnic cu necesit\u0103\u0163ile solu\u0163ion\u0103rii a zeci de probleme ce apar \u00een comunitatea dat\u0103. De faptul cum activeaz\u0103 aceast\u0103 verig\u0103 a administra\u0163iei publice locale, depinde foarte mult opiniile oamenilor despre administra\u0163ia public\u0103 \u00een general.<\/span><\/div>\n<div style=\"line-height: 150%; margin-left: 0.75in; text-align: justify; text-indent: 0in;\"><span lang=\"RO\" style=\"font-family: Symbol; font-size: 12pt; line-height: 150%;\">\u00b7<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Al doilea nivel al autorit\u0103\u0163ilor administrative ale administra\u0163iei publice locale \u00eel constituie consiliile jude\u0163ene.<\/span><\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Fiind o verig\u0103 intermediar\u0103 \u00eentre organele administra\u0163iei centrale \u015fi organele administra\u0163iei publice locale de nivelul&nbsp; \u00eent\u00e2i, consiliile jude\u0163ene \u015fi municipale coordoneaz\u0103 activitatea consiliilor (comunale). Este important de men\u0163ionat c\u0103 raporturile lor se \u00eentemeiaz\u0103 pe principiile autonomiei, legalit\u0103\u0163ii \u015fi colabor\u0103rii \u00een rezolvarea problemelor comune.<\/span><\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; La etapa actual\u0103, c\u00e2nd Republica Moldova tinde s\u0103 fie un stat bazat pe drept, administra\u0163ia public\u0103 e preocupat\u0103 de executarea nemijlocit\u0103 a prevederilor Constitu\u0163iei, a tuturor actelor normative \u015fi celorlalte acte juridice emise<\/p>\n<p> de autorit\u0103\u0163ile statului de drept.<\/span><\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; S\u0103 preciz\u0103m, \u00eens\u0103, care sunt rela\u0163iile dintre autorit\u0103\u0163ile publice \u015fi perspectivele realiz\u0103rii acestor rela\u0163ii, cunoa\u015fterea \u015fi aprofundarea rela\u0163iilor structurale, interne, ale administra\u0163iei publice \u015fi institu\u0163iile administrative. Autorit\u0103\u0163ile administrative, regulile juridice sau nejuridice, mijloacele materiale \u015fi umane ale administra\u0163iei publice nu pot fi realizate \u00een bune condi\u0163ii f\u0103r\u0103 stabilirea rela\u0163iilor dintre administra\u0163ia public\u0103 central\u0103 \u015fi cea local\u0103 ca elemente ale unui sistem.<\/span><\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u0162ara&nbsp; noastr\u0103 se confrunt\u0103 cu mai multe dificult\u0103\u0163i \u00een rezolvarea acestei probleme legate de mo\u015ftenirea sa istoric\u0103. \u00cen Republica Moldova procesul de reformare a administra\u0163iei publice a \u00eenceput mai t\u00e2rziu dec\u00e2t reforma economic\u0103. Au fost cauze at\u00e2t obiective c\u00e2t \u015fi subiective, ca de exemplu, situa\u0163ia social-politic\u0103, lipsa bazei juridice etc.<\/span><\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Distingem mai multe categorii de rela\u0163ii de care avem actualmente nevoie pentru a ob\u0163ine o administra\u0163ie efectiv\u0103. Mai \u00eent\u00e2i \u00eens\u0103 s\u0103 analiz\u0103m raporturile ce apar \u00eentre autorit\u0103\u0163ile administra\u0163iei publice.<\/span><\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Din primul grup fac parte raporturile autorit\u0103\u0163ile administra\u0163iei publice centrale de competen\u0163\u0103 general\u0103 \u015fi autorit\u0103\u0163ile administra\u0163iei publice locale&nbsp; de competen\u0163\u0103 general\u0103 \u015fi special\u0103. Aceste rela\u0163ii sunt determinate de raportul de subordonare \u015fi dup\u0103 con\u0163inutul lor sunt rela\u0163ii de autoritate ierarhic\u0103, care se exprim\u0103 prin dreptul organelor administra\u0163iei publice centrale&nbsp; de competen\u0163\u0103 general\u0103 de a controla activitatea celorlalte organe \u015fi de a emite acte juridice obligatorii pentru acestea. Din alt grup fac parte rela\u0163iile dintre organele administra\u0163iei publice locale de competen\u0163\u0103 general\u0103 \u015fi special\u0103 de pe alt\u0103 parte.<\/span><\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Aici este important de men\u0163ionat c\u0103 organele administra\u0163iei publice locale de competen\u0163\u0103 general\u0103 nu sunt subordonate organelor administra\u0163iei publice centrale specializate. Anume din aceast\u0103 cauz\u0103 raporturile dintre ele sunt raporturi de cooperare. \u00cen unele cazuri acestea pot fi rela\u0163ii de control, determinate de delegarea pe care o au anumite ministere \u015fi departamente de a controla o anumit\u0103 activitate a organelor administra\u0163iei publice locale cu competen\u0163e generale. De a\u015fa drepturi beneficiaz\u0103, de exemplu, Ministerul Finan\u0163elor \u015fi alte ministere. C\u00e2t prive\u015fte raporturile dintre organele administra\u0163iei publice centrale de specialitate \u015fi serviciile publice desconcentrate, acestea sunt rela\u0163ii de autoritate de natur\u0103 func\u0163ional\u0103, dat fiind faptul c\u0103 ele sunt subordonate vertical celor centrale de specialitate.<\/span><\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00cen cadrul sistemului administra\u0163iei publice, \u00een dependen\u0163\u0103 de locul \u015fi rolul organelor respective, autorit\u0103\u0163ile administra\u0163iei publice centrale pot fi \u00een raport cu aceste organe \u00een rela\u0163ii de subordonare, de cooperare ori de control, <\/span><\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Dar, \u00een afar\u0103 de rela\u0163ii interne, autorit\u0103\u0163ile administra\u0163iei publice sunt implicate \u00een procesul de realizare a func\u0163iilor ce le au \u015fi \u00een&nbsp; multiple rela\u0163ii cu elemente exterioare acestui sistem.<\/span><\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Vorbind despre rela\u0163iile autorit\u0103\u0163ilor administra\u0163iei publice&nbsp; centrale cu mediul politic men\u0163ion\u0103m c\u0103, de\u015fi administra\u0163ia public\u0103 exercitat\u0103 prin puterea executiv\u0103 este chemat\u0103 s\u0103 execute decizia politic\u0103, partidele \u015fi forma\u0163iunile politice ca elemente ale sistemului politic nu se subordoneaz\u0103 administra\u0163iei publice. Deci nu se poate afirma c\u0103 \u00eentre autorit\u0103\u0163ile administra\u0163iei publice \u015fi Parlament exist\u0103 rela\u0163ii de autoritate ierarhic\u0103. Acestea sunt \u00een primul r\u00e2nd rela\u0163ii de cooperare, dar \u015fi rela\u0163ii de control exprimate prin controlul parlamentar al activit\u0103\u0163ilor organelor administra\u0163iei publice.<\/span><\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Legislativul este autorizat s\u0103 stabileasc\u0103 structurile organizatorice \u015fi modul de func\u0163ionare a administra\u0163iei publice centrale, s\u0103 elaboreze unele reglament\u0103ri directe, interdic\u0163ii \u015fi recomand\u0103ri pentru ele. Experien\u0163a statelor democratice a demonstrat c\u0103 \u00eent\u0103rirea \u015fi consolidarea puterii legislative constituie o condi\u0163ie esen\u0163ial\u0103&nbsp; a realiz\u0103rii unei administra\u0163ii publice eficiente.<\/span><\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Autorit\u0103\u0163ile administra\u0163iei publice centrale \u00eentre\u0163in rela\u0163ii \u015fi cu autorit\u0103\u0163ile publice care exercit\u0103 puterea judec\u0103toreasc\u0103. Jurispruden\u0163a este chemat\u0103 s\u0103 stabileasc\u0103&nbsp;&nbsp; modul de derulare a ac\u0163iunii administra\u0163iei publice, cadrul normativ ce determin\u0103 tehnologiile, procedurile potrivit c\u0103rora administra\u0163ia public\u0103 ac\u0163ioneaz\u0103 \u00een vederea realiz\u0103rii func\u0163iilor sale. \u00centre organele administra\u0163iei publice centrale \u015fi autorit\u0103\u0163ile publice care exercit\u0103 puterea judec\u0103toreasc\u0103 pot fi rela\u0163ii de cooperare, de exemplu \u00een domeniul activit\u0103\u0163ii de asigurare a legisla\u0163iei. Pot fi \u015fi rela\u0163ii de control, atunci c\u00e2nd o autoritate a administra\u0163iei publice controleaz\u0103 autoritatea judec\u0103toreasc\u0103 (control financiar), sau invers, c\u00e2nd o autoritate judec\u0103toreasc\u0103 exercit\u0103 controlul asupra anumitor activit\u0103\u0163i&nbsp; a autorit\u0103\u0163ilor administra\u0163iei publice.<\/span><\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Rela\u0163iile autorit\u0103\u0163ilor administra\u0163iei publice cu organiza\u0163iile neguvernamentale sunt, de regul\u0103, rela\u0163ii de cooperare sau rela\u0163ii de reprezentare.
