Organul suprem reprezentativ \u015fi unica autoritate legiuitoare a \u0163\u0103rii este Parlamentul, astfel din punct de vedere func\u0163ional putem aprecia c\u0103 administra\u0163ia public\u0103 se subordoneaz\u0103 autorit\u0103\u0163ilor legiuitoare, administra\u0163ia public\u0103 fiind chemat\u0103 s\u0103 exercite legea nemijlocit sau s\u0103 organizeze exercitarea acesteia. \u00cen acest sens, legislativul este autorizat s\u0103 stabileasc\u0103 structurile organizatorice \u015fi modul de func\u0163ionare pentru toate autorit\u0103\u0163ile administra\u0163iei publice, \u00een m\u0103sur\u0103 de a corespunde scopurilor pentru care fiin\u0163eaz\u0103 administra\u0163ia aceasta. Astfel puterea legislativ\u0103 se comport\u0103&nbsp; ca un element prin care se realizeaz\u0103 integrarea tuturor sferelor administra\u0163iei publice. Ac\u0163iunea legislativului asupra administra\u0163iei se pot exprima \u00een diverse forme, cum ar fi stabilirea unor reglement\u0103ri directe, introducerea unor interdic\u0163ii, recomand\u0103ri etc. Ceea ce se poate constata este faptul c\u0103 \u00eent\u0103rirea puterii legislative constituie&nbsp; o condi\u0163ie esen\u0163ial\u0103 a realiz\u0103rii unei administr\u0103ri eficiente a treburilor statului \u015fi societ\u0103\u0163ii.<\/span><\/div>\n<div style=\"line-height: 150%; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Potrivit criteriilor de constituire \u00een sistem autorit\u0103\u0163ile administra\u0163iei publice \u015fi corespunz\u0103tor tipurile de structuri analizate, se consider\u0103 c\u0103 \u00een administra\u0163ia public\u0103 actual\u0103 avem urm\u0103toarele tipuri de rela\u0163ii \u00eentre diferite autorit\u0103\u0163i: rela\u0163ii ce au evoluat \u00een urma reformelor statale,<\/span><\/div>\n<div style=\"line-height: 150%; margin-left: 67.5pt; text-align: justify; text-indent: 0in;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">a)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><b><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Rela\u0163ii de autoritate, care pot fi<\/span><\/b><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">: rela\u0163ie ierarhic\u0103, determinat\u0103 de structura ierarhic\u0103 \u015fi rela\u0163ii func\u0163ionale, determinate de structur\u0103 dup\u0103 competen\u0163a specific\u0103, \u015fi care, de regul\u0103, se realizeaz\u0103 \u00een sprijinul celor dint\u00e2i.<\/span><\/div>\n<div style=\"line-height: 150%; margin-left: 67.5pt; text-align: justify; text-indent: 0in;\"><b><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">b)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/b><b><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Rela\u0163ii de cooperare, care pot fi: formalitate (obligatorii prin acte normative, sau neformalizate (facultative).<\/span><\/b><\/div>\n<div style=\"line-height: 150%; margin-left: 67.5pt; text-align: justify; text-indent: 0in;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">c)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><b><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Rela\u0163ii de reprezentare(iaz na\u015ftere \u00een special \u00een raport cu elementele exterioare sistemului autorit\u0103\u0163ilor administra\u0163iei publice).<\/span><\/b><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\"><\/span><\/div>\n<div style=\"line-height: 150%; margin-left: 67.5pt; text-align: justify; text-indent: 0in;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">d)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><b><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Rela\u0163ii de control, determinate de delegarea (deci nu rela\u0163ii de control, consecin\u0163\u0103 a subordon\u0103rii ierarhice sau func\u0163ionale).<\/span><\/b><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\"><\/span><\/div>\n<div style=\"line-height: 150%; margin-left: 67.5pt; text-align: justify; text-indent: 0in;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">e)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><b><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Rela\u0163ii de prest\u0103ri servicii (cu pondere \u00een raporturile cu cet\u0103\u0163enii).<\/span><\/b><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\"> <\/span><\/div>\n<div style=\"line-height: 150%; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Sumar, referindu-ne la responsabilit\u0103\u0163ile determinate de aceste tipuri de rela\u0163ii, remarc\u0103m \u015fi diferen\u0163ierea tipurilor de responsabilit\u0103\u0163i. De exemplu, rela\u0163iile ierarhice care au la baz\u0103 o autoritate direct\u0103, determin\u0103 o responsabilitate general\u0103 total\u0103; rela\u0163iile func\u0163ionale, care au la baz\u0103 o autoritate indirect\u0103, potrivit competen\u0163ei specifice, determin\u0103 o responsabilitate specific\u0103, specializat\u0103.<\/span><\/div>\n<div style=\"line-height: 150%; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">\u00cenainte de a proceda la analiza detaliat\u0103 a evolu\u0163iei tipurilor de rela\u0163ii \u00een care sunt implicate autorit\u0103\u0163ile administra\u0163iei publice \u00een procesul realiz\u0103rii func\u0163iilor ce le au, reamintim un aspect important al rela\u0163iilor dintre administra\u0163ie \u015fi mediul public, \u015fi anume acela, c\u0103 de\u015fi administar\u0163ia, constituind substan\u0163a puterii executive, este chemat\u0103 s\u0103 execute decizia politic\u0103; partidele \u015fi forma\u0163iunile politice, ca elemente ale sistemului politic, nu se subordoneaz\u0103 administra\u0163iei publice&nbsp; dec\u00e2t \u00eentr-un regim totalitar.<\/span><\/div>\n<div style=\"line-height: 150%; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Voin\u0163a partidelor politice nu se poate impune administra\u0163iei publice dec\u00e2t filtrat\u0103 prin prevederile Constitu\u0163iei \u015fi a celorlalte legi care precizeaz\u0103 cu exactitate tehnologia transform\u0103rii ob\u0163iunilor politice \u00een decizii politice, iar apoi \u00een norme juridice, care sunt singure obligatorii pentru Administra\u0163ia public\u0103.<\/span><\/div>\n<div style=\"line-height: 150%; text-align: justify;\">\n<\/div>\n<div style=\"line-height: 150%; text-align: justify;\"><b><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Rela\u0163ii \u00een cadrul sistemului autorit\u0103\u0163ilor administra\u0163iei publice<\/span><\/b><\/div>\n<div style=\"line-height: 150%; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">\u00cen cadrul acestei grup\u0103ri distingem mai multe categorii de rela\u0163ii \u015fi anume:<\/span><\/div>\n<div style=\"line-height: 150%; margin-left: 0.75in; text-align: justify; text-indent: 0in;\"><b><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">1)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/b><b><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Rela\u0163ii dintre autorit\u0103\u0163ile de v\u00e2rf a administra\u0163iei publice \u015fi celelalte autorit\u0103\u0163i ale administra\u0163iei publice:<\/span><\/b><\/div>\n<div style=\"line-height: 150%; margin-left: 0.75in; text-align: justify; text-indent: 0in;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">a)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">rela\u0163iile \u00eentre autorit\u0103\u0163ile de v\u00e2rf ale administra\u0163iei&nbsp; publice \u015fi ministere sau alte organe de specialitate ale administra\u0163iei publice centrale sunt determinate de raportul de subordonare orizontal \u00eentre Guvern \u2013 ca autoritate de v\u00e2rf \u015fi ministere sau alte organe centrale de specialitate ale administra\u0163iei publice centrale, potrivit c\u0103ruia Guvernul, conform programului s\u0103u de guvernare acceptat de parlament, asigur\u0103 realizarea politicii interne \u015fi externe a \u0163\u0103rii \u015fi exercit\u0103 conducerea general\u0103 a administra\u0163iei publice, iar ministerele \u015fi organele de specialitate ale administra\u0163iei publice centrale, fiecare \u00een ramura sau domeniul s\u0103u specific de activitate, traduce \u00een practic\u0103 aceste m\u0103suri. Aceast\u0103 subordonare orizontal\u0103 (av\u00e2nd \u00een vedere c\u0103 at\u00e2t Guvernul c\u00e2t \u015fi ministerele \u015fi celelalte organe de specialitate ale administra\u0163iei publice centrale ac\u0163ioneaz\u0103 pe acela\u015fi teritoriu), determin\u0103 totu\u015fi rela\u0163ii de autoritate ierarhice, care se exprim\u0103 prin competen\u0163a Guvernului de a controla activitatea ministerelor \u015fi a celorlalte organe de specialitate ale administra\u0163iei publice \u015fi de a emite acte juridice obligatorii pentru acestea.<\/span><\/div>\n<div style=\"line-height: 150%; margin-left: 0.75in; text-align: justify; text-indent: 0in;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">b)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Rela\u0163ii \u00eentre organul de v\u00e2rf al administra\u0163iei publice \u015fi autorit\u0103\u0163ile ocale ale administra\u0163iei publice cu competen\u0163\u0103 general\u0103 \u2013 consilii locale \u015fi prim\u0103rii \u2013 sunt tot \u00een rela\u0163ii de autoritate ierarhice,&nbsp; generate de competen\u0163a general\u0103 pe care o are Guvernul de a conduce \u00eentreaga administrare public\u0103 la nivel na\u0163ional. Expresia acestui tip de rela\u0163ii este dreptul de control al legalit\u0103\u0163ii pe care \u00eel are Prefectul ca reprezentant al Guvernului \u00een teritoriu, precum \u015fi dreptul Guvernului de a emite acte juridice obligatorii pentru aceste autorit\u0103\u0163i locale. Este de remarcat \u00eens\u0103 c\u0103 autoritatea Guvernului asupra consiliilor locale trebuie exercitat\u0103 strict \u00een limitele legii \u015fi cu respectarea autonomiei func\u0163ionale a acestora, principiul autonomiei administrative&nbsp; \u015fi al descentraliz\u0103rii serviciilor publice fiind \u00eenscrise \u00een Constitu\u0163ie.<\/span><\/div>\n<div style=\"line-height: 150%; margin-left: 0.75in; text-align: justify; text-indent: 0in;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">c)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Rela\u0163ii \u00eentre autorit\u0103\u0163ile de v\u00e2rf ale administra\u0163iei publice \u015fi autorit\u0103\u0163ile locale de specialitate ale administra\u0163iei publice sunt rela\u0163ii de autoritate-ierarhice, determinate de structura unitar\u0103 a subsistemului autorit\u0103\u0163ilor administra\u0163iei publice de stat. Acest tip de rela\u0163ii rezult\u0103 din dreptul de control general pe care \u00eel are Guvernul. \u00cen practica administrativ\u0103, rela\u0163iile de autoritate-ierarhice de tip general, nu se realizeaz\u0103 \u00eentotdeauna direct, av\u00e2nd \u00een vedere c\u0103 \u00eentre Guvern \u015fi serviciile publice descentralizate ale ministerelor \u015fi celelalte organe centrale de specialitate ale administra\u0163iei publice exist\u0103 o treapt\u0103 ierarhic\u0103 intermediar\u0103 \u2013 Prefectul sau Ministrul de resort. Rela\u0163ii de autoritate ierarhice se stabilesc doar atunci c\u00e2nd autoritatea de v\u00e2rf a administra\u0163iei publice \u2013 Guvernul \u2013 adopt\u0103 m\u0103suri generale privind func\u0163ionarea acestora (acte normative). Guvernul \u00een virtutea pozi\u0163iei \u015fi rolului s\u0103u, este chemat s\u0103 arbitreze \u015fi s\u0103 solu\u0163ioneze abaterile ce se produc \u00een sistemul de rela\u0163ii \u00eentre autorit\u0103\u0163ile administra\u0163iei publice cu componen\u0163\u0103 general\u0103 (consiliile jude\u0163ene) \u015fi ministerele \u015fi celelalte organe&nbsp; centrale de specialitate ale administra\u0163iei publice, \u00een ideea respect\u0103rii stricte a Constitu\u0163iei \u015fi a celorlalte acte normative, \u00een scopul evit\u0103rii centralismului excesiv \u015fi al asigur\u0103rii autonomiei func\u0163ionale a autorit\u0103\u0163ilor administra\u0163iei publice locale.<\/span><\/div>\n<div style=\"line-height: 150%; margin-left: 0.5in; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">3. R<b>ela\u0163ii \u00eentre ministere \u015fi celelalte organe de specialitate ale administra\u0163iei publice centrale \u015fi autorit\u0103\u0163ile locale sau teritoriale ale administra\u0163iei publice:<\/b><\/span><\/div>\n<div style=\"line-height: 150%; margin-left: 0.75in; text-align: justify; text-indent: 0in;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">a)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Rela\u0163ii \u00eentre ministerele \u015fi celelalte organe de specialitate ale administra\u0163iei publice \u015fi autorit\u0103\u0163ile locale ale administra\u0163iei publice cu competen\u0163\u0103 general\u0103 (consilii locale) sunt determinate de pozi\u0163ia acestor autorit\u0103\u0163i \u00een sistemul general al administra\u0163iei publice. Ele sunt situate \u00een subsisteme diferite, determinate de criterii fundamentale ale competentelor. Pornind de la aceast\u0103 observa\u0163ie, putem deduce c\u0103 autorit\u0103\u0163ile administra\u0163iei publice locale cu competen\u0163\u0103 general\u0103 (consiliile locale) nu sunt subordonate ministerelor \u015fi celorlalte organe de specialitate ale administra\u0163iei publice centrale. <\/span><\/div>\n<div style=\"line-height: 150%; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Deci nu suntem \u00een posesia unor rela\u0163ii de cooperare \u00een cea mai mare parte formalizate pentru diverse acte normative. De asemenea, \u00eentre unele ministere sau organe de specialitate ale administra\u0163iei publice centrale \u015fi autorit\u0103\u0163ile administra\u0163iei publice locale cu competen\u0163\u0103 general\u0103 se nasc rela\u0163ii de control, determinate de delegarea pe care o au anumite ministere \u015fi organe ale administra\u0163iei publice centrale de a controla o anumit\u0103 activitate \u015fi nu de subordonare ierarhic\u0103 sau func\u0163ional\u0103. De exemplu, \u00een toate \u0163\u0103rile Ministerul Finan\u0163elor, prin agen\u0163ii s\u0103i de control, are competen\u0163a de a controla \u00een domeniul respectiv toate autorit\u0103\u0163ile administra\u0163iei publice, indiferent de subordonare, \u00eentr\u00e2nd cu aceasta \u00een rela\u0163ii de control. E de remarcat, de asemenea, c\u0103 Ministerele \u015fi celelalte organe de specialitate ale administra\u0163iei publice centrale, realiz\u00e2nd conducerea de ramur\u0103 sau domeniu, emit acte juridice normative care sunt obligatorii pentru autorit\u0103\u0163ile administra\u0163iei publice locale cu competen\u0163\u0103 general\u0103. Acest lucru nu determin\u0103 \u00eens\u0103 stabilitatea unor rela\u0163ii de autoritate \u00eentre acestea.<\/span><\/div>\n<div style=\"line-height: 150%; margin-left: 0.75in; text-align: justify; text-indent: 0in;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">b)<span style=\"font:\n7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Rela\u0163ii \u00eentre ministere \u015fi celelalte organe de specialitate ale administra\u0163iei publice centrale \u015fi serviciile publice descentralizate ale acestora sunt rela\u0163ii de autoritate de natur\u0103 func\u0163ional\u0103, determinate de structura \u015fi specificul de activitate (func\u0163ional\u0103). Deci, serviciile publice descentralizate, ca autorit\u0103\u0163i ale administra\u0163iei publice de specialitate, sunt subordonate vertical organelor centrale de resort, care au competen\u0163a s\u0103 le suspende dispozi\u0163iile ilegale \u015fi s\u0103 le dea indica\u0163ii obligatorii, dar, \u00een acela\u015fi timp func\u0163ioneaz\u0103 sub direct\u0103 conducere a Prefectului. Un alt tip de rela\u0163ii ce se nasc \u00eentre ministere \u015fi celelalte organe de specialitate ale administra\u0163iei publice centrale descentralizate, ca autorit\u0103\u0163i ale administra\u0163iei publice din teritoriu, sunt rela\u0163iile de control determinate de delegare \u015fi nu pe structur\u0103 sau specific de activitate.<\/span><\/div>\n<div style=\"line-height: 150%; margin-left: 0.75in; text-align: justify; text-indent: 0in;\"><b><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">c)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/b><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Rela\u0163ii \u00eentre autorit\u0103\u0163ile publice locale. Acestea p\u0103trund \u00eentre consiliul local \u015fi primari \u015fi pot fi apreciate pornind de la aceea c\u0103 conform Legii privind Administra\u0163ia public\u0103 local\u0103 din 6 noiembrie 1998, primarii sunt autorit\u0103\u0163i executive \u015fi nu deliberative, ceea ce \u00eenseamn\u0103 c\u0103 dintr-un anumit punct de vedere ar exista o rela\u0163ie de autoritate \u00eentre consiliu \u015fi primar. \u00cen acela\u015fi timp, din punct de vedere al modului de formare, ambele autorit\u0103\u0163i sunt constituite prin votul direct al cet\u0103\u0163enilor, ceea ce confirm\u0103 \u00een egal\u0103 m\u0103sur\u0103 legitimitatea, deosebirea dintre ele nefiind de natur\u0103 juridic\u0103 (ambele autorit\u0103\u0163i apar\u0163in administra\u0163iei publice).
