Organizarea administrativ-teritorial\u0103 a Republicii Moldova \u015fi stabilirea cadrului juridic pentru sate (comune) \u015fi ora\u015fe (municipii) s-a efectuat potrivit art.110 \u015fi 111 din Constitu\u0163ia R.M. \u015fi se realizeaz\u0103 \u00een conformitate cu necesit\u0103\u0163ile reale economice, sociale \u015fi culturale, precum \u015fi cu respectarea tradi\u0163iilor istorice, \u00een scopul asigur\u0103rii unui nivel adecvat de civiliza\u0163ie tuturor localit\u0103\u0163ilor rurale \u015fi urbane. Aceast\u0103 reorganizare administrativ-teritorial\u0103 a fost necesar\u0103 pentru \u00eenf\u0103ptuirea \u00een general a reformei administra\u0163iei publice. Sistemul de administrare public\u0103 nu-\u015fi putea asuma m\u0103car sarcina dezvolt\u0103rii unor puternice centre regionale, eficiente din punct de vedere economic \u015fi social, \u00eenzestrate cu servicii publice moderne, adecvate satisfacerii necesit\u0103\u0163ilor fire\u015fti ale colectivit\u0103\u0163ilor locale. Reforma sistemului de organizare teritorial\u0103 s-a impus printr-o serie de considerente de ordin economic, social \u015fi politic.<\/span><\/div>\n<div class=\"MsoBodyText\" style=\"line-height: 150%; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00cen Republica Moldova procesul de reformare al administra\u0163iei publice a \u00eenceput odat\u0103 cu organizarea administrativ-teritorial\u0103 \u015fi se schimb\u0103 \u00een timpul reorganiz\u0103rii teritoriului. Distingem mai multe categorii de rela\u0163ii de care avem actualmente nevoie pentru a ob\u0163ine o administra\u0163ie eficient\u0103:<\/span><\/div>\n<div style=\"line-height: 150%; margin-left: 67.5pt; text-align: justify; text-indent: 0in;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">a)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><b><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">rela\u0163iile dintre autoritatea de v\u00e2rf \u015fi celelalte autorit\u0103\u0163i ale administra\u0163iei publice:<\/span><\/b><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\"><\/span><\/div>\n<div style=\"line-height: 150%; margin-left: 68.25pt; text-align: justify; text-indent: 0in;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">1.<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Ele sunt determinate de raportul&nbsp; de subordonare dintre Guvern, ministere \u015fi alte organe centrale de specialitate ale administra\u0163iei publice centrale, raport autoritar-ierarhic, care se exprim\u0103 prin competen\u0163a Guvernului de a controla activitatea ministerelor \u015fi a celorlalte organe de specialitate ale administra\u0163iei publice precum \u015fi de a emite acte juridice obligatorii pentru acestea.<\/span><\/div>\n<div style=\"line-height: 150%; margin-left: 68.25pt; text-align: justify; text-indent: 0in;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">2.<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Rela\u0163ii dintre Guvern cu competen\u0163a de a conduce administrarea public\u0103 la nivel na\u0163ional \u015fi autorit\u0103\u0163ile locale ale administr\u0103rii. Expresie a acestui tip de rela\u0163ii este dreptul de control al legalit\u0103\u0163ii pe care \u00eel au autorit\u0103\u0163ile locale, ca reprezentan\u0163i ai Guvernului \u00een teritoriul dat, precum \u015fi dreptul Guvernului de a emite acte juridice obligatorii pentru aceste autorit\u0103\u0163i locale. Este de remarcat, \u00eens\u0103, c\u0103 autoritatea Guvernului asupra consiliilor locale trebuie exercitat\u0103 strict \u00een limitele legii, cu respectarea autonomiei func\u0163ionale a acestora \u015fi a principiului autonomiei administrative \u015fi al descentraliz\u0103rii serviciilor publice.<\/span><\/div>\n<div style=\"line-height: 150%; margin-left: 68.25pt; text-align: justify; text-indent: 0in;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">3.<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Rela\u0163ii dintre autoritatea de v\u00e2rf a administra\u0163iei publice locale de specialitate. Aici exist\u0103 schema: Guvern \u2013 Ministru de resort \u2013 reprezentan\u0163ii administra\u0163iei publice locale (la nivel de consilii jude\u0163ene). Guvernul, \u00een virtutea pozi\u0163iei \u015fi rolului s\u0103u, trebuie s\u0103 arbitreze \u015fi s\u0103 solu\u0163ioneze abaterile produse \u00een sistemul de rela\u0163ii dintre autorit\u0103\u0163ile administra\u0163iei publice cu competen\u0163\u0103 general\u0103, consiliile jude\u0163ene \u015fi ministere, precum \u015fi celelalte organe centrale de specialitate ale administr\u0103rii publice \u00een scopul respect\u0103rii stricte a legisla\u0163iei, \u00een special pentru evitarea centralismului excesiv \u015fi a asigur\u0103rii autonomiei func\u0163ionale a autorit\u0103\u0163ilor administra\u0163iei publice locale.<\/span><\/div>\n<div style=\"line-height: 150%; margin-left: 67.5pt; text-align: justify; text-indent: 0in;\"><b><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">b)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/b><b><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">rela\u0163iile dintre ministere, celelalte organe de specialitate ale administra\u0163iei publice centrale \u015fi autorit\u0103\u0163ile locale ale administra\u0163iei cu competen\u0163\u0103 general\u0103 (consilii locale). Acestea sunt ni\u015fte rela\u0163ii de cooperare. Rela\u0163iile dintre ministere \u015fi restul organelor de specialitate ale organelor administra\u0163iei publice centrale \u015fi serviciile lor descentralizate, care sunt rela\u0163ii autoritare.<\/span><\/b><\/div>\n<div style=\"line-height: 150%; margin-left: 67.5pt; text-align: justify; text-indent: 0in;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">c)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><b><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Rela\u0163ii dintre<\/span><\/b><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">&nbsp; autorit\u0103\u0163ile administra\u0163iei publice locale: \u00een conformitate cu statutul lor, potrivit Legii privind administrarea public\u0103 local\u0103 sunt autorit\u0103\u0163i executive, ceea ce ar \u00eensemna c\u0103, dintr-un anumit punct de vedere, exist\u0103 o rela\u0163ie de autoritate \u00eentre consiliu \u015fi prim\u0103rie. Este necesar, ca noua structur\u0103 administrativ-teritorial\u0103 s\u0103 permit\u0103 ridicarea multilateral\u0103 a eficien\u0163ei, rolului \u015fi pozi\u0163iei organelor administra\u0163iei publice locale \u00een baza urm\u0103toarelor principii:<\/span><\/div>\n<div style=\"line-height: 150%; margin-left: 0.75in; text-align: justify; text-indent: 0in;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">atribuirea organelor administra\u0163iei publice locale a unor func\u0163ii exercitate actualmente de c\u0103tre organele centrale, ca regul\u0103, orientate la manifestarea deplin\u0103 a propriei ini\u0163iative viz\u00e2nd orice chestiune ce nu este exclus\u0103 din competen\u0163a unui alt organ al puterii;<\/span><\/div>\n<div style=\"line-height: 150%; margin-left: 0.75in; text-align: justify; text-indent: 0in;\"><span lang=\"RO\" style=\"font-siz\n\ne: 12pt; line-height: 150%;\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">efectuarea consulta\u0163iilor prealabile cu organele administra\u0163iei publice locale atunci c\u00e2nd se fac unele modific\u0103ri \u00een delimit\u0103rile teritoriale, planificarea \u015fi adoptarea oric\u0103ror decizii ce se refer\u0103 nemijlocit la aceste organe;<\/span><\/div>\n<div style=\"line-height: 150%; margin-left: 0.75in; text-align: justify; text-indent: 0in;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">asigurarea corespunderii structurilor administrative locale cu sarcinile organelor administra\u0163iei publice locale, care const\u0103, \u00een primul r\u00e2nd, \u00een posibilitatea de a determina, respect\u00e2nd prevederile generale ale legisla\u0163iei, structurile lor administrativ interne, \u0163in\u00e2nd cont de necesit\u0103\u0163ile locale;<\/span><\/div>\n<div style=\"line-height: 150%; margin-left: 0.75in; text-align: justify; text-indent: 0in;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">executarea oric\u0103rui control administrativ asupra organelor administra\u0163iei publice locale se admite numai \u00een cazurile \u015fi formele prev\u0103zute de Constitu\u0163ia Republicii Moldova sau alte legi ce se aplic\u0103 numai pentru asigurarea \u015fi respectarea legisla\u0163iei \u015fi ordinii de drept constitu\u0163ional \u00een \u0163ar\u0103;<\/span><\/div>\n<div style=\"line-height: 150%; margin-left: 0.75in; text-align: justify; text-indent: 0in;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">acordarea pentru organele administra\u0163iei publice locale a dreptului de a colabora \u015fi a se asocia (\u00een limitele stabilite de lege) cu alte organe ale administra\u0163iei publice locale pentru a-\u015fi executa sarcinile cu interes comun;<\/span><\/div>\n<div style=\"line-height: 150%; margin-left: 0.75in; text-align: justify; text-indent: 0in;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">&#8211;<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">investirea organelor administra\u0163iei publice locale cu dreptul de a fi protejate de instan\u0163ele judiciare pentru asigurarea efectu\u0103rii libere a \u00eemputernicirilor lor \u015fi a respect\u0103rii principiilor gestionare publice, stipulate \u00een Constitu\u0163ia Republicii Moldova \u015fi alte acte normative.<\/span><\/div>\n<div style=\"line-height: 150%; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">\u00cen timpul reorganiz\u0103rii teritorial-administrative, au avut loc \u015fi schimb\u0103ri esen\u0163iale \u00een via\u0163a social-economic\u0103 \u015fi politic\u0103 a \u0163\u0103rii, care au adus \u015fi la unele schimb\u0103ri \u00een rela\u0163iile dintre organele administra\u0163iei publice.<\/span><\/div>\n<div style=\"line-height: 150%; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">\u00cen locul sistemului de gospod\u0103rie cu planificarea centralizat\u0103, a \u00eenceput s\u0103 se afirme \u00een mod accelerat economia de pia\u0163\u0103 social orientat\u0103 evolu\u0163ia c\u0103reia, \u00eentr-o anumit\u0103 m\u0103sur\u0103, depinde de ini\u0163iativa local\u0103, de capacitatea organelor locale ale puterii de stat&nbsp; de a mobiliza \u015fi utiliza ra\u0163ional&nbsp; resursele interne pentru dezvoltare. Iar aceasta, la r\u00e2ndul s\u0103u, depinde mult de organizarea teritorial-administrativ\u0103, condi\u0163iile pentru asigurarea descentraliz\u0103rii func\u0163iilor administra\u0163iei publice.<\/span><\/div>\n<div style=\"line-height: 150%; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">\u00cen rezultatul adopt\u0103rii Legii privind organizarea administrativ-teritorial\u0103 a Republicii Moldova \u015fi a Legii privind administrarea public\u0103 local\u0103, la nivelul doi apar dou\u0103 puteri: pe de o parte Prefectul, care este reprezentantul&nbsp; Guvernului \u00een teritoriu, iar pe de alt\u0103 parte \u2013 Pre\u015fedintele comitetului executiv. Care vor fi raporturile \u015fi rela\u0163iile dintre aceste dou\u0103 organe r\u0103m\u00e2ne numai de v\u0103zut. Dar s\u0103 sper\u0103m c\u0103 vor fi raporturi de colaborare \u015fi coordonare.<\/span><\/div>\n<div style=\"line-height: 150%; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Descentralizarea teritorial\u0103,&nbsp; principiu \u00eenscris \u00een Constitu\u0163ia Republicii Moldova \u015fi \u00een Legea privind administrarea public\u0103 local\u0103, are menirea s\u0103 permit\u0103 colectivit\u0103\u0163ilor umane sau serviciilor publice s\u0103 se administreze ele \u00eensele, sub controlul organelor centrale de specialitate.<\/span><\/div>\n<div style=\"line-height: 150%; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">Esen\u0163a descentraliz\u0103rii administrative const\u0103 \u00een transferarea unor autorit\u0103\u0163i \u00een unit\u0103\u0163ile administrativ-teritoriale pentru ca problemele care intereseaz\u0103 popula\u0163ia s\u0103 fie solu\u0163ionate la nivelul acestor unit\u0103\u0163i de condi\u0163ii de oportunitate \u015fi operativitate sporit\u0103.<\/span><\/div>\n<div style=\"line-height: 150%; text-align: justify;\"><span lang=\"RO\" style=\"font-size: 12pt; line-height: 150%;\">M\u0103surile \u00eentreprinse p\u00e2n\u0103 \u00een prezent \u00een privin\u0163a descentraliz\u0103rii impun concluzia c\u0103 aceast\u0103 prevedere constitu\u0163ional\u0103 nu este realizat\u0103 \u00een practic\u0103.
