Tocmai datorit\u0103 particularit\u0103\u0163ilor transportului aerian, s-a v\u0103zut necesar\u0103 elaborarea unor norme c\u00e2t mai complete, \u00een m\u0103sur\u0103 s\u0103 garanteze nu numai eficacitatea acesteia, ci \u015fi un alt grad de securitate pentru c\u0103l\u0103tori, c\u00e2t \u015fi pentru marfa. Astfel, \u00een 1929 s-a adoptat Conven\u0163ia de la Var\u015fovia privind unificarea anumitor reguli referitoare la transportul aerian<span class=\"MsoFootnoteReference\"><span class=\"MsoFootnoteReference\"><span lang=\"EN-US\" style=\"font-family: &quot;Times New Roman&quot;; font-size: 12pt;\"><\/span><\/span><\/span>. \u00cen 1924, la Chicago, \u00een S.U.A s-a adoptat Conven\u0163ia privind avia\u0163ia civil\u0103 interna\u0163ional\u0103<span class=\"MsoFootnoteReference\"><span class=\"MsoFootnoteReference\"><span lang=\"EN-US\" style=\"font-family: &quot;Times New Roman&quot;; font-size: 12pt;\"><\/span><\/span><\/span>. Datorit\u0103 evolu\u0163iei traficului aerian \u00een 1955 s-au f\u0103cut mai multe modific\u0103ri \u015fi complet\u0103ri Conven\u0163iei din 1929 prin Protocolul semnat la Haga la 28 Septembrie 1955 \u015fi prin Conven\u0163ia complementar\u0103 la Conven\u0163ia de la Var\u015fovia, \u00eencheiat\u0103 la Guadalajara (1961).<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify; text-indent: 36pt;\"><span lang=\"EN-US\">Conven\u0163ia privind modificarea anumitor reguli referitoare la transportul interna\u0163ional aerian<span class=\"MsoFootnoteReference\"><span class=\"MsoFootnoteReference\"><span lang=\"EN-US\" style=\"font-family: &quot;Times New Roman&quot;; font-size: 12pt;\"><\/span><\/span><\/span>&nbsp;se aplic\u0103 \u201ctuturor formelor de transport aerian\u201d de persoane, bagaje \u015fi bunuri<span class=\"MsoFootnoteReference\"><span class=\"MsoFootnoteReference\"><span lang=\"EN-US\" style=\"font-family: &quot;Times New Roman&quot;; font-size: 12pt;\"><\/span><\/span><\/span>.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify; text-indent: 36pt;\"><span lang=\"EN-US\">Expresia \u201ctransport interna\u0163ional\u201d \u00eenseamn\u0103 potrivit defini\u0163iei dat\u0103 de conven\u0163ie orice transport \u00een care, potrivit contractului \u00eencheiat \u00eentre p\u0103r\u0163i, locul de plecare \u015fi de sosire (de destina\u0163ie), indiferent de \u00eentreruperi, sunt situate \u00een interiorului a dou\u0103 p\u0103r\u0163i contractante.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify; text-indent: 36pt;\"><span lang=\"EN-US\">Transportul efectuat de mai multe aeronave \u00een mod succesiv este considerat, \u00een baza Conven\u0163iei, un transport unitar, \u00een cazul \u00een care a fost organizat de p\u0103r\u0163i \u201c\u00een forma unei singure opera\u0163ii\u201d. Acest transport poate face obiectul unui singur contract sau a unei serii de contracte f\u0103r\u0103 a-\u015fi pierde caracterul s\u0103u interna\u0163ional.<\/span><\/div>\n<div style=\"line-height: 19.5px; margin: 18pt 0cm 12pt; text-indent: 36pt;\"><b><span lang=\"EN-US\">Drepturile, obliga\u0163iile \u015fi r\u0103spunderea expeditorului<\/span><\/b><\/div>\n<div style=\"line-height: 19.5px; text-align: justify; text-indent: 36pt;\"><span lang=\"EN-US\">Fiecare transportor de bunuri are dreptul s\u0103 cear\u0103 expeditorului s\u0103-i prezinte un document<span class=\"MsoFootnoteReference\"><span class=\"MsoFootnoteReference\"><span lang=\"EN-US\" style=\"font-family: &quot;Times New Roman&quot;; font-size: 12pt;\"><\/span><\/span><\/span>&nbsp;\u015fi fiecare expeditor al bunurilor are dreptul s\u0103-i cear\u0103 transportatorului \u201cs\u0103 accepte acest document\u201d.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify; text-indent: 36pt;\"><span lang=\"EN-US\">Absen\u0163a, neregularitatea sau pierderea acestui document \u201cnu afecteaz\u0103 existen\u0163a \u015fi validitatea contractului de transport\u201d, care este guvernat de prevederile Conven\u0163iei (art.9).<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify; text-indent: 36pt;\"><span lang=\"EN-US\">Dac\u0103 \u2013 la cererea expeditorului \u2013 transportatorul a \u00eentocmit documentul, el va trebui, \u00een caz de nevoie, s\u0103 dovedeasc\u0103 c\u0103 a f\u0103cut acest lucru \u201c\u00een numele expeditorului\u201d.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify; text-indent: 36pt;\"><span lang=\"EN-US\">Expeditorul este r\u0103spunz\u0103tor de exactitatea declara\u0163iilor f\u0103cute cu privire la bunuri, date consemnate \u00een documentul de expedi\u0163ie.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify; text-indent: 36pt;\"><span lang=\"EN-US\">Expeditorul este r\u0103spunz\u0103tor de daunele suferite de transportator sau de orice alt\u0103 persoan\u0103, ca urmare a declara\u0163iilor sale \u201cincomplete, incorecte \u015fi inexacte\u201d.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify; text-indent: 36pt;\"><span lang=\"EN-US\">The Air Consignment Note este prima dovad\u0103 a \u00eencheierii contractului, a primirii bunurilor \u015fi a preciz\u0103rii condi\u0163iilor efectu\u0103rii transportului.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify; text-indent: 36pt;\"><span lang=\"EN-US\">Expeditorul are dreptul \u2013 pe r\u0103spunderea sa \u2013 s\u0103 dispun\u0103 debarcarea bunurilor pe aerodromul de destina\u0163ie sau pe unul din aerodromurile de oprire ale aeronavei \u00een drumul acesteia la destina\u0163ie. El poate s\u0103 solicite livrarea m\u0103rfurilor altei persoane dec\u0103t destinatarului; el poate dispune ca m\u0103rfurile s\u0103 fie aduse \u00eenapoi pe aerodromul unde au fost \u00eembarcate.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify; text-indent: 36pt;\"><span lang=\"EN-US\">Drepturile conferite expeditorului \u00eenceteaz\u0103 \u00een momentul \u00een care \u201c\u00eencep drepturile destinatarului\u201d. \u00cen cazul \u00een care destinatarul nu accept\u0103 documentul de expedi\u0163ie a m\u0103rfurilor, ori dac\u0103 nu poate comunica cu expeditorul, acesta \u00ee\u015fi reia dreptul de a dispune de m\u0103rfuri.<\/span><\/div>\n<div style=\"line-height: 19.5px; margin: 18pt 0cm 12pt; text-indent: 36pt;\"><b><span lang=\"EN-US\">Drepturile, obliga\u0163iile \u015fi r\u0103spunderea transporatorului (c\u0103r\u0103u\u015fului)<\/span><\/b><\/div>\n<div style=\"line-height: 19.5px; text-align: justify; text-indent: 36pt;\"><span lang=\"EN-US\">Drepturile \u015fi obliga\u0163iile transportatorului (c\u0103r\u0103u\u015fului) privesc:<\/span><\/div>\n<div style=\"line-height: 19.5px; margin-left: 72pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\">a.<span style=\"font-family: &quot;Times New Roman&quot;; font-size: 7pt; font-stretch: normal; font-variant-east-asian: normal; font-variant-numeric: normal; line-height: normal;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/span><\/span><span lang=\"EN-US\">efectuarea transportului \u00een conformitate cu clauzele stipulate \u00een contract;<\/span><\/div>\n<div style=\"line-height: 19.5px; margin-left: 72pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\">b.<span style=\"font-family: &quot;Times New Roman&quot;; font-size: 7pt; font-stretch: normal; font-variant-east-asian: normal; font-variant-numeric: normal; line-height: normal;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/span><\/span><span lang=\"EN-US\">respectarea normelor legale privind garantarea deplinei securit\u0103\u0163i a transportului;<\/span><\/div>\n<div style=\"line-height: 19.5px; margin-left: 72pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\">c.<span style=\"font-family: &quot;Times New Roman&quot;; font-size: 7pt; font-stretch: normal; font-variant-east-asian: normal; font-variant-numeric: normal; line-height: normal;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/span><\/span><span lang=\"EN-US\">asigurarea transportului m\u0103rfurilor f\u0103r\u0103 pierderi de la preluarea lor p\u00e2n\u0103 la momentul pred\u0103rii&nbsp; la destina\u0163ie.<\/span><\/div>\n<div style=\"line-height: 19.5px; margin-top: 6pt; text-align: justify; text-indent: 36pt;\"><span lang=\"EN-US\">C\u0103r\u0103u\u015ful are dreptul s\u0103-i cear\u0103 expeditorului s\u0103 emit\u0103 \u015fi s\u0103-i \u00eenm\u00e2neze documentul numit \u201cair consignment note\u201d sau s\u0103-i cear\u0103 expeditorului \u015fi s\u0103 emit\u0103 documente de expedi\u0163ie separate c\u00e2nd exist\u0103 mai mult de un pachet.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify; text-indent: 36pt;\"><span lang=\"EN-US\">Tot c\u0103r\u0103u\u015ful este r\u0103spunz\u0103tor pentru daune \u00een cazul mor\u0163ii, r\u0103nirii unui pasager, dac\u0103 accidentul a avut loc la bordul aeronavei ori \u00een cursul oric\u0103rei opera\u0163iuni de \u00eembarcare sau debarcare.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify; text-indent: 36pt;\"><span lang=\"EN-US\">Transportatorul (c\u0103r\u0103u\u015ful) este r\u0103spunz\u0103tor pentru distrugerea, pierderea sau pentru orice daune provocate bagajelor sau m\u0103rfurilor.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify; text-indent: 36pt;\"><span lang=\"EN-US\">C\u0103r\u0103u\u015ful este r\u0103spunzator pentru pierderile provocate de \u00eent\u00e2rzierea \u00een transportul aerian al pasagerilor, bagajelor sau ale m\u0103rfurilor.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify; text-indent: 36pt;\"><span lang=\"EN-US\">Transportatorul nu este r\u0103spunz\u0103tor \u00een cazul \u00een care dovede\u015fte c\u0103 el \u015fi agen\u0163ii s\u0103i au luat toate m\u0103surile necesare s\u0103 evite pierderea ori c\u0103 a fost imposibil pentru el \u015fi pentru agen\u0163ii s\u0103i s\u0103 ia asemenea m\u0103suri.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify; text-indent: 36pt;\"><span lang=\"EN-US\">Dac\u0103 transportatorul dovede\u015fte c\u0103 pierderea a fost provocat\u0103 din neglijen\u0163\u0103 sau culpa unei persoane, instan\u0163a poate \u2013 potrivit prevederilor Conven\u0163iei \u2013 s\u0103 exonereze c\u0103r\u0103u\u015ful \u00een tot sau \u00een parte de r\u0103spunderea sa.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify; text-indent: 36pt;\"><span lang=\"EN-US\">\u00cen cazul \u00een care transportul este efectuat de mai mul\u0163i c\u0103r\u0103u\u015fi succesivi, fiecare c\u0103r\u0103u\u015f care a acceptat pasageri, bagaje \u015fi m\u0103rfuri, fiind una din p\u0103r\u0163ile contractante, ac\u0163iunea \u00een desp\u0103gubire este \u00eendreptat\u0103 contra c\u0103r\u0103u\u015fului \u00een timpul transportului c\u0103reia s-a produs accidentul sau \u00eent\u00e2rzierea, cu excep\u0163ia situa\u0163iei \u00een care \u2013 printr-un acord expres \u2013 primul c\u0103r\u0103u\u015f \u015fi-a asumat r\u0103spunderea pentru \u00eentregul transport.<\/span><\/div>\n<div style=\"line-height: 19.5px; margin: 18pt 0cm 12pt; text-indent: 36pt;\"><b><span lang=\"EN-US\">Preciz\u0103ri \u015fi dezvolt\u0103ri aduse prin Protocolul semnat la Haga la 28 septembrie 1955<\/span><\/b><\/div>\n<div style=\"line-height: 19.5px; text-align: justify; text-indent: 36pt;\"><span lang=\"EN-US\">\u00cen anul 1955, lu\u00e2ndu-se \u00een considerare evolu\u0163iile \u00eenregistrate \u00een acest domeniu, s-au f\u0103cut unele preciz\u0103ri \u015fi s-au adus anumite \u00eembun\u0103t\u0103\u0163iri prevederilor stipulate \u00een Conven\u0163ia din 1929.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify; text-indent: 36pt;\"><span lang=\"EN-US\">Protocolul din 1955 precizeaz\u0103 c\u0103 certificatul de transport va con\u0163ine:<\/span><\/div>\n<div style=\"line-height: 19.5px; font-variant-numeric: normal; line-height: normal;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/span><\/span><span lang=\"EN-US\">indica\u0163ia locurilor de plecare \u015fi de destina\u0163ie;<\/span><\/div>\n<div style=\"line-height: 19.5px; margin-left: 72pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\">b.<span style=\"font-family: &quot;Times New Roman&quot;; font-size: 7pt; font-stretch: normal; font-variant-east-asian: normal; font-variant-numeric: normal; line-height: normal;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/span><\/span><span lang=\"EN-US\">dac\u0103 locurile de plecare \u015fi de destina\u0163ie se afl\u0103 \u00een teritoriul unei singure p\u0103r\u0163i contractante, ori dac\u0103 unul sau mai multe locuri convenite pentru oprirea aeronavei sunt pe teritoriul altei p\u0103r\u0163i contractante s\u0103 indice cel pu\u0163in unul din aceste locuri de oprire;<\/span><\/div>\n<div style=\"line-height: 19.5px; margin-left: 72pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\">c.<span style=\"font-family: &quot;Times New Roman&quot;; font-size: 7pt; font-stretch: normal; font-variant-east-asian: normal; font-variant-numeric: normal; line-height: normal;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/span><\/span><span lang=\"EN-US\">o notificare s\u0103 se fac\u0103 expeditorului \u00een leg\u0103tur\u0103 cu faptul c\u0103, transportului care include destina\u0163ia sau oprirea \u00eentr-o alt\u0103 \u0163ar\u0103 unde s-a f\u0103cut \u00eembarcarea, pot s\u0103 i se aplice prevederile Conven\u0163iei de la Var\u015fovia<span class=\"MsoFootnoteReference\"><span class=\"MsoFootnoteReference\"><span lang=\"EN-US\" style=\"font-family: &quot;Times New Roman&quot;; font-size: 12pt;\"><\/span><\/span><\/span>&nbsp;care guverneaz\u0103 \u00een cele mai multe cazuri limit\u0103rile r\u0103spunderii c\u0103r\u0103u\u015filor \u00een leg\u0103tur\u0103 cu pierderea sau avarierea \u00een transportul cargo<span class=\"MsoFootnoteReference\"><span class=\"MsoFootnoteReference\"><span lang=\"EN-US\" style=\"font-family: &quot;Times New Roman&quot;; font-size: 12pt;\"><\/span><\/span><\/span>.<\/span><\/div>\n<div style=\"line-height: 19.5px; margin-top: 6pt; text-align: justify; text-indent: 36pt;\"><span lang=\"EN-US\">Limitele r\u0103spunderii stipulate \u00een Conven\u0163ia de la Var\u015fovia din 1929 nu se vor aplica, dac\u0103 se dovede\u015fte c\u0103 pierderile au fost rezultatul unei omisiuni a c\u0103r\u0103u\u015fului, a angaja\u0163ilor sau agen\u0163ilor s\u0103i, f\u0103cut\u0103, cu inten\u0163ie s\u0103 provoace pierderi ori din nechipzuin\u0163\u0103, fiind con\u015ftien\u0163i c\u0103 pierderea ar putea s\u0103 aib\u0103 loc, cu condi\u0163ia ca, \u00een cazul unui asemenea act de omisiune a angajatului sau al agentului, s\u0103 se dovedeasc\u0103 c\u0103 ei ac\u0163ionau ca angaja\u0163i ai c\u0103r\u0103u\u015fului.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify; text-indent: 36pt;\"><span lang=\"EN-US\">Luarea \u00een primire a bagajului ori a cargo de c\u0103tre persoana \u00eendrituit\u0103 s\u0103 i se livreze, f\u0103r\u0103 vreo pl\u00e2ngere, este, la prima vedere, dovada c\u0103 s-au livrat \u00een bune condi\u0163iuni conform documentului de transport.<\/span><\/div>\n<div style=\"line-height: 19.5px; margin: 18pt 0cm 12pt; text-indent: 36pt;\"><b><span lang=\"EN-US\">Reglement\u0103ri complementare la Conven\u0163ia de la Var\u015fovia<\/span><\/b><\/div>\n<div style=\"line-height: 19.5px; text-align: justify; text-indent: 36pt;\"><span lang=\"EN-US\">\u00cen septembrie 1961, s-au adoptat reglement\u0103ri complementare la Conven\u0163ia de la Var\u015fovia pentru modificarea unor reguli privind transportul aerian interna\u0163ional efectuat de alt\u0103 persoan\u0103 dec\u00e2t transportatorul contractual. Aceste noi reglement\u0103ri au fost \u00eencorporate \u00eentr-o Conven\u0163ie complementar\u0103, care a fost \u00eencheiata la Guadalajara (Mexic), de la 18 septembrie 1961.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify; text-indent: 36pt;\"><span lang=\"EN-US\">Conven\u0163ia de la Guadalajara deosebe\u015fte dou\u0103 categorii de transportatori:<\/span><\/div>\n<div style=\"line-height: 19.5px; margin-left: 108pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\">a.<span style=\"font-family: &quot;Times New Roman&quot;; font-size: 7pt; font-stretch: normal; font-variant-east-asian: normal; font-variant-numeric: normal; line-height: normal;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/span><\/span><span lang=\"EN-US\">trasnportatorii contractuali;<\/span><\/div>\n<div style=\"line-height: 19.5px; margin-left: 108pt; text-align: justify; text-indent: -18pt;\"><span lang=\"EN-US\">b.<span style=\"font-family: &quot;Times New Roman&quot;; font-size: 7pt; font-stretch: normal; font-variant-east-asian: normal; font-variant-numeric: normal; line-height: normal;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/span><\/span><span lang=\"EN-US\">trasportatorii de fapt.<\/span><\/div>\n<div style=\"line-height: 19.5px; margin-top: 6pt; text-align: justify; text-indent: 36pt;\"><span lang=\"EN-US\">Transportatorul de fapt \u2013 \u00een baza Conven\u0163iei de la Guadalajara \u2013 este acea persoana (\u00eentreprindere) alta dec\u00e2t transportatorul contractual, care efectueaz\u0103 \u00een fapt, \u00een baza unei autoriz\u0103ri date de transportatorul contractual, un transport interna\u0163ional aerian (art.1).<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify; text-indent: 36pt;\"><span lang=\"EN-US\">&nbsp;\u00cen rela\u0163iile comerciale de transport aerian interna\u0163ional a ap\u0103rut nevoia unei asemenea reglement\u0103ri, deoarece, Conven\u0163ia de la Var\u015fovia nu definea statutul juridic al transportatorului de fapt.&nbsp; Prin Conven\u0163ia de la Guadalajara, transportatorul de fapt \u2013 care efectueaz\u0103 transportul aerian \u00een baza autoriza\u0163iei transportatorului contractual \u2013 este supus, ca \u015fi transportatorul contractual reglement\u0103rilor Conven\u0163iei de la Var\u015fovia.<\/span><\/div>\n<div style=\"line-height: 19.5px; margin: 18pt 0cm 12pt; text-indent: 36pt;\"><b><span lang=\"EN-US\">R\u0103spunderea transportatorului (c\u0103r\u0103u\u015fului) de fapt<\/span><\/b><\/div>\n<div style=\"line-height: 19.5px; text-align: justify; text-indent: 36pt;\"><span lang=\"EN-US\">\u00cen baza Conven\u0163iei de la Guadalajara, transportatorul de fapt r\u0103spunde numai pentru transportul efectuat, \u00een timp ce transportatorul contractual r\u0103spunde pentru totalitatea transportului aerian \u00een conformitate cu prevederile contractului.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify; text-indent: 36pt;\"><span lang=\"EN-US\">Potrivit Conven\u0163iei de la Guadalajara, actele \u015fi omisiunile transportului de fapt sau ale prepu\u015filor s\u0103i \u2013 \u00een exercitarea func\u0163iei lor \u00een timpul transportului efectuat \u2013 sunt considerate \u00een aceea\u015fi m\u0103sur\u0103 ca acte \u015fi omisiuni ale transportatorului contractual.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify; text-indent: 36pt;\"><span lang=\"EN-US\">\u00cen acela\u015fi timp, actele \u015fi omisiunile transportatorului (c\u0103r\u0103u\u015fului) contractual sau ale prepu\u015filor s\u0103i \u2013 \u00een exercitarea func\u0163iei lor \u00een timpul transportului efectuat \u2013 sunt considerate acte \u015fi omisiuni ale transportatorului (c\u0103r\u0103u\u015fului) de fapt.<\/span><\/div>\n<div style=\"line-height: 19.5px; margin: 18pt 0cm 12pt; text-indent: 36pt;\"><b><span lang=\"EN-US\">Solu\u0163ionarea litigiilor<\/span><\/b><\/div>\n<div style=\"line-height: 19.5px; text-align: justify; text-indent: 36pt;\"><span lang=\"EN-US\">&nbsp;Potrivit Conven\u0163iei de la Guadalajara, orice ac\u0163iune intentat\u0103 \u00een legatur\u0103 cu transportul efectuat de c\u0103tre transportatorul de fapt, poate fi exercitat\u0103 \u00eempotriva acestuia sau \u00eempotriva transportatorului contractual ori \u00eempotriva ambilor. Op\u0163iunea este a reclamantului cu privire la modul cum s\u0103-\u015fi exercite ac\u0163iunea.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify; text-indent: 36pt;\"><span lang=\"EN-US\">\u00cen cazul \u00een care ac\u0163iunea a fost intentat\u0103 numai \u00eempotriva unuia dintre cei doi transportatori acesta are dreptul s\u0103 introduc\u0103 \u00een cauz\u0103 pe cel\u0103lalt transportator.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify; text-indent: 36pt;\"><span lang=\"EN-US\">Dac\u0103 \u00een contract se stipuleaz\u0103 o cauz\u0103 care ar viza exonerarea de r\u0103spundere a transportatorului (c\u0103r\u0103u\u015fului) contractual sau a transportatorului (c\u0103r\u0103u\u015fului) de fapt, o asemenea clauz\u0103 este nul\u0103 \u015fi f\u0103r\u0103 efect.<\/span><\/div>\n<div style=\"line-height: 19.5px; margin: 18pt 0cm 12pt; text-indent: 36pt;\"><b><span lang=\"EN-US\">Reglement\u0103ri stipulate \u00een Conven\u0163ia privind Avia\u0163ia Civil\u0103 Interna\u0163ional\u0103<\/span><\/b><\/div>\n<div style=\"line-height: 19.5px; text-align: justify; text-indent: 36pt;\"><span lang=\"EN-US\">Reprezentan\u0163ii statelor au negociat \u015fi adoptat Conven\u0163ia privind Avia\u0163ia Civil\u0103 Interna\u0163ional\u0103, urm\u0103rind instituirea unor principii pentru ca avia\u0163ia civil\u0103 interna\u0163ional\u0103 s\u0103 se poat\u0103 dezvolta \u00eentr-un mod sigur \u015fi ordonat \u015fi pentru ca serviciile interna\u0163ionale de transporturi aeriene s\u0103 poat\u0103 fi \u00eentemeiate pe o baz\u0103 de posibilit\u0103\u0163i egale pentru to\u0163i \u015fi s\u0103 fie exploatate \u00eentr-un mod s\u0103n\u0103tos \u015fi economic<span class=\"MsoFootnoteReference\"><span class=\"MsoFootnoteReference\"><span lang=\"EN-US\" style=\"font-family: &quot;Times New Roman&quot;; font-size: 12pt;\"><\/span><\/span><\/span>.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify; text-indent: 36pt;\"><span lang=\"EN-US\">Conven\u0163ia stipuleaz\u0103 dreptul fiec\u0103rui stat contractant de a decide cu privire la \u00eembarcarea pe teritoriul s\u0103u a c\u0103l\u0103torilor sau a m\u0103rfurilor pentru a le transporta, contra plat\u0103 sau a unui contract de loca\u0163iune.<\/span><\/div>\n<div style=\"line-height: 19.5px; text-align: justify; text-indent: 36pt;\"><span lang=\"EN-US\">Conven\u0163ia con\u0163ine reglement\u0103ri privind naviga\u0163ia aerian\u0103; regulile de zbor; taxele de aeroport; formalit\u0103\u0163i vamale; taxe vamale; restric\u0163ii la \u00eenc\u0103rc\u0103tur\u0103, etc, a c\u0103ror cunoa\u015ftere se impune \u015fi comercian\u0163ilor pentru a-\u015fi \u00eencheia contractele de transport interna\u0163ional al m\u0103rfurilor respect\u00e2nd \u015fi normele aplicabile din aceast\u0103 Conven\u0163ie.
