Bunurile ce constituie prezentul contract sunt<sup>1)<\/sup>&nbsp;: suprafata locativa, dotari curente (instalatie de iluminat electric, instalatie de apa rece si calda, instalatie de aer conditionat).<\/span><\/div>\n<div style=\"text-align: justify;\"><b><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 9pt;\">III. OBLIGATIILE PARTILOR<\/span><\/b><\/div>\n<div style=\"text-align: justify;\"><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 9pt;\">3.1. Obligatiile locatarului sunt urmatoarele:<\/span><\/div>\n<div style=\"margin-left: 54pt; text-align: justify; text-indent: -18pt;\"><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 9pt;\">a)<span style=\"font-family: &quot;Times New Roman&quot;; font-size: 7pt; font-stretch: normal; font-variant-east-asian: normal; font-variant-numeric: normal; line-height: normal;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/span><\/span><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 9pt;\">sa plateasca chiria de 150 USD luna la cursul zilei BNR in conditiile stabilite;<\/span><\/div>\n<div style=\"margin-left: 54pt; text-align: justify; text-indent: -18pt;\"><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 9pt;\">b)<span style=\"font-family: &quot;Times New Roman&quot;; font-size: 7pt; font-stretch: normal; font-variant-east-asian: normal; font-variant-numeric: normal; line-height: normal;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/span><\/span><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 9pt;\">sa foloseasca in perioada locatiunii bunurile care constituie obiectul prezentului contract, ca un posesor de buna-credinta, purtand raspunderea pentru toate pagubele produse din culpa sa;<\/span><\/div>\n<div style=\"margin-left: 54pt; text-align: justify; text-indent: -18pt;\"><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 9pt;\">c)<span style=\"font-family: &quot;Times New Roman&quot;; font-size: 7pt; font-stretch: normal; font-variant-east-asian: normal; font-variant-numeric: normal; line-height: normal;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/span><\/span><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 9pt;\">sa restituie la sfarsitul locatiunii bunurile care fac obiectul prezentului contract in starea in care le-a preluat consemnata in procesul-verbal de predare-primire;<\/span><\/div>\n<div style=\"margin-left: 54pt; text-align: justify; text-indent: -18pt;\"><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 9pt;\">d)<span style=\"font-family: &quot;Times New Roman&quot;; font-size: 7pt; font-stretch: normal; font-variant-east-asian: normal; font-variant-numeric: normal; line-height: normal;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/span><\/span><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 9pt;\">sa acorde asistenta tehnica pentru exploatarea normala a spatiului comercial ce face obiectul locatiunii ;<\/span><\/div>\n<div style=\"margin-left: 54pt; text-align: justify; text-indent: -18pt;\"><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 9pt;\">e)<span style=\"font-family: &quot;Times New Roman&quot;; font-size: 7pt; font-stretch: normal; font-variant-east-asian: normal; font-variant-numeric: normal; line-height: normal;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/span><\/span><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 9pt;\">in cazul in care in exploatarea bunului care face obiectul locatiunii apar defectiuni tehnice din culpa locatarului, locatorul este indreptatit sa pretinda si sa i se plateasca despagubiri<sup>3)<\/sup>;<\/span><\/div>\n<div style=\"margin-left: 54pt; text-align: justify; text-indent: -18pt;\"><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 9pt;\">f)<span style=\"font-family: &quot;Times New Roman&quot;; font-size: 7pt; font-stretch: normal; font-variant-east-asian: normal; font-variant-numeric: normal; line-height: normal;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/span><\/span><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 9pt;\">sa garanteze restituirea bunurilor in starea in care s-au preluat printr-un contract de garantie accesoriu contractului de locatiune<sup>3)<\/sup>.<\/span><\/div>\n<div style=\"text-align: justify;\"><b><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 9pt;\">IV. DURATA CONTRACTULUI<\/span><\/b><\/div>\n<div style=\"margin-left: 21.55pt; text-align: justify; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 9pt;\">4.1. Durata locatiunii este de 2 ani incepand cu data de 30 noiembrie 2003 pana la data de 30 noiembrie 2005.<\/span><\/div>\n<div style=\"text-align: justify;\"><b><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 9pt;\">V. PRETUL CONTRACTULUI<\/span><\/b><\/div>\n<div style=\"margin-left: 21.55pt; text-align: justify; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 9pt;\">5.1. Partile au convenit ca locatarul sa plateasca o chirie de 150 USSD la cursul zilei BNR astfel : la data de 15 a fiecarei luni, locatarul este obligat sa plateasca chiria.<\/span><\/div>\n<div style=\"text-align: justify;\"><b><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 9pt;\">VI. SUBLOCATIUNEA CONTRACTULUI{4)T<\/span><\/b><\/div>\n<div style=\"margin-left: 21.55pt; text-align: justify; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 9pt;\">6.1. Locatarul are dreptul de a transmite, in tot sau in parte, cu acordul scris al proprietarului, dreptul de folosinta asupra unui tert, in baza unui contract de sublocatiune (subinchiriere).<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-align: justify; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 9pt;\">6.2. Sublocatiunea sa nu fie convenita in conditii care sa contravina conditiilor din contractul de locatiune.<\/span><\/div>\n<div style=\"text-align: justify;\"><b><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 9pt;\">VII. CESIUNEA CONTRACTULUI<\/span><\/b><\/div>\n<div style=\"margin-left: 21.55pt; text-align: justify; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 9pt;\">7.1. Cesiunea contractului trebuie sa fie notificata locatorului sau acceptata de acesta printr-un act aditional la prezentul contract.<\/span><\/div>\n<div style=\"text-align: justify;\"><b><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 9pt;\">VIII. FORTA MAJORA<\/span><\/b><\/div>\n<div style=\"margin-left: 21.55pt; text-align: justify; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 9pt;\">9.1. Nici una dintre partile contractante nu raspunde de neexecutarea la termen si\/sau executarea in mod necorespunzator &#8211; totala sau partiala &#8211; a oricarei obligatii care ii revine in baza prezentului contract, daca neexecutarea sau executarea necorespunzatoare a obligatiei respective a fost cauzata de forta majora asa cum este definita de lege.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-align: justify; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 9pt;\">9.2. Partea care invoca forta majora este obligata sa notifice celeilalte parti in termen de 72 ore producerea evenimentului si sa ia toate masurile posibile in vederea limitarii consecintelor lui.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-align: justify; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 9pt;\">9.3. Daca in termen de 5 zile de la producere evenimentul respectiv nu inceteaza, partile au dreptul sa-si notifice incetarea de plin drept a prezentului contract, fara ca vreuna dintre ele sa pretinda daune-interese.<\/span><\/div>\n<div style=\"text-align: justify;\"><b><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 9pt;\">X. NOTIFICARI<\/span><\/b><\/div>\n<div style=\"margin-left: 21.55pt; text-align: justify; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 9pt;\">10.1. In acceptiunea partilor contractante, orice notificare adresata de una dintre acestea celeilalte este valabil indeplinita daca va fi transmisa la adresa\/sediul prevazut in partea introductiva a prezentului contract.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-align: justify; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 9pt;\">10.2. In cazul in care notificarea se face pe cale postala, ea va fi transmisa, prin scrisoare recomandata, cu confirmare de primire (A.R.) si se considera primita de destinatar la data mentionata pe confirmare de oficiul postal primitor.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-align: justify; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 9pt;\">10.3. Daca confirmarea se trimite prin telex sau telefax, ea se considera primita in prima zi lucratoare dupa cea in care a fost expediata.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-align: justify; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 9pt;\">10.4. Notificarile verbale nu se iau in considerare de nici una dintre parti, daca nu sunt confirmate, prin intermediul uneia dintre modalitatile prevazute la alineatele precedente.<\/span><\/div>\n<div style=\"text-align: justify;\"><b><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 9pt;\">XI. In cazul in care rezolvarea neintelegerilor nu este posibila pe cale amiabila, ele vor fi supuse spre solutionare tribunalului arbitral, conform regulilor de procedura aplicabile arbitrajului comercial ad-hoc, organizat de Camera de Comert si Industrie a Romaniei.<\/span><\/div>\n<div style=\"text-align: justify;\"><b><span lang=\"RO\" style=\"font-family: &quot;Bookman Old Style&quot;; font-size: 9pt;\">XII.
