OBIECTUL CONTRACTULUI<\/span><\/b><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">2.1. Copermuntantul prim declar ca dau in deplina proprietate copermutantului secund imobilul proprietatea mea, situat in &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;., format din teren in suprafata de &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;. mp si constructia din &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;., compusa din &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.. anexe gospodaresti &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;, astfel cum sunt identificate in schita de plan ce face parte integranta din prezentul contract.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">2.1.1. Am dobandit acest imobil prin &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230; si mi-a revenit in baza sentintei civile nr. &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;, data in Dosarul nr. &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230; de Judecatoria &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;, transcrisa sub nr. &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.. de Judecatoria &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;..<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">2.1.2. Evaluez acest imobil la suma de &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230; lei.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">2.1.3. In schimbul proprietatii asupra acestui imobil, primesc de la copermutantul secund, dreptul de proprietate asupra apartamentului nr. &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.., situat la etajul &#8230;.., scara &#8230;.., blocul &#8230;.., din &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230; .<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">2.2. Copermutantul secund declar ca dau in deplina proprietate copermutantului prim, apartamentul nr. &#8230;.., situat la etajul &#8230;.., scara &#8230;.., blocul &#8230;.. din &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;, compus din &#8230;.. camere si dependinte &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;, impreuna cu dreptul de coproprietate asupra partilor si dependintelor comune din imobil, care, prin natura si destinatia lor, sunt in folosinta comuna a tuturor proprietarilor.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">2.2.1. O data cu proprietatea se transmite si dreptul de folosinta asupra terenului aferent apartamentului in suprafata de &#8230;. mp atribuit pe durata existentei constructiei.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">2.2.2. Am dobandit acest apartament prin contractul de &#8230;&#8230;&#8230;&#8230;.. nr. &#8230;.. incheiat cu &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;., transcris sub nr. &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230; de &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230; .<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">2.2.3. Evaluez acest apartament la suma de &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230; lei.<\/span><\/div>\n<div><b><span lang=\"RO\" style=\"font-family: Arial;\">III. DURATA CONTRACTULUI<\/span><\/b><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">3.1. Transmiterea proprietatii asupra imobilului situat in &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230; are loc de azi, data autentificarii prezentului contract.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">3.2. Transmiterea proprietatii asupra apartamentului nr. &#8230;&#8230;. situat la etajul &#8230;.., scara &#8230;.., blocul &#8230;.., din &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;, are loc de astazi, &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230; data autentificarii prezentului contract.<\/span><\/div>\n<div><b><span lang=\"RO\" style=\"font-family: Arial;\">IV. OBLIGATIILE PARTILOR<\/span><\/b><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">4.1. Copermutantii (coschimbasii) au obligatia sa predea reciproc bunurile<sup>1)<\/sup>&nbsp;care fac obiectul prezentului contract.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">4.2. Imobilul mentionat mai sus este liber de orice sarcini, nu este scos din circuitul civil, prin trecere in proprietatea publica, fiind, in mod legal si continuu, in proprietatea si posesia copermutantului prim, de la data dobandirii si pana in prezent.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">4.3. Apartamentul mentionat mai sus este liber de sarcini, nu este scos din circuitul civil, prin trecere in proprietatea publica , fiind in mod legal si continuu, in proprietatea si posesia copermutantului secund de la data dobandirii si pana in prezent.<\/span><\/div>\n<div><b><span lang=\"RO\" style=\"font-family: Arial;\">V. RASPUNDEREA PENTRU EVICTIUNE ASUPRA BUNULUI IMOBIL<\/span><\/b><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">5.1. Copermutantii cunosc situatia juridica si de fapt a acestor imobile, ce formeaza obiectul prezentului contract de schimb, ca fiind cea descrisa mai sus si garanteaza ca nu sunt grevate de sarcini si raspund reciproc impotriva evictiunii, conform art. 1337 Cod civil.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">5.2. Transmiterea proprietatii si posesiunii fiecaruia dintre cele doua imobile are loc, fara indeplinirea altor formalitati, de astazi, &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;. data autentificarii prezentului contract.<\/span><\/div>\n<div><b><span lang=\"RO\" style=\"font-family: Arial;\">VI. CLAUZE FINALE<\/span><\/b><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">6.1. Impozitele si taxele aferente imobilelor sunt achitate, la zi, conform certificatelor nr. &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.. si nr. &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;, ambele eliberate de &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;, urmand ca de astazi, &#8230;&#8230;&#8230;&#8230; data autentificarii, sa treaca in sarcina noilor proprietari.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">6.2. Prezentul contract de schimb se face fara plata vreunei sulte intre copermutanti.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">6.3. Taxa de autentificare, timbrul judiciar si onorariul notarial sunt suportate de copermutanti, in parti egale.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">6.4. Partile declara, potrivit art. 45 alin. 3 din Legea nr. 36\/1995, ca vor indeplini formalitatile necesare pentru efectuarea operatiunilor de publicitate imobiliara.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">6.5.
