OBIECTUL CONTRACTULUI<\/span><\/b><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">2.1. Credirentierul transmite debirentierului cu titlu oneros\/gratuit urmatoarele bunuri<sup>1)<\/sup>&nbsp;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.. &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.. &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230; .<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">2.2. Credirentierul declara ca bunurile nu au fost scoase din circuitul civil, ramanand continuu in stapanirea sa, in mod legal, nu sunt grevate de sarcini sau servituti si garanteaza pe debirentier impotriva evictiunii, totale sau partiale, in conformitate cu prevederile art. 1337 din Codul civil.<\/span><\/div>\n<div align=\"center\" style=\"text-align: center;\"><b><span lang=\"RO\" style=\"font-family: Arial;\">sau<\/span><\/b><span lang=\"RO\" style=\"font-family: Arial;\"><\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">2.2. Credirentierul plateste suma de &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230; lei debirentierului, cu scopul ca acesta din urma sa plateasca credirentierului o renta lunara de &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230; lei, pana la decesul credirentierului.<\/span><\/div>\n<div><b><span lang=\"RO\" style=\"font-family: Arial;\">III. DURATA CONTRACTULUI<\/span><\/b><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">3.1. Contractul incepe sa-si produca efectele o data cu plata primei rate la data de &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;, asigurandu-se o renta viagera anuala de &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.. lei, platibila la locuinta credirentierului, in rate lunare egale, in ziua a &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;. a fiecarei luni.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">3.2. La data decesului credirentierului &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230; inceteaza si plata rentei viagere, din chiar ziua decesului acestuia. Mostenitorii vor primi renta viagera restanta, dupa ce vor face dovada calitatii de mostenitori.<\/span><\/div>\n<div><b><span lang=\"RO\" style=\"font-family: Arial;\">IV. OBLIGATIILE PARTILOR<\/span><\/b><\/div>\n<div><span lang=\"RO\" style=\"font-family: Arial;\">4.1. Obligatiile debirentierului sunt urmatoarele:<\/span><\/div>\n<div style=\"margin-left: 43.1pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">a)<span style=\"font-family: &quot;Times New Roman&quot;; font-size: 7pt; font-stretch: normal; font-variant-east-asian: normal; font-variant-numeric: normal; line-height: normal;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">garanteaza cu<sup>2)<\/sup>&nbsp;(ipoteca, fidejusiune etc.) &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;. plata rentei viagere si se obliga ca nu va diminua aceasta garantie;<\/span><\/div>\n<div style=\"margin-left: 43.1pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">b)<span style=\"font-family: &quot;Times New Roman&quot;; font-size: 7pt; font-stretch: normal; font-variant-east-asian: normal; font-variant-numeric: normal; line-height: normal;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">sa plateasca renta la termenele stabilite;<\/span><\/div>\n<div style=\"margin-left: 43.1pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">c)<span style=\"font-family: &quot;Times New Roman&quot;; font-size: 7pt; font-stretch: normal; font-variant-east-asian: normal; font-variant-numeric: normal; line-height: normal;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">in caz de rezolutiune a contractului are obligatia de a institui credirentierului bunurile\/suma primita;<sup>3)<\/sup><\/span><\/div>\n<div style=\"margin-left: 43.1pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">d)<span style=\"font-family: &quot;Times New Roman&quot;; font-size: 7pt; font-stretch: normal; font-variant-east-asian: normal; font-variant-numeric: normal; line-height: normal;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">daca intervine anularea contractului din culpa sa, se obliga sa repare credirentierului prejudiciul cauzat.<\/span><\/div>\n<div><b><span lang=\"RO\" style=\"font-family: Arial;\">V. INCETAREA CONTRACTULUI<\/span><\/b><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">5.1. Contractul de renta viagera inceteaza:<\/span><\/div>\n<div style=\"margin-left: 39.55pt; text-indent: -18pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">a)<span style=\"font-family: &quot;Times New Roman&quot;; font-size: 7pt; font-stretch: normal; font-variant-east-asian: normal; font-variant-numeric: normal; line-height: normal;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">prin moartea persoanei in favoarea careia s-a constituit renta;<\/span><\/div>\n<div style=\"margin-left: 39.55pt; text-indent: -18pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">b)<span style=\"font-family: &quot;Times New Roman&quot;; font-size: 7pt; font-stretch: normal; font-variant-east-asian: normal; font-variant-numeric: normal; line-height: normal;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">la implinirea termenului de prescriptie extinctiva;<sup>&nbsp;4)<\/sup><\/span><\/div>\n<div><b><span lang=\"RO\" style=\"font-family: Arial;\">VI. CLAUZA PENALA<\/span><\/b><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">6.1. In cazul in care una dintre parti nu isi indeplineste obligatiile contractuale sau si le indeplineste in mod necorespunzator, se obliga sa plateasca celeilalte parti daune-interese in valoare de &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.., astfel: &#8230;&#8230;&#8230;&#8230;&#8230;&#8230; .<\/span><\/div>\n<div><b><span lang=\"RO\" style=\"font-family: Arial;\">VII. CLAUZE FINALE<\/span><\/b><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">7.1. Prezentul contract, reprezinta vointa partilor si inlatura orice alta intelegere verbala dintre acestea, anterioara sau ulterioara incheierii lui.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">7.2. In cazul in care partile isi incalca obligatiile lor, neexercitarea de partea care sufera vreun prejudiciu a dreptului de a cere executarea intocmai sau prin echivalent banesc a obligatiei respective nu inseamna ca ea a renuntat la acest drept al sau.<\/span><\/div>\n<div style=\"margin-left: 21.55pt; text-indent: -21.55pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">7.3. Prezentul contract a fost incheiat intr-un numar de &#8230;&#8230;&#8230;&#8230;&#8230; exemplare, din care &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230; astazi, data semnarii lui.<\/span><\/div>\n<div><\/div>\n<div align=\"center\" style=\"text-align: center;\"><span lang=\"RO\" style=\"font-family: Arial;\">CREDIRENTIER,<\/span><\/div>\n<div align=\"center\" style=\"text-align: center;\"><\/div>\n<div align=\"center\" style=\"text-align: center;\"><span lang=\"RO\" style=\"font-family: Arial;\">DEBIRENTIER,<\/span><\/div>\n<div><\/div>\n<div><b><span lang=\"RO\" style=\"font-family: Arial;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;NOTE<\/span><\/b><span lang=\"RO\" style=\"font-family: Arial;\">:<\/span><\/div>\n<div style=\"margin-left: 54pt; text-indent: -18pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">1)<span style=\"font-family: &quot;Times New Roman&quot;; font-size: 7pt; font-stretch: normal; font-variant-east-asian: normal; font-variant-numeric: normal; line-height: normal;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">In cazul in care obiectul contractului de renta viagera il constituie un teren, actul se intocmeste in forma autentica.<\/span><\/div>\n<div style=\"margin-left: 54pt; text-indent: -18pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">2)<span style=\"font-family: &quot;Times New Roman&quot;; font-size: 7pt; font-stretch: normal; font-variant-east-asian: normal; font-variant-numeric: normal; line-height: normal;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">Conform art. 1646 Cod civil, persoana in favoarea careia s-a constituit renta, cu titlu oneros, poate cere desfiintarea contractului, daca debirentierul nu ofera garantiile promise.<\/span><\/div>\n<div style=\"margin-left: 54pt; text-indent: -18pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">3)<span style=\"font-family: &quot;Times New Roman&quot;; font-size: 7pt; font-stretch: normal; font-variant-east-asian: normal; font-variant-numeric: normal; line-height: normal;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">Conform art. 1647 Cod civil, contractul de renta viagera este un contract aleatoriu, a carui rezolutiune nu poate fi ceruta de catre credirentier pentru neexecutare. Si totusi, rezolutiunea contractului va fi posibila atunci cand partile au inscris in contract un pact comisoriu expres.<\/span><\/div>\n<div style=\"margin-left: 54pt; text-indent: -18pt;\"><span lang=\"RO\" style=\"font-family: Arial;\">4)<span style=\"font-family: &quot;Times New Roman&quot;; font-size: 7pt; font-stretch: normal; font-variant-east-asian: normal; font-variant-numeric: normal; line-height: normal;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/span><\/span><span lang=\"RO\" style=\"font-family: Arial;\">Atunci cand, la moartea credirentierului, raman sume restante, mostenitorii acestuia au dreptul sa urmareasca sumele scadente la data decesului. Dreptul la actiune, prin care se pretind ratele scadente, se va exercita in termenul general de prescriptie de trei ani.
